In your first week after a layoff, save your separation documents, file for unemployment through the official state program, confirm when health coverage ends, and note every deadline. Then review your retirement-plan options, check the separation agreement, contact public workforce services, and make a short-term cash-flow plan. This is general U.S. guidance: state rules, plan terms, and your separation documents can change your rights and deadlines.

First, record the dates and keep your paperwork

Create a secure folder for documents you are entitled to keep, and write down the dates that affect your next steps. Save your layoff or separation notice, severance offer, benefits notices, recent pay records, and retirement-plan contact information. Note the date your employment ends, the date health coverage ends, and any deadline to respond or sign.

Keep personal copies only. Do not take confidential employer, customer, or business information. If a notice or agreement gives you a deadline, put it on your calendar and keep a copy of the document showing it.

File for unemployment promptly

Unemployment insurance is administered by states, and eligibility and filing procedures vary. The U.S. Department of Labor advises: “You should contact your state’s unemployment insurance program as soon as possible after becoming unemployed.” Start at the Department of Labor’s unemployment insurance information and follow the link to the official program for the state where you worked. Provide complete, accurate information and respond to requests from the agency.

If you live in a different state from the one where you worked, or worked in more than one state, ask the agency where you live how to file. The Department of Labor says an initial benefit check generally takes two to three weeks after filing, but that is not a guarantee; processing time varies by claim and state.

Use an official state agency site reached directly, not a link in an unsolicited message. USAGov warns that someone else may use your information to file a claim. Contact your state agency using its official contact details if you receive an unexpected benefit notice, find that a claim was already filed in your name, or receive an unexpected 1099-G tax form. Decide how to bridge health coverage

Check your benefits notice for the exact date your job-based health coverage ends. Then compare the available paths before choosing: a Marketplace plan, COBRA if offered and you qualify, or an eligible spouse’s employer plan. Medicaid or CHIP may also be available if you qualify.

HealthCare.gov says losing job-based coverage generally gives you 60 days to enroll in a Marketplace plan; its guidance says coverage can start on the first day of the month after the old coverage ends. An eligible spouse’s employment-based plan generally has a 30-day request window for special enrollment, according to the Department of Labor. Confirm the applicable dates and instructions with the plan or agency, since your actual coverage end date and circumstances matter.

Compare more than the monthly premium. Check the deductible and likely out-of-pocket costs, whether your doctors are in network, prescription coverage, eligibility for income-based savings, and the replacement plan’s start date. HealthCare.gov explains Marketplace enrollment after loss of coverage at its special enrollment page; the Department of Labor describes special enrollment in employment-based plans at its benefits guidance.

What COBRA changes—and what it does not

COBRA can let eligible workers and family members continue the former group health plan temporarily, usually for up to 18 months after job loss. You will often pay the full premium, plus a small administrative fee, so compare the total cost with other eligible coverage rather than assuming COBRA is the cheapest option.

COBRA election can be retroactive. If you elect it later, you may owe premiums back to the date your prior coverage ended. Read the COBRA notice for the election deadline, cost, and coverage details. Do not cancel or decline one option until you have confirmed when replacement coverage starts. The Department of Labor’s COBRA continuation guidance explains the general rules.

Ask for retirement-plan documents before moving money

Contact the retirement-plan administrator and request the Summary Plan Description and an individual benefit statement. Use them to understand the options the plan actually permits, any fees, distribution rules, vesting questions, and the treatment of an outstanding plan loan. If you are considering a rollover, ask whether a future employer’s plan or an IRA is an allowed destination and what conditions apply.

There is no universally best destination established for every former employee. Plan terms govern what is available, so review the documents before deciding. The Department of Labor explains how to obtain and use these plan documents at What You Should Know About Your Retirement Plan.

Review the separation agreement and pay terms

Read the agreement and identify its response deadline, payment schedule, any benefits subsidy, release language, and property-return requirements. If a term is unclear or the agreement has significant consequences, seek qualified advice in the relevant state before signing.

Do not assume that every laid-off worker is entitled to severance or advance notice. Federal WARN rules apply to certain covered plant closings and mass layoffs, subject to coverage requirements and exceptions; the Department of Labor describes 60 calendar days’ advance notice for qualifying situations at its WARN Act page. It is not a universal individual severance entitlement. The Department of Labor says severance and vacation pay are generally governed by contract and state law, and sometimes ERISA. Because state rules vary, check your state labor agency for final-pay timing and unused-vacation rules rather than assuming a nationwide rule. See the Department of Labor’s severance-pay guidance.

Use public job-search and retraining support

Contact your state’s Rapid Response team or a nearby American Job Center. Depending on what is offered locally, public services can include job-search assistance, career counseling, resume preparation, interview workshops, training information, and benefits guidance. These services can be free. If your employer or state offers a Rapid Response session for affected workers, attend it. Find local help through CareerOneStop’s American Job Center directory or ask your state workforce agency about Rapid Response services.

Make a short cash-flow plan

List the money and bills that matter over the next several weeks, with the dates each is expected or due. Include:

  • Final wages and any severance payment schedule
  • Unemployment claim status and any agency requests
  • Essential bills and minimum payments
  • Health-insurance premiums and coverage start dates
  • Deadlines for benefit elections, agreement responses, or property returns

Final-pay timing, vacation payout, and severance entitlements are not uniform across the country. Check the written employment terms and your state labor agency for the rules that apply to you.
