A repeatable difference shows that the quote varies with a condition; by itself, it does not prove a retailer used your personal profile to set the price.
Set up a fair comparison
Before comparing prices, make sure you are looking at the same offer. A different variant, seller, delivery option, or checkout stage can change the total without any individual pricing. Record the item price separately from shipping, taxes, service fees, and discounts.
- Item: Match the product identifier, variant, and quantity.
- Seller and offer: Use the same seller and membership eligibility, and note whether the difference is a discount or coupon.
- Time and market: Compare as close together in time as possible, with the same location, currency, store, and availability. Prices and offers can change with time, location, channel, inventory, demand, or market conditions. FTC staff report and the OECD background note describe these as relevant market factors.
- Checkout: Compare at the same stage, since shipping, taxes, and fees may appear later.
Keep dated screenshots or notes showing the product, seller, displayed price, account state, location, and time. That record helps separate a real price difference from a changed offer or a checkout adjustment.
Test one condition at a time
- Open the exact product page in your usual signed-in session and record the offer and checkout details.
- Open the same product and seller in a separate clean browser session or another account. Keep location, device, timing, and other conditions as stable as possible.
- Repeat the comparison close together in time. If useful, test a different browser or device separately, changing only that one condition.
- Compare like with like: item price against item price, discount against discount, and fees against fees. Record search placement separately from the price.
A difference that repeats is a useful clue that the quote varies with the tested condition. It is not conclusive evidence of personalized pricing: inventory updates, promotions, market segmentation, random experiments, and other causes can also produce differences.

Distinguish price changes from search steering
A search page may reorder results or show different products without changing the price of the same item. Confirm the exact product and seller before drawing a conclusion. The FTC has described hypothetical cases in which customer signals could affect product rankings as well as prices, but a change in placement alone is not a price difference. FTC staff findings
What a comparison can—and cannot—show
The FTC’s January 2025 initial study findings say intermediaries can make consumer data available to retailers. Tracked behaviors may include location, demographics, mouse movements, and items abandoned in a cart. The agency’s examples were hypothetical and based on aggregated or anonymized material: they make data-informed pricing plausible, but do not establish that a particular retailer personalized your quote. The staff also reported that the intermediaries it examined worked with at least 250 clients selling goods or services, including groceries and apparel; that figure is about those intermediaries’ client relationships, not retailers proven to personalize prices. An OECD Secretariat background note from 2018 describes a study that tested 16 e-commerce websites using real and synthetic accounts and reported some form of personalization at 9 of the 16. The note discusses controls intended to reduce noise, including identical-account controls, and says discounts and coupons were not covered. This is a result from that study—not a current estimate for the entire web or evidence about any individual shopper’s price. OECD Secretariat background note
Even a carefully repeated comparison cannot identify a retailer’s pricing algorithm or establish intent. Treat it as evidence that offers differed under observed conditions, not as proof of why they differed.

Why private browsing or a VPN does not settle the question
Private browsing may remove locally saved browsing history when the session ends, but it does not prevent websites from seeing online activity. Sites and apps may use cookies, pixels, device fingerprinting, advertising identifiers, or cross-device tracking. Clearing cookies or using a private window changes some conditions; it does not make a comparison anonymous or conclusive. FTC guidance on dark patterns and tracking
A VPN or location change can also move you into a different market or alter shipping and availability, making the comparison less controlled. Review browser and account privacy settings, limit location access where it is not needed, and inspect cookie choices if you want to limit some tracking. Those controls do not prove whether a price was personalized. FTC guidance

Ask the retailer and preserve the evidence
If a difference persists, contact the retailer with the exact product, seller, timestamps, account state, and screenshots. Ask whether the offer is account-specific and what factors determine it. Keep the question focused on the offer you observed; a price discrepancy alone does not establish how it was generated.
U.S. policy status as of October 2026
On August 19, 2026, the FTC announced a draft enforcement policy statement on personalized pricing and sought public comment through September 18, 2026. The release says undisclosed use of personal data for personalized pricing could violate the FTC Act, but describes the statement as a draft open to comment—not a final rule or blanket ban.
