It is shorthand for using a hosting or cloud service in a way that supports compliance with the HIPAA Rules. Whether a provider is a business associate, whether a business associate agreement (BAA) is in place, and whether both parties have implemented appropriate safeguards for electronic protected health information (ePHI) are central questions.
A provider’s BAA or security features do not make a customer compliant by themselves. The customer must assess the actual service and its risks, configure its environment, and meet its own HIPAA obligations.
What does “HIPAA-compliant hosting” mean?
It describes a hosting arrangement intended to support compliance with applicable HIPAA requirements; it is not a defined certification category awarded by the U.S. Department of Health and Human Services (HHS). HHS’s Office for Civil Rights (OCR) says, “OCR does not endorse, certify, or recommend specific technology or products.” A provider should not be described as “HHS-certified,” and purchasing a particular plan does not automatically make an organization compliant. HHS OCR’s cloud-computing guidance, last reviewed December 23, 2022, explains the agency’s position.
HIPAA’s Security Rule focuses on protecting ePHI’s confidentiality, integrity, and availability. The relevant safeguards and responsibilities depend on the service, the risks, and how the parties configure and operate it. “Compliant hosting” is therefore a relationship and operating arrangement—not a property a server or cloud plan can guarantee in isolation.

When is a hosting provider a business associate?
A cloud service provider (CSP) is generally a business associate when it creates, receives, maintains, or transmits ePHI on behalf of a covered entity or another business associate. What the provider does matters more than the label it gives its product. A provider may be a business associate even if it stores only encrypted ePHI and does not possess the decryption key. As HHS puts it, “Lacking an encryption key does not exempt a CSP from business associate status and obligations under the HIPAA Rules.”
A narrow conduit exception can apply when a service only transmits ePHI and has no storage beyond temporary storage incident to transmission. That exception should not be generalized to ordinary hosting or storage.
What does the BAA need to cover?
Before a regulated organization uses a CSP to maintain ePHI, it should have a HIPAA-compliant BAA with that provider. HHS says using a CSP to maintain ePHI without first executing a BAA violates the HIPAA Rules. A BAA is necessary for a business-associate relationship, but it is not a substitute for the customer’s own risk analysis, safeguards, or HIPAA compliance work.

Review the agreement alongside the service terms and any service-level agreement (SLA). Confirm that the documents identify:

- The services and ePHI in scope.
- Permitted and required uses and disclosures of ePHI.
- Safeguards and each party’s security responsibilities.
- Incident reporting and applicable subcontractor obligations.
- How the provider will support the customer’s relevant HIPAA obligations.
- Access to ePHI during the service and arrangements for data return when it ends.
Make sure the SLA or other terms do not conflict with the BAA or prevent the customer from accessing its ePHI.
What must the customer assess and manage?
Covered entities and business associates must conduct risk analyses for ePHI they create, receive, maintain, or transmit. HHS describes risk analysis as foundational and recommends assessing and documenting security measures, whether required measures are in place, and whether they are configured and used properly. The assessment should reflect the actual service and architecture rather than a generic claim that a hosting platform is secure. Useful areas to examine include:
- Where ePHI is stored and transmitted, including the geographic location and related risks.
- Who controls identities, access permissions, and encryption keys.
- Administrative access to systems and tools that can affect ePHI.
- Configuration, patching, and responsibility for maintaining controls.
- Availability dependencies, incident handling, backup protection, and recovery.
These are practical prompts for evaluating risk, not a prescribed architecture or a claim that HIPAA mandates one specific product or configuration. Public, private, and hybrid cloud arrangements can be used when the required BAA is in place and the regulated organization otherwise complies. The configuration affects the risk analysis and how controls and contractual responsibilities should be handled; no cloud type is automatically compliant or prohibited.

Which safeguards and features should the parties map?
HIPAA’s safeguards address administrative, physical, and technical protections. The BAA or other written materials should make clear who implements each relevant control, and the customer should verify that controls assigned to it are enabled and maintained.

For example, in an arrangement where the provider cannot view ePHI, the customer may authenticate the users permitted to access it while the provider implements encryption. The provider still needs to address appropriate risks to administrative systems that manage the infrastructure and can affect ePHI’s confidentiality, integrity, or availability.
Encryption can help reduce unauthorized viewing, but it is not a complete compliance program. By itself, it does not ensure integrity or availability, prevent corruption, provide disaster recovery, or replace administrative and physical safeguards. Consider access control, risk management, incident response, backup and recovery, availability, physical protections, and clearly assigned responsibilities in light of the service’s risks.

Review how the service will work during outages, incidents, and the transition out of the provider. HHS identifies SLA topics that can include availability and reliability; backup and data recovery, including in ransomware or other emergencies; security responsibilities; data return at termination; and limits on use, retention, and disclosure.

Ask practical questions about how quickly restoration may occur, whether backups are protected and tested, how ePHI can be exported, and what happens when the service ends. These are procurement questions to evaluate against the organization’s risk analysis, not universal numeric HIPAA requirements.
Can customers require security documentation or audits?
The HIPAA Rules do not expressly require a CSP to provide security-practice documentation or permit customer audits. A customer can seek documentation, audit rights, or other assurances by contract based on its own risk analysis and compliance needs. HHS also notes that a CSP may be directly liable for applicable HIPAA requirements; the absence of an audit clause does not, by itself, mean the provider has no obligations.
How should organizations compare hosting options?
Compare the exact service and its responsibilities rather than treating “public,” “private,” or “hybrid” as a compliance verdict. For each candidate, establish the following:

- Which party handles each relevant administrative, physical, and technical safeguard.
- How identity, access, encryption keys, and administrative access are managed.
- What availability, backup, recovery, and incident-reporting commitments apply.
- How data is exported, returned, or deleted at termination.
- What documentation, audit rights, or assurance materials are available under contract.
- Where data is located and whether that creates additional risks.
- What configuration and ongoing operational work the customer must perform.
