Yes, in some circumstances—but an image is not illegal to share simply because it is fake. In the United States, the risk depends on what the image depicts, whether someone is identifiable, consent, what the sharer knew or intended, the harm and context, and the law that applies. Nonconsensual intimate deepfakes, defamatory or privacy-invading images, and images used in fraud can create serious legal exposure. State laws differ, so this is general legal information, not legal advice.
When can sharing a fake image lead to legal trouble?
“Fake image” is not one legal category. An obviously satirical edit, an intimate deepfake shared without consent, and a forged image used to trick someone into handing over money raise different legal questions. Falsity alone does not settle whether sharing is unlawful.
The main issues are what the image depicts; whether it identifies a real person and, for intimate-image rules, whether that person is an adult or a minor; whether publication was authorized; what the sharer knew or intended; what harm occurred; and which federal and state laws apply. The FBI has said synthetic content may generally be protected speech, while noting that it may investigate when the facts indicate possible federal crimes.

The TAKE IT DOWN Act, enacted May 19, 2025, created specific federal rules for certain nonconsensual intimate images, including qualifying digital forgeries. It does not make every AI-generated picture, fake image, or intimate image automatically illegal.

Criminal prohibition
Under 47 U.S.C. § 223, certain knowing publications through an interactive computer service are criminal offenses. For an adult’s authentic intimate depiction, the statute includes requirements concerning a reasonable expectation of privacy, whether the person voluntarily exposed the depiction in a public or commercial setting, whether it is a matter of public concern, and intent to cause harm or actual harm. For an adult digital forgery, the statute requires publication without the identifiable person’s consent, the public-exposure and public-concern conditions, and intent to cause harm or actual harm. Separate rules apply to minors; the statute provides penalties of up to two years for specified adult offenses and up to three years for specified offenses involving minors.
The law defines a digital forgery as an intimate depiction of an identifiable person made or altered using technology so that, viewed as a whole by a reasonable person, it is indistinguishable from an authentic depiction. The statute also contains exceptions. Whether a particular image and act of sharing meet every applicable element requires a fact-specific legal assessment.

A separate civil lawsuit
The criminal prohibition is distinct from the federal civil action in 15 U.S.C. § 6851. The U.S. Department of Justice says an affected person may sue over sharing an intimate image without consent when the defendant knew the person did not consent or recklessly disregarded that fact. In applicable circumstances, a court can order the sharing to stop and award damages of up to $150,000, plus attorney’s fees and court costs. The law has limited exceptions, and state criminal laws may apply as well.

Agreeing to have an image taken—or sending it privately to one person—does not by itself mean agreeing to its publication to others. The relevant question is whether the person consented to the sharing at issue.

Can a platform be required to remove the image?
Under 47 U.S.C. § 223a, covered platforms must provide a process for an identifiable person or an authorized representative to notify the platform about a nonconsensual intimate depiction and request its removal. Federal Trade Commission guidance says a covered platform must remove qualifying material and known identical copies within 48 hours after a valid request. The FTC enforces compliance.
If you are affected, use the platform’s designated reporting process and preserve relevant evidence. The exact reporting route depends on the service and whether the image fits the legal definition. The Department of Justice also lists support resources and attorney assistance for people affected by image-based sexual abuse.

What about fake images that are not intimate?
Other laws may apply, but the answer is often state-specific. A manipulated image that falsely portrays an identifiable person doing something harmful could raise defamation or false-light issues, depending on the facts, state law, and applicable speech protections. Privacy or likeness claims may also be relevant in some circumstances. This overview does not determine the law in any particular state.

That recommendation describes the Office’s policy view; it is not itself a law making every unauthorized replica unlawful.

Images used to deceive or defraud
A fake image used as part of a scheme to obtain money or otherwise defraud someone raises different issues from forwarding an obviously satirical picture. Federal counterfeiting laws, for example, prohibit specified fraudulent making or passing of U.S. obligations or securities; they do not create a general federal offense for sharing any false picture.
Political and election-related images
Election rules vary by jurisdiction. The FBI notes that states have their own election laws and directs people concerned about potential state or local election-law violations to local law enforcement. The available federal guidance does not support a blanket claim that every political deepfake is illegal nationwide.
How should you assess a particular image before sharing it?
Use these questions to identify when to pause and seek advice rather than assuming that “fake” means either harmless or unlawful:
- What does it depict? Distinguish an ordinary edit or impersonation from an intimate image or an image used as a forged document or security.
- Can a real person be identified? The federal intimate-image provisions treat adults and minors differently.
- Was publication authorized? Permission to create or privately send an image does not automatically authorize wider distribution.
- What did the sharer know or intend, and what harm resulted? Knowledge, intent, and harm are express elements in relevant federal provisions and may matter to state-law claims.
- What is the context? The intimate-image statute includes public-concern and exposure conditions; other contexts raise different speech questions.
- Which jurisdiction applies? Rules involving defamation, privacy, elections, and likeness rights vary by state.
If you are considering sharing an intimate image, a humiliating or damaging depiction of an identifiable person, or an image connected to a suspected fraud, do not assume that labeling it “AI-generated” or “fake” removes the risk. If you are affected or facing a concrete dispute, preserve relevant evidence and consult a lawyer in the relevant jurisdiction.
