The platform’s label alone does not decide your legal status: the IRS weighs how the work actually operates. That classification affects who handles the contributions, but it is not a status workers can simply choose by agreement.
Questions to ask before accepting the work
- How will you classify me, and for what purpose? Ask whether the platform considers you an employee or self-employed contractor for federal employment-tax purposes, and request the written terms and the basis for that treatment. A contract label is relevant evidence, not the whole test.
- Will you withhold Social Security and Medicare taxes from my payments? Employees generally have these taxes withheld through payroll. A payer generally does not withhold payroll taxes from payments to someone it treats as self-employed, so you may need to plan for self-employment and estimated taxes.
- Will the platform pay an employer share? Employers generally pay a matching Social Security and Medicare amount for employees. Self-employed workers generally cover both shares through self-employment tax.
- What tax statement and payment records will I receive? Ask which information return the platform expects to issue and how it will document gross payments, fees, adjustments, and any withholding. A tax form’s presence or absence does not by itself determine whether income is taxable or settle worker classification.
- Which expenses, equipment, and other costs are mine? Clarify who supplies tools, whether expenses are reimbursed, and what fees are deducted from payments. These financial details can matter to classification, and payment and expense records are important if you are self-employed.
- Where can I seek a status determination if the label does not fit the arrangement? The IRS allows either a worker or a business to file Form SS-8 to request a federal employment-tax status determination. In some circumstances, a worker who believes they were misclassified may use Form 8919 to report the employee share of uncollected Social Security and Medicare taxes.
How contributions differ for employees and self-employed workers
For federal employment-tax purposes, the key distinction is between payroll contributions under FICA and self-employment contributions under SECA. This comparison describes the general treatment; the facts and applicable rules determine which category applies.

The Social Security Administration explains: “The self-employed pay both the employee and the employer share of SECA.” The law permits a deduction for half of self-employment tax as a business expense; that deduction does not mean the worker pays only the employee share.
Why a platform’s contractor label is not decisive
For federal employment-tax purposes, the IRS looks at the facts of the working relationship in three broad categories: behavioral control, financial control, and the type of relationship. Behavioral control concerns how the company directs the work. Financial control includes business details such as payment, expenses, and tools. The relationship category can include written agreements and employee-type benefits.

The IRS weighs all relevant factors; there is no magic number of factors and no single factor settles status. Read the platform’s agreement, but also consider how the work is actually directed, paid for, and organized. For the IRS’s explanation, see Independent contractor (self-employed) or employee?
Other legal tests are distinct. For example, the Department of Labor describes an economic-reality analysis under the Fair Labor Standards Act and says its final rule became effective March 11, 2024. An IRS employment-tax determination does not automatically resolve every federal labor-law or state-law question. See the DOL’s FLSA classification FAQs. What taxes and records to plan for if you are self-employed
Gig income is taxable even if you do not receive an information return. The IRS says most self-employed individuals generally need to pay self-employment tax when net earnings from self-employment are $400 or more. This is a general threshold stated in the IRS FAQ, not a guarantee that every worker’s situation is the same; check current IRS instructions and exceptions for the tax year at issue.
Self-employed gig workers may also need to make estimated quarterly tax payments. Keep platform payment statements, records of fees and adjustments, and records of business expenses. When to ask for help with classification
If the platform’s stated classification seems inconsistent with the actual arrangement, gather the agreement, payment details, and information about how the work is directed and what costs you bear. A worker or business can submit Form SS-8 to ask the IRS for a federal employment-tax status determination. Form 8919 may apply in some cases when a worker believes they were treated as a contractor incorrectly; it is not a universal substitute for resolving classification. For questions about a particular tax year or work arrangement, consult current IRS guidance or a qualified tax professional.
