Medibank reported that its October 2022 data breach affected about 9.7 million current and former customers, authorised representatives and international customers across Medibank and ahm. Information exposed varied by person and could include contact and identity details, some health claims data, and—in particular groups—Medicare or passport numbers. The Office of the Australian Information Commissioner (OAIC) later filed civil penalty proceedings alleging privacy-law failures; the cited official updates do not establish a final court judgment.

What happened in the Medibank data breach?

Medibank’s 1 December 2022 update said unauthorised access had affected approximately 9.7 million people. The company’s figures were estimates, not independently recalculated counts:

The estimate included current and former customers and some authorised representatives. The OAIC describes the affected records as belonging to current, former and prospective Medibank customers, including people associated with ahm and international customers. The OAIC also says some personal information was published on the dark web.

What information was exposed?

The Australian Cyber Security Centre (ACSC) listed the following types of information in its incident guidance, last updated 1 December 2022. The list does not mean every field applied to every affected person:

  • Passport numbers for some international students; the ACSC said passport expiry dates were not exposed.
  • Some health claims data.

Because the affected records differed across customer groups and individuals, the published categories do not by themselves confirm which fields, if any, were exposed for a particular person.

What is the legal status of the breach?

On 5 June 2024, the OAIC announced that the Australian Information Commissioner had filed civil penalty proceedings against Medibank in the Federal Court. The Commissioner alleged that, between March 2021 and October 2022, Medibank seriously interfered with the privacy of 9.7 million Australians by failing to take reasonable steps to protect personal information. These are allegations, not a finding that the court has made.

The OAIC said the proceedings concern Australian Privacy Principle 11.1, which requires reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. At the penalty rate applicable to the alleged period, the OAIC said the court could impose up to $2,220,000 per contravention. That was a possible maximum, not an imposed penalty; whether any penalty would be ordered and its amount were for the court to decide.

An OAIC disclosure-log brief current at 25 November 2024 said the OAIC had amended its statement of claim and Medibank was required to provide its defence by 13 December 2024. The OAIC’s September 2024 breach report said the case was before the Federal Court and subject to case management. Those updates do not establish the case’s disposition as of 4 October 2026, so they should not be read as confirmation that it remains pending or has concluded.

OAIC representative complaint and the separate class action

The OAIC’s representative-complaint notice says that its complaint process is separate from the Federal Court class action. Potential class-member status depends on whether a person’s personal information was exposed. The OAIC notice explains options for remaining in or withdrawing from its representative complaint. Check the current OAIC representative-complaint notice and its linked legal resources for current details; legal options can have consequences, so seek independent legal advice for advice about your circumstances.

What should affected customers do?

The ACSC recommends practical security steps for people concerned about the incident. Its guidance is general: it does not determine whether a specific person’s details were exposed.

  1. Watch accounts and devices. Look for unusual activity, unexpected messages or other signs of misuse. Report suspicious activity to the relevant agency, your bank and IDCARE, as appropriate.
  2. Treat breach-themed messages cautiously. Scammers may refer to Medibank to make messages seem credible. Do not use links or phone numbers in an unexpected message; verify them through an official website or a number you already trust.
  3. Strengthen account access. Update devices, enable multi-factor authentication (MFA) where available, and use regular backups. Limit account access to what each person needs.
  4. Contact your insurer if you need incident-specific help. The OAIC’s advice dated 25 October 2022 told potentially affected Medibank and ahm customers to contact their insurer. That page is historical, so check the insurer’s current contact details and service availability.
  5. Contact your bank and IDCARE if you are concerned about identity compromise. The OAIC’s October 2022 advice names both. Confirm current contact details directly, because the advice page is dated.

The ACSC said people who believe their Medicare card was exposed can replace it at no cost through myGov. This guidance is specifically about Medicare cards; it is not a general replacement process for passports or other identity documents. Should you use a security key?

A FIDO2-compatible hardware security key is one possible way to use MFA on services that support it. It is optional: ACSC guidance recommends MFA generally, not a particular device or brand. A key can help protect supported accounts from unauthorised sign-ins, but it cannot retract information already exposed or prevent every form of identity misuse.
