Apple, Jon Prosser and Michael Ramacciotti disagree over what remains to be produced in Apple’s trade-secret lawsuit and who is responsible for the pace of discovery. In a joint status report made public October 8, 2026, Apple said it still needs documents from Prosser and more testimony from Ramacciotti. Both defendants disputed aspects of Apple’s requests. The report describes competing positions in a pending case—not a ruling on liability or on whether the information at issue remains legally secret.

What the parties say is holding up discovery

Apple says it is still waiting for certain documents from Prosser, including YouTube channel revenue reports and analytics, as well as communications with third parties identified during his deposition. Apple wrote that it “continues to await his production of certain additional documents that it requested over three months ago.” Apple wants discovery to continue.

Prosser says he has met the discovery obligations he agreed to and argues that the information Apple seeks to protect is now public. His position does not establish that the information legally ceased to be a trade secret.

Apple also wants Ramacciotti to update his interrogatory responses and sit for a second deposition. Ramacciotti says he will appear again if Apple first provides “a roadmap to resolution of its claims against him, including what more, if anything, Apple needs from him.” He asks the judge to hold a status conference and then give Apple 30 days to dismiss its claims against him or commit to taking the case to trial.

What happens next

The court has not yet resolved the parties’ dispute over discovery in the materials available for this update. Ramacciotti has requested a status conference; if the judge does not grant that request, the parties propose filing another joint status report on December 2, 2026. The October 8 account reports the contents of the joint status report, while the docket mirror reviewed for this update had not yet listed it.

Why Apple filed the lawsuit

Apple filed the case on July 17, 2025, in the U.S. District Court for the Northern District of California. The docket identifies it as a Defend Trade Secrets Act case before Judge James Donato. Apple’s complaint pleads trade-secret misappropriation under that law and a claim under the Computer Fraud and Abuse Act. Those are allegations, not findings by the court.

Apple alleges that Ramacciotti accessed an employee’s development iPhone and showed unreleased iOS material to Prosser over FaceTime. Apple says Prosser recorded and shared information used in videos. The complaint refers to the unreleased system as iOS 19, which Apple later named iOS 26, and identifies camera, Photos and messaging details, as well as the planned interface and user experience, among the information allegedly exposed.

What the earlier default means

The docket records that the clerk entered default against Prosser on October 17, 2025, after Apple sought entry of default. A clerk’s entry of default is not a final judgment resolving the allegations. 9to5Mac reports that the court later set the default aside, giving Prosser another opportunity to formally contest Apple’s claims; the docket mirror reviewed here ends with entries from December 2025 and does not independently show that later order.

Are the alleged iOS details still trade secrets?

That question has not been answered by the positions described in the October 8 update. Prosser argues that the trade secrets at issue are now public, writing that “[i]t appears that the Trade Secrets at issue are no longer trade secrets and are in the public domain.” That is his argument, not a judicial determination. The available update establishes no final decision on whether the information qualifies as a trade secret or whether any party is liable.
