Potentially—but buying or using GPUs, servers, or cloud computing does not by itself qualify a business for the U.S. federal research credit. Under Internal Revenue Code Section 41, eligibility turns on whether the business performed qualifying research for a particular business component and whether the claimed costs are connected to that work. The IRS materials describe some potentially eligible expense categories, but do not settle every current cloud or AI infrastructure arrangement.
Can a business claim the research credit for AI development?
Yes, potentially. An AI project may involve qualifying research, but its label—such as “AI,” “machine learning,” or “model training”—does not establish eligibility. A business must apply Section 41’s four-part test separately to each business component it claims, such as a product, process, software component, or other component under development or improvement. The IRS Form 6765 instructions dated December 2025 describe this test.
- Permitted purpose: The research must be intended to develop or improve the taxpayer’s business component.
- Technological in nature: The work must rely on the relevant principles of physical or biological science, engineering, or computer science.
- Elimination of uncertainty: The work must address uncertainty about the capability, method, or appropriate design for developing or improving the component.
- Process of experimentation: The work must substantially involve evaluating alternatives or otherwise experimenting to resolve that uncertainty.
- Domestic research requirement: The research must meet the applicable U.S. location requirement.
In practical terms, a business should be able to explain what it was trying to improve, what it did not know at the outset, what alternatives it evaluated, and how its experiments informed the design or approach. Routine use of an AI system, ordinary software maintenance, or deploying an established model does not become qualifying research merely because it involves technical work.
Does buying servers or GPUs for AI training qualify?
Not automatically. A hardware purchase is not itself a qualifying research activity. The relevant analysis separates the research from the equipment and then asks whether a particular expense fits an eligible Section 41 category and is sufficiently connected to qualified research. The IRS identifies wages for qualified services, research supplies, certain amounts paid for the right to use computers in qualified research, and qualifying contract research as potential expense categories, subject to applicable rules.

For owned servers or GPUs, the purchase price should not be assumed to qualify simply because the equipment supports an AI project. The IRS materials reviewed identify certain computer-use amounts, but do not establish a general rule that an owned server purchase is eligible. A tax adviser would need to analyze the expense’s tax characterization and the equipment’s actual use under the applicable rules.
When might GPU, server, or cloud-computing costs be relevant?
Computer access can be a potentially relevant expense category when amounts are paid for the right to use computers in qualified research. That does not resolve how a particular cloud bill, GPU rental, colocation arrangement, bundled platform charge, or owned system should be classified. Contract terms, the nature of the charge, actual research use, and the method used to allocate mixed costs can all matter. The IRS audit guidance discusses computer-use expenses generally, not a categorical answer for every modern AI infrastructure arrangement.

| Infrastructure arrangement | Questions for the eligibility analysis |
|---|---|
| Owned equipment | What expense is being claimed, how is it treated for tax purposes, and what records show its use in qualified research? |
| Rented computer or GPU access | Does the payment represent a right to use computers in qualified research, and can the research use and amount be substantiated? |
| Separately stated cloud compute | What does the contract say the charge covers, and can the business trace the compute use to qualifying research rather than production or other work? |
| Bundled cloud or AI platform service | Can the business identify the relevant cost components and support a reasonable allocation to qualified research? |
| Mixed research and production use | What portion, if any, is tied to qualified research rather than deployment, commercial production, or other nonqualifying activity? |
These are fact distinctions to investigate, not an IRS safe-harbor checklist or a ranking of infrastructure models. The official guidance does not establish a universal allocation formula for these scenarios.

- Research conducted after commercial production begins.
- Adapting an existing product or process to a particular customer’s needs.
- Duplicating an existing product or process.
- Surveys or studies.
- Certain research relating to internal-use software.
- Research conducted outside the United States or a U.S. territory.
- Research funded by another person or a government entity.
For an AI product, this makes the boundary between experimentation and routine operation important. Work on unresolved technical alternatives during development may warrant analysis under the test; routine production inference, customer-specific configuration, or post-production support should not be treated as eligible merely because engineers perform it. Whether a particular activity falls within an exclusion depends on the facts and applicable statutory rules.

For a research-credit refund claim, IRS guidance calls for identifying each business component, the research activities for each component, the individuals who performed those activities or their titles or positions, and the information those individuals sought to discover. That claim-specific identification is not a substitute for the underlying records connecting the claimed work and expenses to the eligibility analysis.

A practical record set can include:
- Project descriptions that identify the business component and intended improvement.
- Technical records showing the uncertainty addressed, alternatives considered, experiments or design iterations, and results.
- Employee role, activity, and wage records that support the claimed qualified services.
- Invoices, contracts, and usage records for computer access, cloud services, equipment, supplies, and outside research.
- A documented, traceable method for allocating costs when resources support both research and nonresearch work.
- Records showing when commercial production began and which work occurred before or after that point.
The IRS materials do not prescribe one universal documentation format. Records created as work proceeds are generally more useful for substantiating what was done and why than a project label or a summary assembled without supporting technical and expense evidence.
