Sometimes. In the United States, whether you need a license to transmit depends on the radio service and how you will use the radio—not simply whether it operates on VHF or UHF. An FRS walkie-talkie, a GMRS radio, an amateur radio, a marine VHF set, and a business radio can be subject to different rules.
How to tell which rules apply to your radio
VHF and UHF are frequency-band labels, not license categories. A radio’s appearance, advertised range, or ability to tune a frequency does not establish that you may transmit on it. First identify the service the radio is designed and certified for, then check the rules for that service and intended use.
- Check the label and documentation. Look for the stated service—such as FRS, GMRS, amateur, marine, or Part 90 land mobile—and any FCC certification information. Confirm that the model is authorized for the service you plan to use.
- Identify the purpose and station. Personal, amateur, maritime, and business communications do not necessarily share the same authorization rules, even when frequencies are close together.
- Confirm the authorization before transmitting. A license-free service still has equipment and operating restrictions. A radio that can tune a channel is not permission to use it.
The comparison below summarizes common U.S. services; it is not a complete inventory of every radio service or every eligibility rule. The cited regulations are in Title 47 of the Code of Federal Regulations (CFR).

FRS: a common license-free option, with equipment limits
Family Radio Service (FRS) is a common choice for ordinary short-range personal voice communications without an individual FCC license. That does not mean every device sold as a “walkie-talkie” is an FRS radio: the equipment must be authorized for FRS, and operation must follow the service’s rules.

Under 47 CFR § 95.567, the maximum FRS transmitter power is 0.5 W ERP on channels 8–14 and 2.0 W ERP on channels 1–7 and 15–22. These are FCC equipment limits, not promises or estimates of real-world communication range. The Electronic Code of Federal Regulations identified Title 47 as current through October 1, 2026.
GMRS: an FCC license is required to transmit
General Mobile Radio Service (GMRS) requires a valid individual FCC license to operate a GMRS station; 47 CFR § 95.1705 states that requirement. Applicants must meet the rule’s eligibility conditions and follow FCC application procedures, including the applicable fee. Because a fee amount can change, check current FCC application information rather than relying on an undated figure.

A GMRS handheld is an option only for someone choosing to use GMRS: buying or owning it is separate from obtaining authority to transmit. The radio must also be certified for its intended service.
Amateur radio: an operator license and examination
“Ham radio” is not a license-free alternative. Before transmitting on amateur-service frequencies, the station must be under the physical control of a person named in an amateur station license grant or someone permitted to operate under the applicable reciprocal-operation rules. A person applying for a new operator license must pass an examination; FCC rules provide for Technician, General, and Amateur Extra examination elements.

Marine VHF: the ship-station exception is conditional
Maritime stations generally require FCC station licensing, but a ship station can be licensed by rule without an individual FCC-issued station license only if it is not subject to specified radio-equipment carriage requirements, does not travel to foreign ports, and does not make international communications.
For a ship station operating under that rule-based authorization, specified equipment and transmissions include a marine radio in the 156–162 MHz band, AIS, an EPIRB, and radar. Other transmissions require a ship station license, and rule-based operation remains subject to Part 80. The exception therefore does not mean that marine VHF never needs a license.

Business radios: verify the Part 90 system authorization
Many business and organizational private land-mobile systems fall under Part 90. The relevant service, who is eligible to use it, and the system’s authorization determine whether and how a particular organization may operate. A consumer handheld or a channel that sounds quiet does not establish permission to transmit. Check the applicable Part 90 provisions for the intended system rather than assuming that an available-looking frequency is open for general use.

Why the radio itself matters
Personal-radio transmitters generally need FCC certification for the service they are intended to serve, subject to limited exceptions. Authorization to transmit and equipment compliance are separate questions: having an operator or station license does not make an uncertified or wrong-service device suitable, and a compliant device does not supply a license where one is required.

Aviation-specific VHF/UHF requirements, every Part 90 frequency pool and applicant class, and local land-use or other jurisdiction-specific restrictions are outside this overview.
