A former Cornell student identified in court papers as Jane Doe alleges that members of the Chi Phi fraternity sexually assaulted her at the fraternity house in October 2024. The allegation is contested: several accused men deny having nonconsensual sex with her or deny touching her. Cornell’s completed campus disciplinary process, the civil lawsuit, and the reopened criminal investigation are separate proceedings, and none should be treated as a final criminal finding.
What does the lawsuit allege?
In a civil complaint filed in September 2026, Jane Doe alleges that an assault took place at the Chi Phi house on October 19–20, 2024. According to the complaint, she had consumed alcohol earlier and was given alcohol, marijuana, and ketamine before becoming incapacitated and being sexually assaulted by multiple fraternity members. Those are allegations in a civil filing and related reported statements, not facts established by a criminal court.
Several of the accused men deny nonconsensual sex or say they did not touch Doe. The disagreement over what happened remains central to the civil claims and the criminal investigation.

What did Cornell’s inquiry conclude publicly?
Cornell says its Title IX investigation has concluded. The university has said that some students were expelled or suspended, but it has declined to identify individual outcomes, citing federal privacy law. The Chi Phi chapter remains barred from campus.
The AP’s reported figures describe the scope of Cornell’s internal inquiry: 50 interviews with 32 witnesses, 12 days of hearings, and a 99-page panel report. These are details of a university process, not the result of a criminal trial. The publicly available information does not specify each student’s discipline or establish a criminal verdict.

Why was the criminal investigation reopened?
Jane Doe reported the incident to Cornell police in November 2024, according to the AP. The local district attorney initially declined to bring charges after reviewing a campus-police summary. AP reported that the prosecutor relied on that summary rather than a full interview transcript, and that the summary did not include Doe’s reported certainty that she had been raped.

AP’s fact-check says the claim that Doe never told police she had been raped is misleading: according to AP’s account of the interview transcript, she said later events involved coercion and that she was certain she had been raped. That account of what the transcript recorded does not independently establish that an assault occurred.

After the civil lawsuit was filed in September 2026, the district attorney reopened the investigation. Reuters reported that the matter would be presented to a grand jury for possible indictment. That is a potential next step, not evidence that an indictment has been issued. In October 2026, New York Attorney General Letitia James took over as special prosecutor. James said her office would “review the facts, gather evidence, interview witnesses and, if warranted, pursue prosecutions.” No final criminal finding is reported.

Cornell’s trustees selected former Deputy Attorney General Sally Yates to lead an independent review of the university’s handling of sexual-misconduct complaints and related campus processes. The review concerns the university’s handling of such matters; it is not a criminal investigation or a ruling on Doe’s allegations. The review’s conclusions had not been reported as of October 2026. Trustee Chair Anne Meinig Smalling said, “It is imperative that Cornell be willing to examine itself with the same rigor we expect of others.”

What can—and cannot—be concluded now?
- The civil complaint contains serious allegations about an October 2024 incident, and the accused men’s denials mean the underlying account is contested.
- Cornell says its university inquiry is complete, but individual disciplinary outcomes are not public.
- The first decision not to prosecute was followed by a reopened criminal investigation and a transfer to the state attorney general. Neither the earlier decision nor the reopening establishes whether a crime occurred.
- The civil lawsuit, criminal investigation, university process, and trustee-commissioned review have different purposes and decision-makers. Their outcomes should not be treated as interchangeable.
