A condo association and an HOA are not necessarily alternatives: a condominium community can be governed by an HOA. “Condo” describes a form of property ownership; “HOA” describes an organization that governs a community. To compare two homes, look beyond the labels at their assessments, maintenance and insurance duties, rules, and financial records.
What is the difference between a condo association and an HOA?
A condominium describes an ownership arrangement. California’s definition, quoted in a state Attorney General opinion, combines a separate interest in a unit with an undivided interest in common property. An HOA is an organization that makes and enforces rules for a residential community, which may be a subdivision, planned community, or condominium building. A condo project can therefore have an HOA or condo association; the terms are not mutually exclusive. California Attorney General consumer guidance and its 2002 opinion describe these concepts.
In California, residents in many such developments must join the association, follow its rules, and pay assessments. That is a state-specific description, not a rule for every community nationwide. For a particular home, the recorded governing documents and local law determine the obligations.
Are condo fees higher than HOA fees?
There is no reliable rule that condo assessments are always higher—or that an HOA for detached homes is always cheaper. The amount depends on the property, the services and amenities funded by the association, the maintenance it handles, insurance arrangements, and its financial planning. Compare the actual budgets and obligations rather than relying on the community type.

For each property, check:
- The current regular assessment, its billing schedule, and any approved increase that is not yet due.
- Any current special assessment, disclosed delinquency, or related charge.
- What the assessment pays for, such as shared facilities, landscaping, or exterior upkeep.
- Budget and reserve information, including plans for major repairs and replacements.
- Which insurance and maintenance costs belong to the association, the owner, or both.
California Department of Real Estate (DRE) buyer guidance describes disclosures that can include current regular and special assessments, certain approved changes, and annual budget materials. It also advises buyers to study the association’s financial documents for potential future assessment obligations. See the DRE buyer guidance and its HOA buyer information. Who is responsible for repairs and maintenance?
The declaration or CC&Rs, condominium plan, other governing documents, and applicable state law determine who maintains each part of a property. Ownership alone may not settle the question: an owner can be responsible for an area treated as common property, or the association can maintain an exterior area owned by the lot owner. California’s AB 968 enrolled text describes a default allocation: the association maintains, repairs, or replaces common areas, while the owner handles the separate interest, unless the declaration provides otherwise. Before buying, identify the responsible party for each item that matters to the property:

- Unit interior, structure, roof, exterior walls, windows, and balconies.
- Plumbing, electrical systems, and heating or cooling equipment.
- Landscaping, driveways, parking, and exclusive-use areas.
- Insurance coverage, required owner policies, and applicable deductibles.
Do condo associations and HOAs have different rules?
Neither label reliably predicts how restrictive a community will be. Rules may appear in CC&Rs, bylaws, and board-adopted rules, and applicable state and federal law can constrain them. The California Attorney General notes that CC&Rs describe association and homeowner rights and duties, with examples such as fence placement and remedies for violations. It also cautions that “Each HOA’s CC&Rs may be different.”
Read the actual documents for rules affecting your plans, including exterior changes, rentals, pets, parking, noise, business use, and shared facilities. Check how the rules can be changed and how violations are handled. What should you review before buying?
Request the association’s governing and financial documents, then compare both properties using the same checklist. California DRE buyer information describes seller-provided materials that can include governing documents, annual budget information, assessment details, certain unresolved violation notices, and rental restrictions. The applicable package depends on the property’s location and transaction. DRE HOA buyer information
- Read the governing documents. Review the declaration or CC&Rs, bylaws, current operating rules, and any condominium plan or related documents.
- Establish the full cost. Compare regular assessments, approved changes, disclosed special assessments, covered services, and reserve or repair funding.
- Map maintenance and insurance duties. Confirm who handles each major component and what coverage or deductibles apply.
- Check rules against your intended use. Look for restrictions on rentals, alterations, pets, parking, and other relevant activities.
- Review disclosed financial and property issues. Note delinquent charges, unresolved violations, and other matters that could affect ownership or cost.
If the documents leave legal meaning or financial exposure unclear, California DRE advises discussing the matter with an agent and seeking legal counsel or an appropriate financial adviser for interpretation or advice. DRE HOA buyer information

How do the rules differ outside California?
The legal and disclosure examples above are California-specific. In another state, check that state’s law and the recorded documents for the property before relying on a maintenance default, disclosure requirement, or association rule. In any location, the community label by itself does not establish the fee, the services included, or the owner’s responsibilities.
