A TPO usually means you need written consent before specified work; the conservation-area route is a six-week notice process, not a TPO application. The exact order, map, location and proposed work determine what applies, so check with the local planning authority before acting.
What makes a tree legally protected in England?
There are two main routes. A local planning authority can make a TPO to protect selected trees, groups of trees or woodland in the interests of amenity. Separately, section 211 of the Town and Country Planning Act 1990 generally requires advance notice of certain work to a tree in a conservation area if that tree is not already covered by a TPO. The national framework is set out in Part VIII of the Act, as amended, and the Town and Country Planning (Tree Preservation) (England) Regulations 2012, which came into force on 6 April 2012. The government’s England guidance is Tree Preservation Orders and trees in conservation areas.
A TPO protects trees selected by the authority
A TPO is a local order, not a blanket rule for a particular species or size. It can apply to an individual tree, a group, an area or woodland, and it must identify what is covered with an associated map. Trees of any size or species may be protected. A woodland-classification order also protects regeneration and new planting within its designated area.
The authority decides whether a TPO is expedient in the interests of amenity. Public visibility is relevant but not enough by itself: the authority considers the tree’s characteristics and whether its removal would significantly harm the local environment and the public’s enjoyment of it. The government guidance says orders should protect selected trees and woodlands where removal would have a significant negative impact on the local environment and its enjoyment by the public.

Conservation-area protection is a separate notice process
If a tree is in a conservation area and already has a TPO, the ordinary TPO rules apply. If it has no TPO, section 211 generally requires the person proposing certain work to give the local planning authority six weeks’ notice. The authority can use that period to make a TPO if justified. If it does not, the proposed work may proceed after the notice period, subject to the guidance’s rules and any applicable exception.
A section 211 notice is not an application for consent. The authority cannot refuse the notice or attach conditions to it as though it were deciding a TPO application. Check the precise work and any exception with the authority rather than assuming all pruning or safety work is exempt.

What work needs permission or notice?
Work on a TPO-protected tree
Without written consent from the local planning authority, a person generally must not cut down, top, lop, uproot, wilfully damage or wilfully destroy a protected tree, unless an exception applies. Government guidance also states that, in the Secretary of State’s view, cutting roots is a prohibited activity for which consent is required.
The proposed work should be described precisely in a TPO application, with supporting information explaining why it is justified. The authority considers the effect on amenity and the reasons for the work; it may grant consent with conditions. Apply before starting work and follow any conditions attached to consent.

Work on a non-TPO tree in a conservation area
For work covered by section 211, notify the local planning authority at least six weeks beforehand. The notice gives the authority time to decide whether protection by TPO is justified. The six-week period is an advance-notice requirement, not a waiting period for a decision granting permission.
Exceptions and other rules
Exceptions can depend on the circumstances and the type of work. Owners, agents, contractors, statutory undertakers and other bodies should take care not to exceed an exception. If its scope is uncertain, seek advice from the local planning authority or a qualified arboriculturist. How to check whether a tree is protected
- Contact the local planning authority for the tree’s location. Ask whether the land is in a conservation area and whether a TPO applies.
- Ask for the relevant TPO and map. Compare the order’s description and map with the specific tree or area; do not assume a nearby order covers the tree in question.
- Set out the proposed work clearly. Say what you intend to do, including whether it involves cutting branches or roots, reducing the crown, felling or other work.
- Follow the correct route. For a TPO, check whether written consent is required and apply if it is. For a non-TPO tree in a conservation area, check whether a section 211 notice is required and allow six weeks before relevant work.
- Check exceptions and other constraints before work starts. Get confirmation or qualified arboricultural advice if the rules are unclear; consider protected species and any felling-licence requirement.
What happens after a TPO application or breach?
Decisions and appeals
The authority weighs the effect of the proposed work on amenity against the justification and supporting information. It may grant consent with conditions. If it refuses an application, an appeal can be made to the Secretary of State. The Planning Inspectorate’s Tree preservation order appeals: procedure guide sets out the appeal procedure for England.
Offences and replacement duties
Carrying out prohibited work on a protected tree can be an offence. A prosecution must establish, among other matters, that the tree was protected at the relevant time, that prohibited work took place, and that the defendant carried it out, caused it or permitted it. Ignorance of an order is generally not a defence.

A statutory duty to replace a tree may arise when a TPO-protected tree is removed, uprooted or destroyed in circumstances covered by section 206 of the Town and Country Planning Act 1990. The rules differ for woodland-classification orders, and the duty has exceptions. A replacement planted under the statutory duty is automatically protected by the original order. Whether a duty applies depends on the facts and the relevant statutory provision.
