Generally, yes. At a U.S. port of entry, border agents may search a traveler’s phone without first getting a warrant. The method matters: CBP distinguishes a manual review from an equipment-assisted search, and its policy sets a higher threshold for the latter. Courts have not established one phone-search rule that applies identically in every federal circuit.
What kind of phone search can CBP conduct?
U.S. Customs and Border Protection (CBP) distinguishes between a basic search and an advanced search in its public guidance on border searches of electronic devices.

That advanced-search threshold is CBP agency policy; it is not a nationwide Supreme Court rule. Courts may impose separate constitutional limits, and the applicable appellate precedent can depend on where the search occurs.

Does the border-search exception mean agents need no suspicion at all?
For a brief manual search, recent appellate decisions have treated the search as routine and have said individualized suspicion is not required. In United States v. Belmonte Cardozo, decided July 13, 2026, the Fourth Circuit held that manual phone searches at the border are routine under its precedent. In United States v. Eta, decided July 6, 2026, the Seventh Circuit applied its precedent that brief manual device searches do not require a warrant, probable cause, or individualized suspicion. Those decisions are appellate guidance, not a Supreme Court ruling binding every court on the phone-search question. Their conclusions also do not mean that every search, however lengthy or intrusive, is automatically lawful. The Fourth Circuit noted that an unusually lengthy or intense manual search may raise other Fourth Amendment questions.
Are forensic searches treated differently?
They can be. An equipment-assisted search may copy or analyze data rather than simply display what an officer can see manually. The Fourth Circuit treats forensic searches as nonroutine under its precedent, recognizing that their capabilities can include recovering deleted material and creating a durable copy. That is a circuit-specific constitutional rule, distinct from CBP’s policy threshold for an advanced search.

The Second Circuit’s September 17, 2026 opinion in United States v. Alisigwe also reflects continuing disagreement about the constitutional balance. A dissent in that case is not the court’s holding. The Second Circuit’s Alisigwe opinion should be read as part of an evolving appellate landscape, not as a single nationwide rule.

No. The Supreme Court has not squarely decided the constitutional standard for searching a phone at the U.S. border. Riley v. California, which addressed searches of phones incident to arrest, is not a border-search decision and should not be treated as resolving this question. As a result, the lower-court decisions and their jurisdictions matter, especially for more intrusive forensic searches.

What should travelers do before crossing the border?
Practical privacy steps can reduce the amount of sensitive information carried on a device, but they do not guarantee that agents will not search it or determine whether a search is lawful.
- Carry only the sensitive data you need for the trip, where that is practical.
- Back up important information before traveling so a device problem or seizure does not leave you without a copy.
- If you handle employer, client, or legally privileged data, ask your organization or qualified counsel about its cross-border procedures before travel.
- Do not lie to officers or assume that refusing access has no consequences. CBP says travelers must present devices and resident information in a condition that allows examination; the consequences of declining access can depend on the traveler’s circumstances.
CBP reported that in fiscal year 2024, fewer than 0.01 percent of arriving international travelers encountered by CBP at a port of entry had electronic devices searched. That figure is limited to that year and that stated denominator; it is not a measure of every border encounter or a guarantee about an individual trip. The statistic appears in CBP’s electronic-device search guidance.

What if agents seize your phone or the search could affect your case?
If a device is seized, or you may face criminal or immigration consequences, contact a lawyer qualified to advise on your specific situation. A general explanation cannot determine whether a particular search was lawful, what rules govern your circuit, or what may follow from refusing access. CBP’s published guidance states that travelers are obligated to present electronic devices and resident information in a condition that allows examination, but it does not by itself settle every traveler’s legal consequences.
