Yes, an AI chatbot provider may disclose user data to police or another government authority in response to valid legal process or, under limited conditions, an emergency. That does not mean every concerning conversation is automatically reported. Provider safety reviews, account enforcement and responses to government demands are different things, and the rules depend on the service, account and location.
What “reporting” can mean
The phrase can describe two separate actions. A provider may disclose information it holds after receiving a government request. Separately, it may review conversations or account activity for safety and policy enforcement. A safety review or account action is not, by itself, evidence that the provider sent a conversation to police.
OpenAI says its systems analyze content and behavior for policy violations and harmful activity, and that some patterns may be reviewed by a trained team. That describes safety processes, not a blanket practice of referring flagged conversations to law enforcement. OpenAI’s explanation of its safety approach does not establish that every safety flag is reported to police.
When providers say they may disclose user data
ChatGPT and OpenAI
OpenAI’s December 2025 Law Enforcement Policy says the company may disclose user data in response to valid legal process. It also describes a limited emergency route when OpenAI believes disclosure is necessary to prevent an emergency involving danger of death or serious physical injury. The applicable OpenAI entity and process can depend on the user’s location and service; the policy distinguishes OpenAI US from OpenAI Ireland.

That policy is not the only disclosure pathway. OpenAI’s Privacy Policy also describes sharing personal data, including information about interactions with its services, for reasons such as legal compliance, safety, fraud prevention and policy enforcement.
Gemini and Google
Google says it may process Gemini information to meet applicable law, legal process or an enforceable government request. Its Gemini Apps Privacy Hub also describes safety and policy review, including review by human reviewers. Google explicitly says this may happen even when Keep Activity is off or temporary chats are used. That statement concerns the review described in Gemini’s notice; it does not establish that those settings have no effect on every retention or training practice.

Google’s broader explanation of government information requests says it reviews requests, may narrow those it considers too broad, and may object to producing information. The applicable process depends on the Google entity providing the service and the relevant law.
Claude and Anthropic
Anthropic says it evaluates requests for legal validity and may reject requests it considers overly broad or vague. Its government-request help page describes an emergency exception where imminent physical harm or death may result and providing information without delay may avert it. The page does not establish a complete account of notice rules or legal thresholds across jurisdictions.

Do providers notify users before disclosure?
Notice is not guaranteed. OpenAI says it generally gives notice before disclosure unless legally prohibited. It describes exceptional cases where it may withhold notice, including emergencies where notice could create danger or situations where notice would be counterproductive, such as a compromised account. OpenAI says it may provide delayed notice once a legal restriction ends. Its law-enforcement policy sets out those qualifications.
Google likewise describes notice before disclosure subject to restrictions and exceptions, including legal prohibitions, account compromise and emergencies. Its government-request information explains that these practices depend on the circumstances and applicable law. The Anthropic material cited above does not provide enough detail to describe its notice practice comparably.

What OpenAI’s request figures do—and don’t—show
OpenAI’s government requests report for July–December 2025 distinguishes requests received from requests where data was disclosed, as well as accounts affected:

In the report, non-content requests include account details such as name, email, payment information and transaction history. Content requests seek material such as text or files input or output in connection with OpenAI services. These are OpenAI’s figures for that six-month interval, not totals for all chatbot companies or a measure of the chance that any particular user’s chat will be disclosed.

What privacy settings and account types change
History, activity and temporary-chat controls should be understood according to the specific service’s notice. Google’s Gemini notice, for example, says safety review can still occur when Keep Activity is off or temporary chats are used. That does not make a general claim about what every provider’s controls do.
Also check whether the account is personal or managed by a school or employer. Consumer, school, workplace and API accounts may be governed by different terms or customer arrangements. The official materials cited here do not establish one rule for every account type, provider or country.
- Read the privacy notice and law-enforcement policy for the exact product and region you use.
- Check whether the account is managed by an organization and what its terms say about access and oversight.
- Use activity and history settings with the scope the provider actually describes; do not treat them as a promise that no review or disclosure can occur.
- Avoid entering information you would not want handled under that service’s retention, safety and disclosure policies.
Do not assume that a VPN, deletion control, temporary chat or opt-out blocks compliance with a valid legal demand for data a provider still holds. The policies cited here do not make that guarantee.
How to read these policies for your situation
For a useful comparison, look for the answers to these questions in the provider’s current official materials:
- What process does it require for account details versus conversation content?
- Does it describe an emergency disclosure exception, and what threshold does it state?
- Does it promise notice before disclosure, and what legal or safety exceptions apply?
- What safety reviews can happen independently of a government request?
- Which service, entity, region and account type govern your use?
