California’s 2014 smartphone “kill switch” law was aimed at deterring theft: covered phones sold from July 1, 2015 were to include an opt-in feature that could make essential functions unusable to someone who had the phone without the owner’s authorization. The bill analysis described the feature as reversible, so the rightful owner could restore the phone after recovering it. It does not mean every current phone has the same feature, settings, or defaults.
What the “kill switch” was meant to do
In this context, “kill switch” means a remote anti-theft function—not a way to permanently destroy a phone. The May 7, 2014 California Senate floor analysis described a technological solution that could render essential smartphone features inoperable when the device was outside its rightful owner’s possession. The intended effect was to make a stolen phone less useful to an unauthorized user.
The analysis described the feature as reversible: after recovering the device, the rightful owner or an authorized designee could restore its essential functions. It also said the solution should withstand a hard reset. These are terms described in the analysis of the bill, not a guarantee about how every present-day phone behaves. What California’s bill analysis said the requirement covered
California SB 962 is the law at issue. The May 7, 2014 floor analysis said the requirement would apply to smartphones manufactured and sold in California on or after July 1, 2015. It described coverage for retail sales in California and devices shipped to a California address, with an exception for specified secondhand transactions.

The analyzed bill version said a device’s default setting must prompt the user to enable the feature during activation and registration. It also described a civil penalty of up to $2,500 for each noncompliant smartphone sold after July 1, 2015. Those details come from a legislative analysis of the bill version it considered; they should not be treated as confirmation of current codified law or enforcement status.
How a kill switch differs from other anti-theft tools
Anti-theft features can serve different purposes. Locating a phone helps identify where it is; locking or disabling access restricts its use; remote erasure removes data stored on it. A feature that renders essential functions unusable is aimed at reducing the value of the device to an unauthorized user. These functions are not interchangeable, and the 2014 legislative materials do not establish that all current phones offer them in the same way.

- Locate: helps find a device, if the relevant service is available and configured.
- Lock or disable access: restricts use or access without necessarily erasing stored data.
- Erase: removes stored data, which is different from merely restricting device use.
- Restore: the bill analysis described recovery by the rightful owner or an authorized designee; current restoration steps depend on the device and service.
Why the law emerged—and what the evidence does not prove
The anti-theft effort was not limited to California legislation. A June 19, 2014 New York Attorney General report said participating companies had committed to providing a “baseline anti-theft tool” on new devices by July 2015, but that commitment did not require an opt-out default. A 2015 California Commission on the Revision of the Penal Code memo recounted an estimate of 3.1 million U.S. smartphone-theft victims in 2013. The memo also said the initiative and related legislation were credited with a 50% reduction in smartphone robberies in San Francisco. The passage does not establish that the law alone caused the decline, so those figures should be read as historical claims reported by the commission, not proof of a causal effect. What it means for you now
The practical takeaway is that the law’s central idea was owner-controlled remote protection: a person who loses a phone should have a way to make it less useful to someone else and regain normal operation if it is recovered. The sources cited here do not establish the law’s current code citation or enforcement status, nor do they verify today’s setup paths, defaults, or capabilities on specific phones.
If you need to protect or locate a phone you own, use the current official support instructions for its manufacturer and operating system. Check which functions are available and whether they must be enabled in advance; do not assume that locating, locking, disabling, erasing, and restoring are the same operation.
