Sometimes—but permission depends on the AI music service’s terms for your account and track, the rights in any material used to make it, and the rules of the platform where you publish it. Permission to use a track commercially is not the same as owning copyright in it, and neither guarantees that a platform will accept it for monetization.
What “commercial use” does—and does not—mean
Commercial use can mean different things: monetizing a video, using music in an advertisement or client project, adding it to a game or podcast, or releasing the track as a standalone song for sale or streaming. A service may allow some of these uses and restrict others. Check the terms for your particular account and output rather than relying on a general claim such as “commercial rights included.”
There are three separate questions to answer before release:
- What does the generator’s contract allow? The plan, generation date, download method, remix status, and uploaded inputs may affect the permission.
- What can you claim as your own? A service license can permit use without giving you an enforceable copyright in every part of the output.
- Will the destination platform accept the use? YouTube, a streaming distributor, or another service can have its own licensing, monetization, and content-identification rules.
What a service license can grant: examples and limits
Terms vary by provider, and even a provider’s rules can distinguish among plans, outputs, and uses. The examples below reflect the terms or vendor explanations identified here; they are not interchangeable or a guarantee that a particular release is cleared.

A paid subscription is not a shortcut around the terms. For example, Suno’s terms tie specified commercial rights to qualifying paid-tier output and an approved download channel, while also disclaiming any guarantee that copyright vests in output. The terms also grant Suno a broad license to use user submissions and content for service provision, monetization, promotion, and model improvement; users represent that they have the rights needed for material they submit. Do not upload a commercial recording, lyrics, samples, or a voice recording unless you have the necessary permissions.
Commercial permission is different from copyright ownership
In the United States, the U.S. Copyright Office’s 2025 summary says copyright protection for generative-AI output depends on whether a human author determined sufficient expressive elements. Human-authored material perceptible in the result, or sufficiently creative human arrangement or modification, may qualify on the facts. Merely entering prompts, where the system determines the expressive elements, is not enough under the Office’s stated position. AI assistance in a creative process—or AI material incorporated into a larger human-created work—does not by itself rule out protection.

As Register of Copyrights and Director Shira Perlmutter put it: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The Office said it reviewed more than 10,000 responsive comments in preparing its 2025 conclusions; that figure describes its review process, not the odds that any particular song is copyrightable or safe to release.
Copyright owners can have rights to reproduce, distribute, publicly perform, and prepare derivative works from musical works, and can authorize others to exercise those rights. But a service’s permission to use its output, copyright in human contributions, rights in source material, and clearance for a particular commercial release are distinct layers. There is no one-number probability in the cited official material for whether a specific AI-generated track infringes or qualifies for copyright protection. The Copyright Office described training on copyrighted works as a separate issue addressed in its forthcoming Part 3 report, not as a blanket answer about every output.

Check the rules of the platform where you publish
A generator’s commercial-use permission does not guarantee acceptance by YouTube, a streaming distributor, or another destination. Check that destination’s current terms and music rules as well as the generator’s license. This matters especially for monetization, standalone releases, and any track containing third-party material or a recognizable protected work.

YouTube monetization and Content ID
YouTube says some third-party music licenses, including licenses from royalty-free or licensing sites, may not grant the rights needed to use or monetize music on YouTube. A license that allows commercial use in one setting may therefore be insufficient for a monetized video. YouTube also explains that fair use is decided by courts on the facts: commercial purpose is one consideration that is generally less favorable than nonprofit educational use, but the outcome depends on the full four-factor analysis. A disclaimer or label does not settle the question, and Content ID cannot determine fair use.
A Content ID match is not itself a court ruling on infringement; likewise, no automated match is not proof that all rights are clear. YouTube’s guidance describes the limits of platform detection and licensing, not a legal clearance test for an individual track. Source: YouTube guidance [c003].

How to compare terms before choosing a service
Look for answers that match the actual project, not just a broad “commercial use” label. Check:
- Use scope: whether the plan covers monetized videos, podcasts, client work, advertising, games, streaming distribution, and standalone sales.
- Eligibility: the required plan tier, when the output must be generated, whether it must be downloaded through a specified channel, and whether cancellation affects rights already granted.
- Restrictions: rules for remixes, uploaded samples or lyrics, voice likenesses, attribution, editing, standalone tracks, and sublicensing.
- Nature of the grant: whether the service grants a license or assigns rights it owns, and whether the grant is exclusive, transferable, sublicensable, limited in duration or territory, or accompanied by a warranty about copyright.
- Platform fit: whether the intended distributor or platform allows the use and how it handles monetization or fingerprinting.
- Documentation: whether you can retain the applicable terms and get written clarification for a commercially important use.
Pre-release checklist
- Record the generator, exact output or version, and the dates it was generated and downloaded.
- Read and save the terms that applied to your account and output at that time, along with your plan receipt and any relevant license or permission records.
- Match the intended use—such as a client project, advertisement, video, game, streaming release, or standalone sale—to an explicit permission in the service’s terms.
- Check whether the track is a remix or includes uploaded audio, lyrics, samples, or voice recordings. Establish that you have rights to each input and that the generator’s terms allow the intended submission and use.
- If copyright ownership or registration matters, assess your human-authored material and creative arrangement or modification separately. In the United States, prompting alone does not meet the Copyright Office’s stated human-authorship standard.
- Review the destination platform’s rules as well as the generator license. For YouTube, check music and monetization requirements in addition to the service terms.
- For a valuable release, a track resembling a known song or artist, another person’s voice, or an unclear contract, consult a qualified music or intellectual-property lawyer in the relevant jurisdiction.
What this does not establish
“AI-generated” does not mean automatically copyright-free, and “royalty-free” does not mean unrestricted. A lack of copyright in some machine-generated elements does not grant permission to use protected inputs or erase contract limits. Nor does a commercial-use license establish exclusivity, guarantee an enforceable copyright, or settle a platform’s monetization decision. The cited material provides no comparable statistic on how often AI music is commercially cleared, rejected, claimed, or registered, and it cannot determine the rights in a specific track.
