In the United States, you generally cannot sue a company directly under HIPAA just because it exposed your health information. A separate claim under state law may be possible, depending on the company’s role, the facts, your state’s law, and any harm you can show. A breach notice by itself does not establish that you can recover damages.
Does HIPAA let you sue the company?
No. HIPAA does not give individuals a private right of action—that is, a personal right to bring a lawsuit for a HIPAA violation. In J.R. v. Walgreens Boots Alliance, Inc., the Fourth Circuit explained that HIPAA assigns enforcement to government authorities and rejected a negligence-per-se theory based on HIPAA in that case.
That answer is about suing under HIPAA itself. It does not rule out a different claim based on the same events under state law; whether such a claim exists is a separate, jurisdiction-specific question.
Could state law give you a separate claim?
Possibly. Depending on the state, the defendant, and what happened, a lawyer might assess claims such as negligence, breach of confidentiality, breach of contract, or a privacy-related claim. Those are possible categories, not claims available in every state. Each has its own elements, deadlines, and rules about what harm or proof is required. There is no universal rule that a person must—or need not—show that someone actually viewed or misused the information.

A Northern District of California order in Ward v. Mochi Health Corp. illustrates the limits of generalizing: it described disagreement among California federal courts about using HIPAA to support negligence per se and allowed that theory to proceed at the pleading stage under its application of California law. It is a district court ruling, not a nationwide rule or a final finding that the company was liable.
Who held the information, and which rules apply?
The word “company” does not determine whether HIPAA applies. HIPAA covers specified health-care providers, health plans, health-care clearinghouses, and their business associates when they handle protected health information in covered roles. A consumer app or other health-data service may not be covered by HIPAA. Certain personal health record vendors, related entities, and service providers outside HIPAA may instead be subject to the FTC’s Health Breach Notification Rule. HHS explains the distinction in its overview of consumer health information and HIPAA and FTC rules.

To narrow down the applicable rules, identify the company that collected or stored the information, what service it provided, and whether it was acting for a health-care organization. A company’s handling of health-related data does not, on its own, establish that it is a HIPAA-covered entity or that a HIPAA violation occurred.
What routes are available besides an individual lawsuit?
| Route | Who acts and under what authority | What it is for |
|---|---|---|
| State-law lawsuit | The affected person, if state law recognizes a claim that fits the facts | Individual relief that may be available under the particular state-law claim; eligibility and remedies vary. |
| HHS Office for Civil Rights (OCR) complaint | An individual may complain about possible noncompliance with HIPAA or Part 2; OCR can investigate only covered entities, conduct, and rules within its authority. | Regulatory investigation and enforcement, not an individual damages award. See OCR’s complaint process. |
| FTC enforcement | The FTC may be relevant for certain consumer health businesses subject to the Health Breach Notification Rule outside HIPAA. | Regulatory enforcement under applicable FTC rules; it is not the affected person’s private lawsuit. See HHS’s overview of the FTC rule. |
| State attorney general action | A state attorney general may bring a civil action on behalf of residents for violations of HIPAA’s Privacy and Security Rules, under authority granted by HITECH. | Public enforcement on behalf of residents, distinct from an individual’s own claim. See HHS’s guidance on state attorneys general. |
For an OCR complaint, HHS says to identify the entity and describe the alleged act or omission. The general filing period is 180 days from when you knew of the alleged violation; OCR may extend it for good cause. A complaint can prompt regulatory review, but it does not decide whether you have a state-law claim.

What does a HIPAA breach notice mean?
A notice is about an organization’s regulatory duty, not proof that an individual can sue or recover money. Under the HIPAA Breach Notification Rule, an impermissible use or disclosure of protected health information is generally presumed to be a breach unless the regulated entity establishes a low probability that the information was compromised through the required risk assessment, subject to rule exceptions. The rule applies to unsecured protected health information.
Covered entities generally must notify affected individuals without unreasonable delay and no later than 60 days after discovering a breach of unsecured protected health information. A business associate generally notifies the covered entity, which handles required notices to individuals and HHS. Additional media notice is required in specified circumstances, including breaches affecting more than 500 individuals in a state or jurisdiction; smaller breaches may be reported to HHS annually within the prescribed period. HHS sets out these duties in its Breach Notification Rule guidance.

What should you do if your information was exposed?
- Save the notice and related messages. Keep copies of letters, emails, app messages, and any response from the company.
- Record when you learned about the exposure. This may matter for complaint timing and for assessing state-law deadlines.
- Identify the company’s role. Note which organization held the information, whether it provided health care or a consumer service, and whether another organization operated the service for it.
- List what information was involved. Record the categories identified in the notice and any stated time period or circumstances of exposure.
- Document effects and evidence. Keep records of any fraud, discrimination, medical, financial, or other concrete effects, along with information showing what was exposed or accessed.
- Check your state’s law and deadlines. If you are considering an individual claim, a lawyer familiar with privacy or data-breach cases in your state can assess the applicable claim, evidence, and time limits.
- Consider a regulator complaint where appropriate. If the organization or conduct may fall under HIPAA or Part 2, review HHS OCR’s complaint process. The relevant regulator depends on which rules cover the company and incident.
These steps help organize the facts; they do not establish legal eligibility or guarantee a particular outcome.
