As of 4 October 2026, there is no single worldwide rule for AI chatbot privacy. In the EU, the AI Act’s chatbot transparency requirement applies from 2 August 2026: people generally must be informed when they are interacting with AI, unless that is obvious in context. That notice is not a privacy notice. When a chatbot service processes personal data, the GDPR separately requires information about the processing, including its purposes, legal basis and retention period.
What changed for EU chatbot users in 2026?
Article 50(1) of the EU AI Act requires providers of AI systems intended to interact directly with people to design them so users are informed that they are interacting with AI. The European Commission identifies chatbots, agents and avatars as examples of direct interaction. The requirement applies from 2 August 2026.
There is a context-based exception: a separate disclosure may not be needed when it is obvious to a reasonably well-informed, observant and circumspect person that they are interacting with AI. That does not amount to a blanket exemption for a particular chatbot category; whether the interaction is obvious depends on its context.
The Act distinguishes the provider, which develops or has the system developed and places it on the EU market or puts it into service under its name, from the deployer, which uses it under its authority. The direct-interaction design duty is framed for providers. Article 50 also covers other transparency matters, including machine-readable marking of certain AI-generated or manipulated outputs and disclosures in specified situations. Those are distinct from telling someone they are chatting with AI.

Does an AI disclosure explain what happens to what you type?
No. The AI Act disclosure answers whether the person is interacting with AI. It does not, by itself, explain how a service handles personal data. If an organisation processes personal data through a chatbot, GDPR information duties separately require clear information about the processing.

- The controller’s name and contact details, including a data protection officer’s details if applicable.
- The purposes for processing and the categories of personal data involved.
- The legal basis for processing.
- How long the data will be stored, or the criteria used to determine that period.
Additional information may be required depending on the circumstances. A generic “you are chatting with AI” banner does not answer these questions. For a particular service, check its privacy information and relevant account or organisation terms to understand the stated purposes, retention and processing arrangements. The rules described here do not establish the settings or practices of any specific chatbot.
How should organisations approach chatbot data protection?
AI Act Recital 69 says privacy and personal-data protection should be guaranteed throughout an AI system’s lifecycle. It points to data minimisation and data protection by design and default. It mentions anonymisation, encryption and technologies that bring algorithms to data without transferring or copying raw data as possible measures. These are examples, not a universal checklist or a safe harbour; they do not replace assessment under the GDPR or other applicable law.

Establish who determines the purposes and means of processing, what data the service receives, why it is used, and how long it is kept. Do not assume that a provider’s AI disclosure settles the deploying organisation’s separate information duties.

What do the California examples establish?
SB 243 concerns companion chatbots, but enactment alone does not specify the obligations
California’s SB 243 was approved and chaptered on 13 October 2025. The California code index lists a Companion Chatbots chapter at Business and Professions Code sections 22601–22606. Those facts establish enactment and where the provisions are codified; they do not, on their own, establish the detailed requirements, covered systems, enforcement provisions or effective dates. Do not infer those details from a bill-history entry alone.
The California AI Transparency Act example is about detection tools
A separate California AI Transparency Act provision became operative on 1 January 2026. The cited text concerns specified providers and AI detection tools, including limits on collecting or retaining personal information from tool users and on retaining submitted content beyond what is necessary for compliance. It is not a general rule for ordinary conversational chatbot providers.

Why “the 2026 chatbot law” is not one global rule
The EU dates are part of a phased AI Act timetable, not a date when every provision began applying at once. The European Commission lists 2 December 2026 for specified prohibitions concerning generation or manipulation of non-consensual intimate material and child sexual abuse material. It lists 2 December 2027 and 2 August 2028 for specified high-risk AI system rules, with different dates for Annex III systems and high-risk AI embedded in regulated products. These dates are not general chatbot privacy commencement dates.

Which questions determine the rules for a chatbot?
- Where does the service operate? Consider the locations of users and operators and the laws that may apply to them.
- Who is responsible for which activity? A system provider, a business deploying a chatbot, and a controller or processor may have different roles.
- What triggers the rule? Relevant triggers can include direct interaction, personal-data processing, a high-risk use, companion-chatbot status or use of an AI detection tool.
- What must be communicated? AI-interaction disclosure, privacy information, output labelling and a route to human contact are different kinds of communication; one should not be assumed to replace another.
- When does the requirement apply? Distinguish enactment, operative or application dates, and enforcement timing.
