Maybe. Before renting out a driveway or parking space, make sure you have the right to let someone else use it, check any property or building restrictions, ask the relevant local authority about local rules, and confirm with your insurer that paid third-party parking is covered. The answer depends on your location, your rights to the space and the terms of your insurance policy.

Can you legally rent out your parking space?

First establish that you are entitled to offer the space. Owning the home does not necessarily settle every issue: a mortgage, lease, shared-building arrangement or other restriction may limit how the space can be used. If you rent, lease or share the property, read the governing documents and ask the landlord, freeholder or building manager about any required consent.

Check who controls the space

  • Owner: Check your mortgage terms, property restrictions and any shared-building rules.
  • Tenant: Check whether the space is included in your tenancy and whether subletting, business use or third-party access requires the landlord’s approval.
  • Leaseholder or resident in a managed building: Review the lease and building rules for parking, access, visitors, nuisance and insurance provisions. In England, lease conditions are set out in the lease and failing to follow them can have legal consequences. GOV.UK explains leaseholders’ rights and responsibilities.

When the documents are unclear, ask the person or organization that controls the relevant right—such as a landlord, lender, freeholder or building manager—and keep any response in writing. A listing on a parking platform does not establish that you have permission to rent the space; a JustPark public-sector contract, for example, places responsibility for obtaining required permissions on the space provider.

Do you need planning permission?

Planning rules depend on where the property is. In England, government guidance says renting out parking spaces should be possible without planning permission when there are no substantive planning concerns, such as public nuisance to neighbours. This is a qualified, England-specific baseline—not a blanket permission for every property or arrangement.

The local planning authority assesses the circumstances, including whether the use amounts to a material change and whether existing planning conditions or other restrictions apply. The scale and character of the activity matter: use of one existing space may raise different questions from a more intensive arrangement that creates nuisance or changes how the property is used. Read the GOV.UK planning guidance and contact the authority if the position is uncertain. Rules elsewhere may differ.

Will your home or building insurance cover it?

Do not assume that ordinary home or building insurance covers paid parking or the risks of giving drivers access to your property. GOV.UK warns that home insurance may not cover business activity. Coverage depends on the policy and the facts of the arrangement, so contact your insurer or broker before accepting a booking.

Ask specifically about damage to property, third-party liability and any policy changes needed, and request confirmation in writing. A London borough’s subletting guidance also cautions that building insurance might not cover accidental damage and advises informing the authority so cover can be checked; that warning is specific to its context, but illustrates why building cover should be verified. GOV.UK’s landlord guidance and Barking and Dagenham Council’s subletting guidance provide related information.

Which permissions and checks may apply?

Depending on the property and arrangement, more than one party may need to be consulted. GOV.UK’s guidance on running a business from home identifies a mortgage provider or landlord, the planning authority and the local council as parties whose permission may be needed depending on circumstances. Parking-space rental is not automatically the same as every home business, but the guidance is a useful reminder to check the relevant restrictions rather than assuming one approval answers everything. See GOV.UK’s guidance on running a business from home.

  • Property rights: landlord, freeholder, building manager or lender, as relevant to your documents.
  • Planning or other local requirements: local planning authority or council; ask about any applicable local planning, licensing, access or other restrictions.
  • Insurance: your insurer or broker, with details of payment and third-party access.

How to check before taking a booking

  1. Identify your status and rights. Establish whether you own, rent or lease the space, or have a specifically allocated right to use it.
  2. Read the relevant documents. Search for terms covering subletting, business use, visitors, parking, access, nuisance and insurance. Seek consent if required or if your authority is unclear.
  3. Ask the local authority about local rules. If the property is in England, use the government’s case-by-case planning guidance as a starting point; elsewhere, check the local rules that apply.
  4. Verify insurance before advertising or accepting payment. Describe the arrangement and request written confirmation of coverage and any policy changes.
  5. Keep a written record. Retain approvals and insurer responses, and set out the space, permitted use, access method, hours, payment, duration, cancellation terms and responsibility for damage or obstruction.

A written agreement is practical risk management; the sources cited here do not establish that one particular form is legally required everywhere.

Could tax rules apply?

Tax treatment is jurisdiction- and arrangement-specific. For example, the Canada Revenue Agency says the treatment of parking supplies depends on the type and duration of the arrangement and its relationship to a residential unit. That does not determine the tax result elsewhere—or every Canadian arrangement—so check the rules that apply where the space is located. See the Canada Revenue Agency’s guidance on parking.
