No. Paying for software—or for a device that contains it—does not by itself tell you whether you own the software copy, own its copyright, or have permission to install, use, transfer, or resell it. Those are separate questions, and the agreement and applicable law help answer them.
What does buying software actually buy?
It helps to separate three things that can be bundled into one transaction:
- The physical object: You may own a computer, phone, game disc, or other item that contains or stores software.
- The copyright: The right to control the software as a copyrighted work is distinct from ownership of the object or copy.
- Permission to use a copy: The terms may grant rights to use the software subject to limits, or describe another arrangement. Price alone does not settle which applies.
Under 17 U.S.C. § 202, “Ownership of a copyright, or of any of the exclusive rights under a copyright, is distinct from ownership of any material object in which the work is embodied.” The statute also says transferring the material object does not, by itself, transfer copyright in the work. Read § 202 in the U.S. Copyright Office’s Title 17 materials.

Nor does calling a transaction a “license” automatically answer every legal question. The contract’s terms and the law that applies to the transaction matter.

Does the software price determine whether you own the copy?
No. A one-time payment is not, on its own, proof that you own the software copy rather than hold a license to use it. The agreement may specify what rights are granted, who retains title, and what restrictions apply. The outcome depends on the particular terms and jurisdiction.
In the Ninth Circuit, Vernor v. Autodesk, 621 F.3d 1102 (9th Cir. 2010), describes a framework for deciding when a software user is a licensee rather than an owner of a copy. As summarized by the U.S. Copyright Office, the analysis looks at whether the copyright holder “(1) specifies that the user is granted a license; (2) significantly restricts the user’s ability to transfer the software; and (3) imposes notable use restrictions.” The Copyright Office’s 2016 report on software-enabled consumer products discusses the framework.

This is a Ninth Circuit example, not a rule to assume applies identically everywhere or that resolves every contract. The Copyright Office’s 2010 annual report summarizes the conclusion in Vernor that first sale did not apply on the facts of that case. Whether a particular buyer owns a copy or is a licensee affects questions such as resale and transfer; the sources do not determine the status of an unseen agreement or transaction.

What copying does U.S. copyright law allow?
Section 117 of the U.S. Copyright Act provides limited rights to an owner of a computer-program copy. Subject to statutory conditions, the owner may make another copy or adaptation when it is an essential step in using the program with a machine and the copy or adaptation is used in no other manner, or may make an archival copy. The section also limits transfer of copies made under it.

These are specific statutory provisions, not blanket permission for every purchaser to make unlimited copies, share software, or redistribute it. Whether you qualify as an owner of the copy is a separate question. See § 117 in the Copyright Office’s Title 17 materials.
How to check what your software agreement permits
Find the terms that apply to your transaction. They may be linked at checkout, included with packaging, presented during device setup, or available through the software or account. Compare the actual wording against these questions:

- What rights are granted? Look for the stated scope, such as personal or commercial use, a limited or perpetual term, or subscription-based access.
- Who holds title, and how is the arrangement described? Note whether the agreement expressly calls it a license and says who retains title to the copy.
- Who and what may use it? Check limits on users, devices, installations, accounts, or locations.
- Can it be transferred or resold? Look for restrictions on transferring the copy, license, or account, as well as rules about resale or lending.
- How long does access last? Review duration, renewal, and termination terms. Check what use, access, updates, or account functions remain after termination or subscription expiry.
- What copying or changes are allowed? Find the rules for backups, archival copies, modification, reverse engineering, and sharing.
- Is software bundled with a product? Check whether the terms also address updates, cloud services, and connected features, or cover them separately.
- Which law and agreement apply? Identify the governing-law language and the terms tied to your specific purchase or device.
These are questions to investigate, not conclusions about the effect of your contract. A general legal explanation cannot determine what an agreement you have not reviewed grants or restricts.
How to compare software purchase terms
When comparing two offers, do not rely on whether either is described as a purchase or a license. Compare the rights and limits that matter to your use:

There is no universal outcome for every software agreement. The terms and applicable law must be considered together, especially before relying on a right to transfer, keep using, or resell software.
