No—HIPAA does not automatically protect every health-related detail held by every app or company. HIPAA applies to defined health care entities and their business associates. Other federal rules may apply to some businesses outside HIPAA, and state laws can add protections or create separate obligations. Which rules matter depends on who holds the data, what the data is, what the company does with it, and which jurisdictions apply.
Why health information is not automatically covered by HIPAA
HIPAA is a law with a defined scope, not a general privacy label for anything connected to health. A company does not become subject to HIPAA simply because its records mention a diagnosis, track exercise, or contain other sensitive information.
Who HIPAA covers
HHS says the HIPAA Rules apply to covered entities: health plans, health care providers that conduct standard health care transactions electronically, and health care clearinghouses. They also apply to certain business associates that perform functions for covered entities or handle protected health information (PHI) in connection with services to them.
So a hospital or health insurer may be covered, while a separate consumer app holding health-related data may not be. The app’s relationship with a covered entity and its role in handling PHI can matter; the subject matter of the data alone does not settle the question.

What to check for an app or device
For a fitness tracker, wellness app, or other consumer service, ask who operates it, whether it is acting for a HIPAA-covered organization, and what data it collects and shares. Do not assume either that the product is covered because it holds health data or that no rules apply if HIPAA does not.
What federal protections may apply outside HIPAA
HHS’s overview of consumer health information explains that the FTC Act applies to businesses handling health information whether or not they are covered by HIPAA. Companies must not engage in unfair or deceptive practices. That can make a company’s statements about its collection, use, retention, or sharing of data important: a misleading privacy promise can raise an FTC Act issue.
The Health Breach Notification Rule has a narrower scope
The FTC Health Breach Notification Rule applies to specified personal health record vendors, related entities, and third-party service providers. It is not a rule that automatically covers every health app. HHS describes a covered breach as including unauthorized acquisition from a security incident or unauthorized disclosure by the company. Whether a particular service falls within the rule depends on its role and the rule’s scope.

These federal rules address different questions. The FTC Act’s unfairness and deception prohibitions can apply to companies outside HIPAA, while the Health Breach Notification Rule imposes notification duties on specified categories of businesses when its requirements are met.
How HIPAA and state law interact
HHS describes HIPAA as a federal floor of privacy protections for individually identifiable health information held by covered entities or their business associates. A state requirement that is contrary to HIPAA is generally preempted, but exceptions apply. Among them are certain state laws that provide greater privacy protections or rights, as well as specified public-health, disease-reporting, and health-plan-reporting rules.
That is why neither “HIPAA overrides every state rule” nor “state law always wins” is a reliable shortcut. The particular state provision, the information and entity involved, and the relevant exception all matter.

Public-health disclosures are a separate consideration
HIPAA permits covered entities to disclose PHI without an individual’s authorization for specified public-health purposes, such as reporting to legally authorized public-health authorities to prevent or control disease, injury, or disability. HIPAA also permits disclosures required by law. Privacy protections therefore do not amount to an absolute bar on disclosure; the purpose and legal basis for a disclosure matter.
What Washington’s My Health My Data Act illustrates
Washington enacted its My Health My Data Act in 2023. The Washington Attorney General describes it as protecting personal health data outside HIPAA’s ambit. It is one example of a state law that can address consumer health data beyond the traditional HIPAA relationship—not a nationwide rule.
What counts as consumer health data
Under RCW 19.373.010, “consumer health data” is personal information linked or reasonably linkable to a consumer that identifies the consumer’s past, present, or future physical or mental health status. Listed examples include conditions, treatment, diagnoses, interventions, procedures, medication use, and bodily functions or measurements.

The law’s definitions also connect its coverage to Washington residents, collection in Washington, and entities doing business in or targeting Washington while determining the purposes and means of processing. Those definitions are relevant to coverage; they do not mean every company handling health-related data is covered in every situation.
Policy and consent requirements
RCW 19.373.020 requires regulated entities and small businesses to maintain a consumer health data privacy policy. The statute generally restricts collecting, using, or sharing additional categories of consumer health data without disclosure and affirmative consent. Defined terms, scope provisions, and exceptions affect how those requirements apply to a particular company or activity.

State laws do not all use the same approach. For example, Connecticut’s 2026 codification of its consumer data privacy chapter lists HIPAA PHI among the exclusions from that chapter. That provision is a reminder to examine the specific statute and data category rather than assume a state consumer-privacy law applies to all health information.

Washington and Connecticut are examples, not a fifty-state survey. A reader’s rights or a company’s duties may turn on state residence, where information is collected, business activity or targeting, statutory definitions, and exclusions. State rules also change, so a decision about a specific dataset should be checked against current law in the relevant jurisdictions.
What HIPAA breach notification does—and does not—tell you
HIPAA’s Breach Notification Rule concerns breaches of unsecured PHI. An impermissible use or disclosure is presumed to be a breach unless an exception applies or a risk assessment shows a low probability that the PHI was compromised. HHS says the assessment considers the nature and extent of the information and identifiers, who received it, whether it was actually acquired or viewed, and what mitigation occurred.
For breaches affecting 500 or more individuals, notice to HHS is due without unreasonable delay and no later than 60 days. For breaches affecting fewer than 500 individuals, reporting may be annual and is due within 60 days after the end of the calendar year in which the breach was discovered. These are HIPAA reporting rules for covered breaches; they do not establish that every health-data incident is governed by HIPAA. The FTC Health Breach Notification Rule separately covers certain non-HIPAA personal health record businesses.
A practical way to assess which rules may apply
For a particular app, record, or incident, work through these questions rather than starting with the assumption that all health data is either covered or unprotected:
- Identify the holder and its role. Is it a HIPAA covered entity, a business associate handling PHI for one, a personal health record vendor or related service provider, or another business?
- Describe the data precisely. Is it PHI under HIPAA, identifying electronic health information in a personal health record, or consumer health data as defined by a state law?
- Pin down the action at issue. Are you asking about collection, use, disclosure, sale, security, breach notification, access, deletion, or consent? Different rules may govern different actions.
- Check the jurisdictions. Consider the person’s state, where the data is collected, and where the business operates or targets consumers. Do not assume one state’s law supplies the rule for everyone.
- Read the scope limits and exceptions. Check whether the law excludes a type of entity or record, or permits an activity such as legally required reporting or a specified public-health disclosure.
