There is no single worldwide law defining consent for deepfakes. The rules reviewed here focus mainly on non-consensual intimate images, and differ on whether they cover creating an image, asking someone to create it, sharing it, or the tools and platforms involved. U.S. federal law, UK provisions, an EU AI Act amendment, and the policies of Meta, YouTube and TikTok illustrate those differences; none should be treated as a universal rule.
What “consent” means depends on the act and the rule
“Deepfake” can describe consensual or nonsexual synthetic media as well as abusive material. For a specific law or platform policy, use its own terms: official sources discussed here include “digital forgery,” “purported intimate images,” and “image-based sexual abuse.” A rule about an intimate image does not automatically cover every manipulated likeness.
Consent to create an image and consent to distribute it are separate questions. A law may address one, both, or a platform’s handling of a report without deciding whether the person who made or shared the image committed a crime. The person’s age, the image’s content and realism, identifiability, the conduct involved, and the applicable jurisdiction can all change the analysis.

United States: TAKE IT DOWN Act
The federal TAKE IT DOWN Act was enacted May 19, 2025. It defines consent as affirmative, conscious and voluntary authorization. A qualifying “digital forgery” must be an intimate visual depiction of an identifiable person, generated or altered through technological means, and indistinguishable from an authentic depiction when viewed as a whole by a reasonable person. Those details matter: the Act is not a blanket rule covering every AI-generated image of someone.

The Act also requires covered platforms to remove qualifying non-consensual intimate images and known identical copies within 48 hours after a request. The Federal Trade Commission said enforcement of the platform-compliance section began May 19, 2026. FTC Chairman Andrew Ferguson described the process this way: “Then, they must quickly take down those images — and any known identical copies — within 48 hours of your request.” That is a statutory platform-removal process, not a guarantee that every report will qualify or be resolved in the same way, and it does not by itself determine whether an individual’s conduct is criminal.
United Kingdom: purported intimate images and related measures
The Data (Use and Access) Act 2025 inserts provisions into the Sexual Offences Act 2003 concerning creating, or requesting the creation of, purported intimate images of adults without consent or a reasonable belief in consent. The explanatory notes describe a relevant image as one that appears to be a photo or video of an adult in an intimate state.

The explanatory notes distinguish children’s images from that adult-focused provision: purported intimate images of children are not covered by it because existing criminal law captures indecent images, including deepfake images, of children. Child sexual abuse imagery is a separate legal category; it should not be treated as merely another case of adult intimate-image abuse.

The Crime and Policing Act 2026 and its government factsheet describe additional measures, including an offence concerning purported intimate-image generators and duties relating to nudification tools for platforms and search services. The measures do not necessarily share one start date. Whether a specific duty is in force or operational depends on its commencement and the applicable Online Safety Act requirements.

European Union: AI Act amendment
Regulation (EU) 2026/1744 amends the AI Act. It targets realistic depictions of intimate parts or sexually explicit activity and distinguishes between AI systems intended to generate or manipulate prohibited material and other systems where that output is reasonably foreseeable and reproducible without reasonable and adequate safeguards. It also prohibits a deployer from using an AI system for the purpose of generating or manipulating non-consensual intimate material.
The amendment was published July 8, 2026, and its entry-into-force rule is the third day after publication. That does not mean every amended requirement applies from the same date: check the application date for the particular provider or deployer provision before relying on it.

What major platform policies say
Platform rules are service policies, not a common legal definition of consent. They may prohibit conduct beyond a statute’s scope, but they do not establish that conduct is criminal or guarantee that a particular report will lead to removal. The descriptions below are each company’s own stated policies, not independent assessments of enforcement results.

Meta says its policies prohibit non-consensual intimate imagery, whether real or AI-generated, and promotion of nudify services. It describes removing ads, pages and accounts when found, blocking links, and restricting certain search terms on Facebook and Instagram. These statements describe Meta’s policy and approach; they are not an independently measured removal rate.

YouTube
YouTube’s Nudity & Sexual Content Policy identifies unwanted sexualization, non-consensually shared imagery and nude-photo leaks among content it disallows. Its Harassment & cyberbullying policies also address sharing, requesting or showing how to distribute non-consensual intimate imagery, as well as unauthorized AI imitation of someone’s voice or likeness when it may mislead and cause harm. Context and other policy details can affect how a case is handled.
TikTok
TikTok’s Community Guidelines describe image-based sexual abuse as having, sharing or creating intimate images, real or edited, of someone without consent, especially for sexual purposes. TikTok separately calls for labels on significantly AI-edited content that realistically depicts people or scenes. A label addresses AI disclosure; it does not make otherwise abusive content permissible.
How to assess a specific case
Before deciding which rule may apply, identify the facts that distinguish one legal or policy route from another:

- Where: Identify the relevant country or state and the service’s coverage. The laws summarized here are not a worldwide or state-by-state survey.
- What was done: Separate creating, requesting creation, threatening to share, actual distribution, and hosting. A rule may address only some of these acts.
- What the image depicts: Determine whether it is intimate or sexually explicit, whether the person is identifiable, and whether the relevant definition requires realism or indistinguishability.
- Whose consent and what consent: Ask whether the issue is permission to create, to share, or both, and whether the rule uses an affirmative-consent standard or a reasonable-belief standard.
- Age: Check whether the person depicted is an adult or a child. Child sexual abuse imagery is governed by distinct rules and must not be conflated with adult-focused provisions.
- Who has the duty: The relevant obligation may fall on an individual, an online platform, an AI-system provider, or a deployer.
- What process applies: Distinguish a criminal-law question from a platform report, a statutory removal request, or regulator enforcement. Each has different criteria and outcomes.
- When: Check enactment, entry into force, commencement, and application separately. A law can be enacted or enter into force while a particular duty is not yet applicable.
Where to report non-consensual intimate imagery
For content on Meta, YouTube or TikTok, use that service’s current in-app reporting route for the relevant content and location. A platform’s report process and the TAKE IT DOWN Act’s statutory request process are not interchangeable: the federal removal deadline applies to covered platforms and qualifying requests under that Act. If the person depicted is a child, treat the matter as a separate and potentially urgent child-safety issue and seek appropriate local specialist or legal support.
