The key difference is not simply whether a person or an AI tool made the image. Copyright depends on the law that applies and on the human creative expression, if any, in the work. An AI tool can assist a human artist, but a prompt alone does not automatically make the user the copyright author of the generated image under the current U.S. Copyright Office approach. The UK and EU use distinct legal frameworks.
What is the difference between AI-generated and human-made art?
“AI-generated” and “human-made” describe how an image was produced. Copyright asks a separate question: whether the image contains original expression attributable to an author under the law of the relevant jurisdiction. A work can look novel without meeting that legal test, and using a digital or AI tool does not by itself determine whether copyright applies.
In the United States, the Copyright Office describes copyright as protecting original works of authorship once they are fixed in tangible form. It says works are original when independently created by a human author and possessing a minimal degree of creativity. These are U.S. formulations, not a universal definition. For an image made with generative AI, the practical question is which expressive choices came from a person and which came from the system. A finished image may combine generated material with a person’s own creative contributions. Copyright protection, where available, may cover the human-created contribution without extending to every generated element.

Can you copyright AI-generated art?
Sometimes, in part; not automatically as a whole. The U.S. Copyright Office’s January 29, 2025 report says existing copyright principles can address generative AI outputs. Using AI as an assistive process, or including AI-generated material within a larger human-created work, does not by itself rule out protection. The Office identifies human-authored expression perceptible in the output, creative selection or arrangement of generated material, and creative modifications as contributions that may qualify. Typing a prompt does not automatically make the user the copyright author of the expression the AI generates under this U.S. approach. The issue is not whether the person participated in the process, but whether their own creative choices are expressed in the resulting work and meet the applicable legal standard.

Examples of contributions that can matter
- Direct human expression: A person paints or draws parts of an image, then uses an AI tool for assistance. The person’s own expressive material may be protectable, subject to the usual requirements.
- Selection or arrangement: A person makes creative choices in selecting and arranging generated elements, or combines images into a larger composition. The resulting arrangement may qualify even if some component material does not.
- Creative modification: A person substantially reshapes, edits, or adds to generated material. The human-authored changes may be protectable; the scope depends on the actual contribution.
- Prompting alone: A prompt can guide generation, but its existence alone does not establish that the user authored the image’s generated expressive details.
These are examples of the kinds of contributions the U.S. Copyright Office discusses, not automatic outcomes for any particular image.
How do the United States, United Kingdom, and EU differ?
The same image-making process can raise different copyright questions in different places. The U.S. materials described here focus on human authorship; UK law includes a statutory provision for certain computer-generated works; and the EU originality formulation centers on the author’s own intellectual creation. The comparison below summarizes the frameworks addressed in the cited materials, not a legal determination for an individual image.

Is AI art original?
That depends on what “original” means in context. In ordinary conversation, it may mean that an image looks new or unlike familiar work. Copyright originality is a legal standard, and visual novelty by itself does not answer whether the image qualifies for protection or who authored its expression.
For AI-assisted work, assess the image’s human-authored parts rather than treating the whole output as one indivisible result. A person may have made creative decisions in editing, choosing, combining, or arranging material even when a system generated other elements. The U.S. Copyright Office says the sufficiency of such contributions depends on the particular work; the EU formulation asks whether the work reflects the author’s own intellectual creation. Neither approach supports a blanket rule that every AI-assisted image is protected or that none can be.

What does “rights” mean for an AI image?
Copyright in the output is only one possible rights question. It is separate from permission to use a model or service, claims about material used to train a system, rights in a person’s likeness or other third-party material, and duties to disclose synthetic content. A conclusion on one issue does not settle the others. The sources cited here do not establish the terms of a particular AI service, the contents or legal status of a particular training corpus, or whether a specific image violates someone’s rights.
Copyright in the image
This concerns whether the image, or particular human-authored elements of it, qualifies for copyright protection under the relevant jurisdiction’s rules. For a mixed human-and-AI output, protection may be limited to the human contribution rather than the generated material.

Service terms and permission to use the tool
A provider’s contract or license can set terms for using its service or outputs. Those terms are not the same as a government copyright determination. Check the applicable service terms for the tool, account, and date in question; this article does not assess any provider’s contract.
Training material and third-party rights
Whether a particular work was lawfully used to train a model, or whether an output implicates another person’s rights, is a separate question from whether the user owns copyright in the output. No conclusion about a specific training source, likeness, or image follows from the general copyright principles above.
EU transparency duties
The EU AI Act addresses transparency separately from copyright ownership. Consolidated Article 50 provides for machine-readable marking and detectability for covered systems that generate synthetic image, audio, video, or text, subject to qualifications and exceptions. It also provides for disclosure by deployers of certain generated or manipulated deepfake content. For material forming part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, it limits the manner of disclosure so that display or enjoyment is not hampered. These provisions concern transparency; they do not decide who owns copyright or make otherwise unprotected work copyrightable. How to evaluate a particular AI-assisted image
- Identify the jurisdiction. Copyright analysis can differ between the United States, the United Kingdom, and EU member states; do not apply one jurisdiction’s answer everywhere.
- Separate the image’s elements. Note which parts were generated and which were drawn, edited, selected, arranged, or otherwise expressed through human creative choices.
- Describe the human contribution concretely. Record the actual creative changes or arrangement rather than relying only on the fact that a prompt was written or a tool was used.
- Consider the applicable originality test. The U.S. Copyright Office evaluates the sufficiency of human contributions case by case; the UK and EU frameworks have their own formulations.
- Check the other rights questions separately. Review relevant service terms and investigate potential third-party rights or applicable disclosure duties; copyright in the output does not answer those issues.
This framework helps identify the issues but cannot determine the legal status of a particular image. For a consequential use or dispute, seek advice from a qualified lawyer in the relevant jurisdiction.
