AI can set or change a pay rate, but it does not take an employer off the hook for applicable wage laws. The U.S. Department of Labor (DOL) says employers using AI or other technology to calculate pay must still meet federal minimum-wage and overtime requirements for covered workers. Whether a particular worker is covered, or is owed money, depends on the facts and applicable law.

Can AI decide how much you get paid?

Automated systems may calculate rates using factors such as supply and demand, customer traffic, location, worker efficiency or performance, and task type. Some systems may recalculate rates during the day. Automated assignment tools can also affect earnings by determining how many tasks a worker receives or which kinds of tasks they are offered. The DOL describes these practices in its Field Assistance Bulletin 2024-1.

That bulletin does not establish that every platform worker is legally an employee, that every algorithmic pay system is unlawful, or that any particular worker is owed wages. It does make clear that using technology to calculate pay does not remove an employer’s obligations under the Fair Labor Standards Act (FLSA), when that law applies. Variable rates must still be considered alongside the worker’s hours and earnings when assessing compliance.

What wage rules apply when your rate changes?

For workers covered by the FLSA, the DOL wage overview lists a federal minimum wage of $7.25 per hour. It also says covered, nonexempt employees generally must receive overtime pay of at least one and one-half times their regular rate for hours over 40 in a workweek. A state or local minimum wage may be higher, and a higher applicable state minimum takes precedence where both laws apply. Coverage and exemptions can change which rules govern a particular job. Check the DOL’s minimum wage and overtime overview and the rules for your state or locality.

A changing rate is not by itself proof of a violation. The relevant questions include how much you earned across the workweek, how many hours you worked, whether your work is covered and nonexempt, and which minimum-wage and overtime rules apply. A system’s displayed rate for one task or one moment may not answer those questions on its own.

How to check whether you may be owed wages

  1. Gather your own records. Save schedules, time entries, pay statements, rate screens, task or assignment histories, and notices showing rate changes. Note dates and the hours you worked, including schedule deviations. A personal log can help you organize information, but it does not replace employer records or, by itself, establish a legal claim.
  2. Compare hours with pay by workweek. Look at total hours and earnings for each workweek rather than relying only on a stated hourly or task rate. If your rate varied, retain the information showing when and how it changed. The legal calculation can depend on coverage, exemptions, applicable local rules, and the details of your compensation.
  3. Search the DOL’s Workers Owed Wages database. The DOL’s Wages page links to its Workers Owed Wages database, where you can search for back pay the Wage and Hour Division is holding.
  4. Ask for an explanation or correction. If a pay or assignment record seems inaccurate, ask the employer or platform how the rate and hours were calculated and how to report incorrect data. Keep the response with your records. Whether a particular system offers an appeal or human review is specific to that employer or platform.

What the Workers Owed Wages search does—and does not—show

The database is a lookup for back wages held by the DOL’s Wage and Hour Division. A match may help you identify money being held for you and follow the agency’s instructions. No match does not establish that you were paid correctly: the tool is not a complete search of every employer, state agency, private claim, or unpaid amount.

What records can help clarify a pay dispute?

The DOL’s FLSA compliance guide explains that covered employers must keep certain records for nonexempt employees. For a stable schedule that rarely changes, it describes recording the usual schedule and noting deviations as one possible recordkeeping method. Keep your own contemporaneous notes and copies of available pay information as an organizational aid; they do not substitute for employer records or decide whether wages are legally owed.

When rates or assignments are controlled by automated decisions, useful questions include which inputs affect pay, whether workers can see the relevant records, how incorrect information can be corrected, and whether a decision can be reviewed by a person. These are questions to put to the employer or platform, not verified features of any particular system.

What DOL guidance says about workplace AI

In October 2024, the DOL announced AI Best Practices for developers and employers as a roadmap for worker-centered implementation and protection of labor and employment rights. It is guidance, not a binding wage-law standard and not evidence that a particular system meets those principles. The department also announced AI and Worker Well-being principles in May 2024; that page notes that some information may not reflect policies after January 20, 2025. These materials provide context for transparency and worker voice, while wage obligations remain governed by applicable law.

The available DOL materials do not quantify how often AI pay systems cause errors or underpayment, or how many workers are affected. They support the narrower conclusion that employers remain responsible for complying with applicable wage rules when technology calculates pay.
