Arizona State University has asked former Arizona Supreme Court Chief Justice Scott Bales to lead an independent review of hockey player Matthew Mayich’s collapse during an outdoor workout. The announced review is focused on ASU policies and practices for outdoor athletic activities and on recommending ways to prevent future harm. The Mayich family welcomed Bales’s selection but says the review should also investigate how the workout was authorized and who was responsible.
What is Bales’s review expected to examine?
ASU asked Bales to review the university’s findings and materials provided by the Mayich family’s attorneys, team members and law enforcement. James Rund, ASU’s senior vice president of educational outreach and student services, said Bales would make recommendations on the planning, approval and staffing of outdoor athletic activities, as well as the policies and procedures governing them. The review is also to consider outside consultants in strength and conditioning. The Associated Press reported that ASU asked Bales to complete the review by early December 2026.
ASU’s stated mandate is oriented toward university practices and prevention. It does not, in the available reporting, establish that Bales has been tasked with deciding individual responsibility or legal liability.
What did ASU’s preliminary account say about the workout?
According to AP’s account of ASU’s preliminary report, hockey coaches sought permission for Timothy Ziesel, a former Green Beret, to speak at a three-day team-building event. Staff did not submit a plan of training activities to ASU strength-and-conditioning coaches for review before the event.

The report’s account of the workout on August 20, 2026, said it began at 7 a.m. at Sun Angel Stadium. Temperatures were reported at 86 to 89 degrees Fahrenheit, with relative humidity of 46% to 51%. Participants did calisthenics and body-weight exercises, and received a water break about 20 minutes into the activity. Mayich collapsed during a wind-down run while carrying a 10-pound medicine ball. Trainers applied ice towels and poured water over him; after he quickly deteriorated, 911 was called. These details come from ASU’s preliminary report as relayed by AP, not from independent verification.
Earlier AP reporting quoted family attorney Rob Carey alleging that the workout lasted well over an hour, that some participants had no rest and only one water break, and that players showed signs of trouble before Mayich collapsed. The preliminary-report account describes a water break about 20 minutes into the activity but does not establish the session’s full rest schedule. The accounts do not resolve that difference.

AP reported that ASU described its preliminary work as fact-finding about the workout and related university rules and protocols, while noting that it had limited medical information and was respecting the family’s privacy. The medical description reported publicly has also been attributed to Carey: he said Mayich suffered exertional heat stroke that reduced oxygen flow to his brain and was unlikely to recover. That is the attorney’s account, not an independently confirmed medical finding in the reporting cited here.

Why does the family say the review is too narrow?
Through Carey, the family said it wants an investigation into why the workout was allowed, why it was not stopped when players appeared distressed, and which school, conference or NCAA rules may have been violated. Those are the family’s questions and allegations, not findings that a rule was broken. The family also asked for Bales to report to the Arizona Board of Regents rather than the university office conducting ASU’s own review.

The family welcomed Bales’s appointment while objecting to the mandate. In a statement reported by AP through Carey, the family said: “Justice Bales is a respected choice and he will do an excellent job. But ASU hired him to review policies that may help prevent a tragedy like this in the future. That’s not what’s needed right now.”
The family cited the 2018 death of University of Maryland football player Jordan McNair, noting that Maryland used outside investigators and reported to its Board of Regents, which released findings publicly. That comparison reflects the family’s argument about oversight; it does not establish that the circumstances of the two cases are equivalent.

How does the review differ from the law-enforcement process?
| Process | Reported purpose or role | Status in AP reporting |
|---|---|---|
| Bales review | ASU-commissioned examination emphasizing policies and practices for outdoor athletics, with recommendations for prevention. | Under way; ASU set an early-December 2026 target for completion. |
| Arizona State police investigation | Separate law-enforcement investigation into the incident. | Reported as continuing; a completed report was to go to the Maricopa County Attorney’s Office for independent review. |
AP also reported that hockey coach Greg Powers was placed on administrative leave as the investigation continued. ASU Athletic Director Graham Rossini said the university’s focus was on Mayich, his family and supporting student-athletes. The leave and investigations do not, by themselves, establish a finding of fault.

The preliminary account identifies a missing submitted training plan for strength-and-conditioning review and describes the workout and emergency response. The family is pressing for a broader inquiry into authorization, conduct and possible rule violations. Those are distinct questions: a review of institutional policies may recommend safeguards without determining who made particular decisions or whether specific rules were violated.

The scope of Bales’s review, its reporting line and whether findings will be made public also remain unresolved.
