Sometimes—but there is no nationwide rule that permits every kind of photo inside every polling place. State law and election guidance may treat a picture of your own ballot differently from a photo of another voter, a poll worker, voting equipment, or the polling-place interior. Check current state and local election-office guidance before taking a photo inside.

Can you take photos inside a polling place?

It depends on your state, what you plan to photograph, and sometimes local polling-place procedures. The main nationwide comparison available is about ballot selfies—pictures of a voter’s own ballot—not a blanket permission matrix for photographing polling-place interiors.

As the Institute for Constitutional Advocacy and Protection at Georgetown University Law Center put it in 2024: “Laws governing the use of recording devices inside the polls vary from state to state.” That variation means permission to photograph your own ballot does not automatically allow you to record other people or the room.

State-by-state rules for photographing your own ballot

The National Conference of State Legislatures (NCSL) summarized state ballot-selfie rules as of October 1, 2026. These classifications concern a picture of your own ballot; they do not establish whether you may photograph other voters, poll workers, equipment, or the polling-place interior. NCSL also cautions that some state laws do not directly address ballot images and that implementation can vary by county.

The categories are NCSL’s ballot-selfie classifications, not a count of states that broadly allow photography inside polling places. State law and official local procedures remain important.

Why a ballot selfie is different from a photo of the room

Your ballot and someone else’s ballot

Some states distinguish between voluntarily showing your own ballot and recording another voter’s ballot. For example, NCSL says Utah permits a voter to photograph their own ballot but not another person’s. A picture that captures a nearby voter’s selections can therefore raise a different issue from a picture limited to your own ballot.

A ballot photo and general interior photography

A state may allow a ballot selfie while restricting other photos in the polling place. NCSL’s Florida entry, for example, says voters may photograph their own ballot at the polling place, while other polling-place photography is not permitted. Do not read a ballot-selfie classification as permission to take a selfie with other voters, record poll workers, or film the voting area.

North Carolina law illustrates the distinction: it prohibits recording a voter within the voting enclosure without the required permissions and prohibits photographing a voted official ballot unless otherwise permitted by law. The rule concerns more than whether a voter may share a picture of their own choices.

In-person voting and absentee ballots

A restriction on recording devices in a polling room does not necessarily settle whether you may photograph an absentee ballot somewhere else. NCSL places Arizona, Maryland, Michigan, Tennessee, Texas, and West Virginia in a category where in-person ballot selfies are prohibited but treatment of absentee ballots is unclear. Check the rule for the specific setting rather than carrying a polling-place rule over to mail voting, or vice versa.

State law and county procedure

Even where state law does not expressly address recording devices, local procedures may matter. Pennsylvania’s Department of State said in its 2025 guidance that the Election Code does not address electronic-device use in polling places and recommended county rules designed to preserve order and unimpeded voting. The department also advises voters not to disclose other voters’ selections and says: “The Department recommends that voters wait until after they leave the polling place to post ballot selfies on social media.”

What to do before taking a photo

  1. Identify what the photo would show. A close-up of your own ballot, a picture that includes another voter’s ballot, and a photo of the room may be governed differently.
  2. Check your state election office’s current rules. Use its guidance for the relevant election and voting method; NCSL’s state-by-state list is a useful ballot-selfie overview, not a ruling on every kind of photography.
  3. Check county or polling-place instructions. Local procedures may address phone use and recording even when state law does not clearly settle the question.
  4. If the rule is unclear, ask before taking the photo. Georgetown ICAP advises voters and local officials to consult state election officials about whether and under what conditions recording devices are permitted at the polls.
