A crypto presale pitch is not proof that a token has value or that its project will succeed. Before paying, check what rights the token actually gives you, what stage the project has reached, and whether the seller is promising returns. If you already sent funds and suspect fraud, stop sending money, save the transaction and contact records, and report it through official U.S. channels. Reporting does not guarantee that your funds will be recovered.

How to evaluate a crypto presale before paying

The Commodity Futures Trading Commission (CFTC) advises buyers to research digital coins and tokens and understand both the rights attached to a token and the factors that could affect its value. Its advisory applies to digital tokens generally, including tokens described as utility or consumption coins; it is not a certification process for presales.

Ask what the token entitles you to, if anything, and distinguish a working product from a proposal. A project may still be at the planning stage and may use sale proceeds to start or grow a venture. Future plans are not the same as an operating product, and neither establishes that the token will gain value. The CFTC puts it plainly: “Understand what rights are attached to the coin or token being sold, and what underlying factors could affect its value.” Read the CFTC customer advisory, “Use Caution When Buying Digital Coins or Tokens.”

  • Token rights and claimed utility: What can a holder actually do or claim? Do not treat a label such as “utility token” as evidence of value.
  • Project stage: Is there an operating product, or is the pitch describing plans that still depend on future development?
  • How value is presented: What factors are offered to support the token’s value, and what remains uncertain?
  • Return claims: Is anyone promising or guaranteeing future value, high returns, or little to no risk? The CFTC cautions against promises or guarantees of future value.
  • Independent verification: Can you verify material claims independently rather than relying on the seller’s pitch? No single check can certify a presale as legitimate.

These questions help expose uncertainty; they are not a pass/fail test. The available official guidance does not establish a universal checklist that can prove a particular presale is safe.

Warning signs that call for a pause

Several warning signs in official guidance concern cryptocurrency investment fraud broadly, not presales alone. Treat them as reasons to stop and verify independently—not as conclusive proof about a particular project.

  • Guaranteed high returns or little to no risk: A joint SEC and CFTC investor alert identifies these claims as warning signs. See the SEC/CFTC investor alert on fraudulent digital-asset and crypto trading websites.
  • Pressure to act immediately: The FBI’s Operation Level Up identifies pressure to invest quickly as a possible sign of crypto investment fraud. Slow down rather than letting a deadline dictate a payment.
  • Attempts to isolate you: The FBI also flags efforts to keep someone from consulting family or financial advisers.
  • Withdrawal problems or new charges: Difficulty withdrawing, or a demand for previously undisclosed taxes or fees before funds can be released, warrants serious caution.

The FBI’s Operation Level Up page describes these possible indicators. A warning sign is a reason to pause, not a finding that a named project committed fraud.

What to do if you sent funds to a suspected crypto presale scam

  1. Stop all further payments. Do not send more funds to the project or people associated with it, even if a new payment is described as a tax, verification charge, unlock fee, or recovery deposit. The FBI specifically advises victims not to pay additional fees or taxes to withdraw funds. Read the FBI’s cryptocurrency investment fraud guidance.
  2. Save the evidence. Record the transaction hash or ID; sending and receiving wallet addresses; asset and amount; date and time; exchange used; project website or app; messages; names, usernames, phone numbers, and email addresses; and a timeline of contact. Keep original messages and records where possible. The FBI asks for as much transaction information as possible and says to file even if some details are missing.
  3. Report promptly through official U.S. channels. File a report with the FBI’s Internet Crime Complaint Center (IC3). The FTC also lists ReportFraud.ftc.gov, CFTC.gov/complaint, SEC.gov/tcr, and the exchange used to send the cryptocurrency as reporting destinations. Which regulator is relevant depends on the facts and your location. The FTC explains cryptocurrency scams and reporting options.
  4. Contact the sending exchange using its official support channel. Provide the transaction details and ask whether it can take any action. The FTC lists the exchange used to send cryptocurrency as a place to report. Do not assume an exchange can reverse a blockchain transfer; the cited guidance does not promise reversal.

Can you get your crypto back?

Recovery is not guaranteed. Report the incident and contact the sending exchange, but do not interpret either step as a promise that a transfer can be reversed or the funds returned. The official guidance cited here does not establish that a private recovery service can retrieve assets sent to a scammer.

Be alert for a second scam from someone claiming they can recover your money. The CFTC warns about recovery fraud, and the FBI describes schemes that seek upfront fees. Be especially cautious if an unexpected contact promises guaranteed results, asks for payment in advance, or will communicate only through a messaging app. The FBI says private recovery companies cannot issue seizure orders; exchanges freeze accounts through their own internal processes or legal process.

Reporting is useful, but it is not a recovery guarantee

The FBI, FTC, CFTC, SEC, and your sending exchange are reporting destinations identified in U.S. guidance; the right regulator can depend on the circumstances. Preserve what you have and file even if some transaction details are unavailable. Do not pay a supposed recovery company to file or pursue a report for you: the FBI and CFTC warn that recovery approaches themselves can be fraudulent.
