Yes, if the specific work and the version you plan to stream are genuinely in the public domain for the territories that matter. But that does not guarantee YouTube will leave the stream uninterrupted or approve the channel for monetization. You are responsible for verifying rights, and YouTube scans live streams for third-party content.
What “public domain” must mean for your stream
Public domain is a rights status, not a description that can be established just because a video is old, freely available online, or labeled “public domain” by an archive or uploader. YouTube says there is no official list of public-domain works and that status can vary by territory. Its Copyright on YouTube guidance puts the responsibility for verification on the uploader.

Before scheduling a continuous stream, identify the particular work and the particular copy or version. Record the basis for your conclusion, such as the relevant rights information from a reliable source. A finding that applies in one country should not automatically be treated as applying worldwide.

A film or other video can contain separate creative elements. The underlying story or footage may be public domain while a later restoration, translation, narration, score, soundtrack, or other added material is protected. Treat each component as a rights question, and verify that your evidence covers the exact version you will broadcast and the intended territories.
#1 Best Overall
- Factory sealed DVD
A government-produced work is not automatically public domain everywhere. YouTube gives works created by U.S. government agencies as an example of material that may be public domain; that example does not settle the status of every government video, jurisdiction, or third-party element within it.
Can YouTube interrupt a public-domain stream?
Yes. YouTube states that “All live streams are scanned for matches to third-party content, including copyrighted content in the form of another live broadcast.” A detected match may lead to a placeholder, warning, interruption, or termination. A stream can therefore be interrupted even when you believe you have a sound basis for using the material.

- Factory sealed DVD
For licensed third-party content, YouTube says the rights holder may need to add your channel to its Content ID allowlist. A license by itself may not prevent an automated interruption. If a component is licensed rather than public domain, check the license terms and coordinate any required allowlisting before going live. YouTube’s guidance is in Copyright issues with live streams.
Keep records that support your rights conclusions and be prepared to respond to an interruption. Legal confidence and uninterrupted platform delivery are separate matters; no public-domain determination guarantees that YouTube’s scanning or enforcement systems will not act.

Does public-domain material qualify for monetization?
Not automatically. Copyright permission and YouTube Partner Program eligibility are different questions. YouTube’s monetization policies cover live streams and assess the channel as a whole. A channel that mainly republishes material with little original contribution may run into reused-content or repetitive-content problems, even if the creator has permission or reasonably believes the material is public domain. See YouTube channel monetization policies.
Meaningful original contribution—such as historical context, explanation, or considered curation—can give viewers more than a bare rebroadcast, but it is editorial guidance, not a guarantee of monetization approval. Do not treat a rights determination as proof that a channel meets YouTube’s separate monetization requirements.

When an explicit license is the better route
If public-domain status is uncertain, an explicit license can be a clearer basis for use, provided it covers the way you plan to stream and the relevant territories. Check commercial-use permissions, attribution requirements, and any other conditions. YouTube says Creative Commons material can be monetized only when the license grants commercial rights; credit or proof of purchase may also be required. It also cannot grant reuse rights to someone else’s upload. Read YouTube’s licensing guidance and the actual license rather than assuming that a video’s availability on YouTube permits rebroadcast.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems| Material you plan to use | What to establish before streaming | Important limitation |
|---|---|---|
| A specific version you believe is public domain | Document the work, version, source, territories, and basis for the status; check audiovisual and audio components separately. | YouTube has no official public-domain list, and its scanning can still interrupt a live stream. |
| A version with uncertain status | Resolve the rights uncertainty or choose material with clearer documentation before scheduling it. | An online upload, archive label, or old release date alone is not conclusive proof. |
| Material under an explicit license | Confirm streaming and commercial-use rights, attribution and other conditions, and any needed rights-holder allowlisting. | A license does not necessarily prevent an automated live-stream interruption; commercial rights depend on the license terms. |
Practical pre-stream checklist
- Identify the exact work and copy or version, rather than relying on a general title or an online label.
- Check the intended territories and keep evidence supporting your public-domain conclusion or license.
- Review the soundtrack, restoration, translation, narration, and other added elements separately.
- For licensed material, verify commercial-use and attribution conditions and ask whether the rights holder must allowlist your channel.
- Plan for a possible warning or interruption; a continuous schedule does not override YouTube’s scanning and enforcement.
- If monetization matters, assess originality and viewer value separately from copyright status.
