No specific time clock is required under the U.S. federal Fair Labor Standards Act (FLSA). Covered employers must keep complete and accurate records for non-exempt employees, but the U.S. Department of Labor (DOL) permits a physical clock, a timekeeper, or employee-entered hours. The right method is the one that reliably records all hours worked and supports accurate pay.
This guide covers U.S. federal rules and practical choices for restaurants, hotels, and other hospitality businesses. State and local requirements may add protections or recordkeeping obligations, so check the rules where your employees work.
What does federal law require of a hospitality timekeeping system?
The FLSA requires covered employers to keep records for non-exempt employees, but it does not prescribe a particular device, format, or timekeeping method. The DOL says, “Any timekeeping plan is acceptable as long as it is complete and accurate.” That may mean a shared clock, records kept by a timekeeper, or hours entered by employees. The standard is the resulting record, not whether staff used a specific kind of clock. A punch system is useful only if it reflects the time employees actually worked and supports correct wage calculations.

Which hospitality workers need to be included?
Restaurants
The DOL says many restaurant workers are covered by federal minimum-wage and overtime requirements. Covered employers must keep required records for non-exempt employees. Coverage and worker classification depend on the circumstances, so do not assume every business or role is treated identically. The DOL’s Restaurant Employment Toolkit was updated September 11, 2025, and notes that some states provide additional rights and protections.
Hotels and motels
Federal coverage can apply to hotel and motel employees under enterprise or individual coverage rules. The DOL’s Fact Sheet #45 on hotel and motel establishments was revised in January 2020 and is flagged as under revision for tips and tipped-worker guidance. Do not rely on it alone for current tip rules; consult the DOL’s current tipped-worker resources and applicable state and local law.
How should a hospitality business choose a timekeeping method?
There is no federally preferred option. Match the method to how staff work and to the records payroll needs, rather than buying features simply because they are marketed to hospitality businesses.

When comparing options, assess whether the process fits your locations and job roles, makes missed punches visible, allows transparent corrections, supports review against schedules and actual work, transfers usable records to payroll, and preserves records for the required periods. These are practical selection criteria, not statutory feature requirements or endorsements of particular products.
How can employers keep time records accurate?
Use the clock as one part of a process. Make it clear when employees should record the start and end of work, give them a way to flag an error, and review and document corrections before payroll is finalized. Compare records with schedules and what managers know happened, especially around shift changes and closing duties. Federal guidance requires accuracy, but it does not prescribe a particular correction workflow.
Count work that happens outside a punch
Under the FLSA, work an employer requires or allows generally counts as hours worked, even if it happens after a scheduled shift or without a punch. For example, finishing a task or serving a customer after clocking out may still be compensable when the employer allows the work. A written rule against off-the-clock work does not make permitted work disappear from the record. See the DOL’s Hours Worked Advisor on “suffer or permit” work.

Check whether breaks are truly unpaid
An automatic break deduction does not by itself make a break unpaid. The DOL says employees must be completely relieved from duty for break time to be unpaid; time spent working or remaining on duty may count as hours worked. Review actual practice, not just the timekeeping settings.

Use rounding cautiously
Rounding should not be used as a shortcut for reducing paid time. DOL material indicates a rounding practice may be acceptable only when, over time, it does not result in failing to count all time actually worked. Check current federal, state, and local rules and the effect of the practice before relying on it.

Federal DOL guidance distinguishes payroll records from records used to calculate wages. Payroll records generally should be retained for at least three years. Wage-calculation records, including time cards and schedules, generally should be retained for two years. See the DOL’s Fact Sheet #21 and its recordkeeping overview. Other laws or circumstances may require a longer period.
Do small restaurants need to buy a time clock?
Not for federal FLSA recordkeeping alone. A business can use a physical employee time clock, a manager or timekeeper process, employee-entered records, or the DOL’s free Timesheet App, provided the method produces complete and accurate records. If considering a badge-card clock or paid software, compare the cost and day-to-day fit with what an existing or free method can do. The DOL’s recognition of time clocks as one permissible method is not an endorsement of any brand, device, or integration.
