Yes. YouTube may treat a 24/7 stream of public speeches as reused content if it mainly republishes recordings from elsewhere without significant original commentary, substantive changes, or educational or entertainment value. A speech being public, politically important, or continuously streamed does not by itself make the channel eligible for monetization or give it permission to retransmit the material. YouTube’s monetization review and Indian copyright law are separate questions.

Why a public-speech stream can fail YouTube’s reused-content test

YouTube says reused content is material repurposed from YouTube or another online source without significant original commentary, substantive modifications, or educational or entertainment value. Its monetization policies apply to live streams as well as Shorts and long-form videos. See YouTube’s channel monetization policies.

A stream that loops or aggregates full speeches with little beyond a logo, ticker, static introduction, or schedule has substantial reused-content risk. That is an application of YouTube’s examples, not a claim that YouTube has ruled on this exact format. The policy gives more favorable examples such as critical review, reaction with commentary, edited footage organized into a storyline with commentary, and substantive editing that makes the material unique to the channel.

What meaningful original contribution can look like

Make the channel’s own work an important part of what viewers watch: introduce the speaker, date, and context; explain the speech’s subject; compare positions; annotate claims; or add substantial original narration and analysis. Organize editing around a clear educational purpose rather than simply playing a sequence of recordings. A thin graphic overlay or brief opening alone is not a guaranteed fix; YouTube’s test is qualitative.

Review the channel as a whole

YouTube may consider the channel’s main theme, most-viewed and newest videos, videos accounting for the largest share of watch time, titles, thumbnails, descriptions, and About section. An occasional analytical program may not change the overall impression if the channel’s central offering remains continuous, minimally altered republication. Make the editorial purpose and your contribution clear in each program and its metadata.

Permission and monetization are different tests

YouTube expressly separates reused-content enforcement from copyright enforcement and says reused-content rules may apply even if the uploader has permission from the original creator. Conversely, avoiding a copyright claim does not establish eligibility for YouTube Partner Program monetization. Copyright permission, reused-content eligibility, advertiser suitability, and copyright claims or strikes should be treated as distinct issues. YouTube’s policy page also notes that on July 15, 2025 it renamed “repetitious content” to “inauthentic content” to clarify its existing rule on repetitive or mass-produced material; it said that change did not alter the separate reused-content policy.

What Indian copyright law says about public speeches

“Public speech” does not mean “free to retransmit.” Under section 17(cc) of India’s Copyright Act, 1957, the speaker—or, if the speech was delivered on another person’s behalf, that person—is the first owner of copyright in an address or speech delivered in public. Section 17(d) provides that Government is the first owner of copyright in a Government work unless there is an agreement to the contrary. The Act’s definition of Government work includes work made or published under the direction or control of Government, a department, an Indian legislature, or a court or tribunal. Read the Copyright Office’s Chapter IV text.

These provisions mean that the event’s public nature, venue, or government connection alone does not settle ownership or grant retransmission rights. The speech and the particular audio or video recording may also involve different rights holders. Check the specific material and any licence or release that applies to it.

The reporting exception is not a blanket 24/7 licence

Section 52(1)(a)(iii) provides for fair dealing for reporting current events and current affairs, including reporting a lecture delivered in public. Its wording does not establish categorical permission to retransmit full speeches continuously as a channel format. Whether an individual use qualifies depends on its facts; this article is not a legal determination about a particular stream. The relevant text is on the Copyright Office’s section 52 exceptions page.

Rights and editorial checklist before you stream

  • Identify the rights holder for each speech and for each underlying recording. Do not infer permission from public access or government affiliation.
  • Obtain and retain written permission or a clear licence covering live retransmission, archiving, territories, and embedded music or third-party footage, where applicable.
  • Build original value into the program itself through context, explanation, substantive editing, or commentary—not only channel branding.
  • Make programs meaningfully distinct, and use titles, descriptions, and the About section to accurately explain the channel’s editorial purpose and your contribution.
  • Keep records that make your production participation and rights clear enough to explain to a reviewer.
  • Read YouTube’s livestream terms and conditions. YouTube’s terms require the provider to represent that it has the necessary rights to exploit live content on Google services and to comply with applicable laws.

If the content is original but the stream still needs to run

StreamNeo is a cloud service for keeping uploaded videos live on YouTube: upload a recording or build a playlist, add your YouTube stream key, and go live. It can keep the stream running with your computer off, but using it does not add originality, establish copyright permission, or guarantee monetization. Its monthly price is $9.99 per month; the first day is free with no card. See StreamNeo or start the free day.
