That gives Nintendo a contractual basis to disable some or all of the system or software; it does not prove that every detected pirated game or modification triggers an automatic hardware brick.
What Nintendo’s Switch 2 agreement says
Nintendo of America’s Switch 2 User Agreement, effective September 2026, covers the console and its accessories, software, content, data, and updates. It prohibits bypassing or tampering with protections, as well as using unauthorized software or hardware to run unauthorized, illegal, or pirated software or hardware. It also bars installing software Nintendo identifies as an unauthorized copy and reinstalling earlier software versions.

The agreement states: “You acknowledge that if you fail to comply with the foregoing restrictions Nintendo may render the Console and/or the Software permanently unusable in whole or in part.” The wording reserves that option after a violation. It does not say that every violation will result in disabling, or specify a universal, automatic process that physically destroys the console.
What Nintendo means by piracy and circumvention
Nintendo’s Intellectual Property & Piracy FAQ describes circumvention products as devices or software that bypass Nintendo security measures and enable unauthorized copies or ROMs. Its examples include piracy cartridges, game copiers, USB piracy sticks, and mod chips. The agreement separately addresses unauthorized software and hardware, so the restrictions are not limited to one type of device.

Nintendo’s FAQ tells parents that pirating a game or playing a pirated version is against the law, and provides an email address for reporting piracy. That statement is not a substitute for legal advice about a particular jurisdiction or situation.
Does a firmware update automatically brick modified consoles?
Nintendo’s official Switch system-update history lists version 22.5.0 as released on June 15, 2026. The update history records feature and bug-fix changes; it does not say that this release automatically bricks modified or pirated consoles. The agreement’s warning and a claim about a specific update doing that are different kinds of evidence.

PC Gamer reported on May 10, 2025, shortly before the Switch 2 launch, that Nintendo had changed its user agreement and highlighted the “permanently unusable” wording. That coverage connected the change to anti-piracy and anti-modification enforcement. The agreement itself is the primary evidence for what Nintendo reserves the right to do; the cited official update history does not establish a universal “kill switch.”

- Use games and software obtained through authorized channels rather than unauthorized copies or ROMs.
- Avoid devices or software intended to bypass Nintendo’s security measures, including the circumvention products Nintendo lists in its FAQ.
- Do not tamper with system protections or reinstall an earlier software version in violation of the agreement.
- Use authorized accessories and software, and follow Nintendo’s current agreement for the console.
The agreement sets out consequences Nintendo may impose for prohibited conduct. Neither that wording nor the cited update history establishes how often Nintendo disables systems or whether a particular device, modification, or software version will be detected.
