When a GST rule is omitted or a new rule is made prospective, first identify the exact amending instrument and its effective date. Then check its savings or transitional wording and whether the relevant transaction or proceeding was still open on that date. Neither “prospective” nor “omitted” automatically decides what happens to every past period or pending case.

What does “prospective” mean for a GST change?

A prospective change ordinarily operates from its stated effective date rather than applying automatically to earlier periods. But that does not, by itself, settle the treatment of a pending notice, appeal, refund claim, or other proceeding. The instrument’s wording, applicable saving provisions, procedural status, and binding precedent can affect the result.

Start with the official CBIC Tax Information Portal to locate the relevant Act, rule, notification, circular, or order. Confirm the exact version applicable to the period in question and retain the amending instrument, not just a consolidated text or search result.

Record the dates that govern the issue

Distinguish the instrument’s issue date from its commencement or effective date. Then compare that effective date with the transaction, return, notice, adjudication, appeal, payment, reversal, or refund event in your case. A change issued on one date may specify that it takes effect on another.

Check savings and transitional wording

Read the full amendment for language preserving pending proceedings, liabilities, rights, or actions, and check whether a replacement provision continues them. Where relevant, consider section 6 of the General Clauses Act and any special saving provision. The Supreme Court’s judgment of 13 February 2026 discusses how such statutory savings can affect the result; it does not establish a universal outcome for every GST amendment. Does omitting a GST rule end a pending demand?

Not automatically. The Supreme Court’s 13 February 2026 judgment restates the principle from Kolhapur Canesugar Works Ltd. v Union of India: an unconditional omission without a saving for pending proceedings may stop actions founded on the omitted provision where the omission finds them. But section 6 of the General Clauses Act, a special statutory saving, or the terms of a replacement provision may alter that effect. The principle must be applied in its statutory context, not as a rule that all omitted provisions erase liabilities.

Procedural status matters. A proposed demand, an adjudicated demand under appeal, a final order, an amount already paid, and a refund claim are not interchangeable situations. Do not infer from omission alone that a concluded matter reopens, that a refund is due, or that a pending demand necessarily fails.

A GST example: Rule 96(10)

In M/S Shilap Medicare Ltd v The Union of India, WP No. 201122 of 2025, the Karnataka High Court considered Notification 20/2024 Rules, which omitted CGST Rule 96(10) prospectively from 8 October 2024. In its judgment dated 4 August 2026, the court concluded that the omission applied to pending proceedings or cases where final adjudication had not taken place, and set aside the show-cause notices and original orders in the matters before it. That ruling concerns a particular rule, notification, court, and procedural posture. Its application to another taxpayer depends on the facts, jurisdictional precedent, and subsequent appellate status; that appellate status is not established here. Do not treat the decision as a nationwide ruling on every omitted GST rule.

Use the following distinctions to organize the issue before changing a filed position or responding to a demand:

Position to assess Question to answer
Future transaction Which rule and rate or treatment apply from the effective date?
Past, closed period Was the relevant liability or entitlement determined, paid, or otherwise concluded before the change?
Open assessment or notice Was the proceeding pending on the effective date, and does a saving or replacement provision preserve it?
Pending appeal Does the applicable saving law or binding precedent address proceedings at this stage?
Final order, payment, or reversal Does the change provide a basis for further relief, or does a separate procedure or limitation apply?
Refund claim Does the governing text support the claimed entitlement and satisfy the relevant procedural requirements?

This is an issue-spotting framework, not a conclusion about any individual liability, remedy, or deadline. Compare the governing instrument and effective date, applicable savings, procedural status, the territorial reach and authority of court decisions, and the remedy being considered—such as future compliance, a defense to a demand, an appeal, or a refund claim.

Are GST Council proposals already law?

No. A Council agenda or committee proposal is not, by itself, an enacted amendment or an effective notification. The agenda for the 53rd GST Council meeting discusses proposed retrospective wording concerning input tax credit time limits and a proposed refund limitation in specified circumstances; it also records that the Law Committee did not reach consensus on the cited matter. Confirm the final Act, rule, or notification and its effective date before treating a proposal as law. See the 53rd GST Council meeting agenda.

What should finance teams do when a change affects an open matter?

  1. Identify the exact provision. Record the Act, rule, notification, or other text relied on for the return, assessment, refund, or internal tax treatment.
  2. Obtain the amending instrument. Note its issue date, commencement and effective dates, and any saving, transitional, or replacement wording. Keep the instrument with the relevant version of the underlying law.
  3. Build a chronology. List the transaction and invoice dates, return dates, notice and adjudication dates, appeal status, payment or reversal date, and the change’s effective date.
  4. Classify the procedural position. Establish whether the matter is a future transaction, closed period, open assessment, pending appeal, final order, payment or reversal, or refund claim.
  5. Check the legal framework. Review applicable saving provisions, including section 6 of the General Clauses Act where relevant, the terms of any replacement rule, and controlling decisions for the jurisdiction.
  6. Get case-specific review before acting. For material exposure or an active dispute, have an Indian GST professional examine the instrument, facts, limitation periods, and current jurisdictional authority before changing a filed position, stopping payment, or claiming a refund.
  7. Preserve the record. Keep source texts and a date-stamped chronology in the tax file so the position can be explained in an audit or litigation.

Use the CBIC CGST Act section 47 page as an example of why amendment history matters: it notes a sub-clause omitted effective 1 October 2022 by Notification 18/2022-Central Tax, pursuant to section 108 of the Finance Act 2022, and a separate insertion effective the same day. That section-specific history illustrates the need to check dates and text; it does not decide how every omission affects pending matters.
