Neither AI medical scribes nor human medical transcriptionists can be called categorically more accurate or private on the available evidence. AI scribes can generate useful draft notes, but may omit or invent clinically important details, so clinician review matters. Privacy depends on the information handled, the service’s data practices, contracts, and safeguards—not whether the vendor uses AI or a person.

What is being compared?

An ambient AI scribe listens to a patient-clinician encounter and produces a draft note. Depending on the product, that process can involve speech recognition, speaker identification, summarization, structuring, and note generation. Each stage can introduce different errors.

A medical transcriptionist typically turns a recording or clinician dictation into text. That is not automatically the same task as creating a structured clinical note: a transcript aims to represent spoken words, while a note may summarize, organize, or interpret them. Neither task is the same as a clinician reviewing and approving the final record.

Workflow Typical output What an accuracy review should distinguish
AI ambient scribe A draft note generated from an encounter; the specific steps vary by product Speech recognition, speaker attribution, omissions, invented details, summarization, clinical certainty, and formatting
Human medical transcription Text produced from recorded speech or dictation Misheard words, omissions, speaker attribution, formatting, and whether editing or interpretation is part of the contracted task
Clinician-authored or clinician-edited note A clinical record written or approved by a clinician Whether the documentation accurately reflects the encounter and relevant chart context

These outputs should not be treated as interchangeable. The studies cited below evaluate AI scribe tools or their notes; they do not establish a matched comparison with professional human transcriptionists.

How accurate are AI medical scribes?

Published evaluations show that errors can survive into draft notes, but their results are specific to the tools, encounters, and methods studied. They are not a universal error rate for every product or specialty.

Transcript errors can carry through to a note

A 2025 simulated ambulatory-encounter study reported an average of 13.9 transcript errors across the tested platforms, with 19.5% of those transcript errors transmitted to the clinical note. The study also found variation among platforms and in documentation quality. Those figures describe that study’s tested systems and simulated encounters, not routine use generally, and they do not compare AI with human transcriptionists. Note quality includes more than transcription

A 2025 JMIR instrument-validation study examined AI-enabled scribe output for accuracy and safety concerns, including misplaced or irrelevant content and material that could be technically correct but inappropriate in context. Its findings support evaluating the output as a whole rather than relying on a single transcription-accuracy label; they do not show that every AI scribe has the same failure pattern. A separate 2025 framework paper evaluates ambient scribing across transcription, diarization (identifying who said what), and note generation. It reported shortcomings in factual accuracy and capturing new medications. This staged view is useful because a system can recognize words correctly yet still attribute them to the wrong speaker, omit them in a summary, or produce a misleading note. Specialty simulation found both strengths and safety concerns

A 2026 JAMA Network Open study assessed AI-generated notes from simulated encounters in cardiology, gastroenterology, hematology-oncology, and neurology. Sixteen clinicians participated—four per specialty—and the evaluation took place at a Veterans Health Administration simulation center in February 2025. Across specialty ratings, mean overall PDQI-9 note quality was 36.2 out of 50 (SD 10.9). Ratings were highest for succinctness and lowest for thoroughness. Scores differed descriptively by specialty, but the differences were not statistically significant (ANOVA P=.09). The authors note that the simulation, limited specialties, and lack of EHR integration constrain what the results establish about everyday practice. Read the JAMA Network Open study.

In clinician feedback from that simulation, concerns included fabricated examination findings, missing pertinent negatives, and notes that did not represent diagnostic uncertainty appropriately. One hematology-oncology participant described an allergy example: “Or [for] allergies—it said ‘none,’ and it wasn’t asked. Like, those are big safety issues.” This is a participant’s qualitative comment, not a measured frequency of errors. Clinicians also saw possible benefits such as less typing, more eye contact, and better capture of encounter details. The study authors noted that integration with prior notes, test results, and EHR workflows could affect usefulness; they suggested subjective histories or new-patient assessments may suit the tools better than follow-ups needing substantial chart context.

The same study raised a patient-communication concern: clinicians worried that some patients might limit sensitive disclosures if they knew an encounter was being recorded. That was feedback from a simulated evaluation, not a measured change in patient behavior during routine care.

Are AI scribes more accurate than human transcriptionists?

The available sources do not establish that either group is more accurate. They do not compare AI scribe notes with professional human transcriptionist output from the same recordings using shared error definitions, review standards, or correction-time measures. The 2026 specialty study rates AI-generated notes; it is not a head-to-head transcription study.

A fair comparison at a clinic or health system should use the same representative encounters and define what counts as an error. It should separately assess misheard words, omissions, invented content, speaker attribution, summarization, clinical interpretation, and formatting. It should also track how long reviewers spend correcting each output and whether errors remain in the approved record. Comparing an AI draft note with a human-produced transcript alone would conflate different tasks.

Are AI medical scribes and transcription services HIPAA compliant?

There is no blanket answer based on a product label. Under U.S. HIPAA guidance, a vendor that handles protected health information (PHI) on behalf of a covered entity may be a business associate. HHS identifies independent medical transcriptionists and app vendors providing transcription services to physicians as examples; a cloud service that processes or stores electronic PHI for a covered entity or business associate is also generally a business associate. This can apply to human transcription services as well as AI services. See HHS guidance on business associates.

HHS says the parties generally need a compliant business associate agreement (BAA), and the covered organization must understand the service and conduct its own risk analysis. Encryption does not necessarily remove the vendor’s business-associate status: HHS says a cloud provider that maintains ePHI can remain a business associate even if it does not possess the encryption key. See HHS guidance on HIPAA and cloud computing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A BAA is not, by itself, proof that a service is safe or suitable for a particular organization. HHS’s Office for Civil Rights says, “OCR does not endorse, certify, or recommend specific technology or products.” Evaluate what the contract permits and what safeguards actually apply, rather than treating a vendor’s “HIPAA compliant” claim as a product endorsement.

Check the whole data lifecycle and workflow

  • Retention and deletion: Find out whether audio, transcripts, and generated notes are stored separately, for how long, and how they are returned or deleted when the service ends.
  • Permitted uses: Check whether the BAA and service terms allow model training, product improvement, analytics, or other uses of the data.
  • Access and subcontractors: Identify which vendor staff, cloud providers, and other subcontractors may handle the information, and what contracts and controls govern them.
  • Security and incidents: Review safeguards, access controls, audit evidence, breach-notification commitments, and backup and recovery arrangements.
  • Accuracy and review: Ask whether the vendor’s performance has been evaluated on encounters representative of your setting, and make clear who reviews and approves a draft before it enters the record.
  • Workflow fit: Determine whether the tool can use relevant prior notes, medications, tests, templates, and EHR fields—and whether review saves time or shifts work into correction.
  • Patient communication: Establish what notice or consent process applies to recording in the relevant jurisdiction and setting. The applicable rules are not settled by HIPAA guidance alone.

What should UK health and care organizations consider?

NHS England’s guidance, published April 27, 2025, advises organizations using AI-enabled ambient scribing to assess product evidence and accuracy, including errors, omissions, and dysfunctions. It calls out potential effects from accents, regional dialects, and speech impairments, and recommends clear governance, accountability, human oversight, auditing, and record-keeping. This is UK guidance, not a U.S. HIPAA rule. Read the NHS England guidance.
