Section 107 is the first appeal against an adjudicating authority’s GST order; GSTAT is the later tribunal tier under section 112. A taxpayer’s GSTAT appeal and a department-initiated GSTAT application are different routes: the taxpayer appeals as an aggrieved person, while the department’s route begins with the Commissioner’s review and direction to a subordinate officer. The ordinary periods identified in official materials are three months for an aggrieved person and six months for the department’s application, but notifications can affect which deadline applies. The notified backlog date of 31 July 2026 has passed as of 4 October 2026.
What is the difference between a GST appeal and a GSTAT appeal?
“GST appeal” can refer to more than one stage. Under the CGST framework, section 107 provides the first appeal to the prescribed Appellate Authority against an adjudicating authority’s decision or order. Section 112 provides the later appeal to the Goods and Services Tax Appellate Tribunal (GSTAT) for qualifying orders of an Appellate or Revisional Authority.
So a GSTAT appeal is not simply another name for the first appeal. Nor is a department-initiated GSTAT filing the same as a taxpayer’s appeal: section 112(3) provides a separate route for the department after review by the Commissioner.

The prescribed first Appellate Authority depends on the rank of the officer who made the original decision. A CBIC circular explains that authority assignment; it is not necessarily the same forum for every order.

How the taxpayer appeal process works
1. Appeal an adjudicating authority’s order under section 107
If you are aggrieved by an adjudicating authority’s decision or order, the first appeal is generally to the prescribed Appellate Authority under section 107. The baseline period described in a CBIC circular is three months from communication of the decision or order. Confirm the competent authority by checking the original officer’s rank and the applicable instructions.
2. Appeal a qualifying appellate or revisional order to GSTAT
Section 112 is the Tribunal stage for qualifying orders made under section 107 or section 108. A taxpayer’s appeal is made as an aggrieved person. The statutory material identifies three months from communication as the ordinary baseline, but it also discusses amendments and notified start dates. Do not treat that baseline as a deadline calculation for an individual order without checking whether a transitional measure applies.

How the GST department initiates a GSTAT case
For the department’s section 112(3) route, the Commissioner may call for and examine the record of an Appellate or Revisional Authority order. If the Commissioner directs a subordinate officer to apply to GSTAT, that officer makes the application on the department’s behalf. This is a departmental review-and-direction process, not a taxpayer filing under another label.
The baseline period shown in the statutory extract for that application is six months from the date the relevant order is passed. Because amendments and notifications may affect the operative position, verify the current enacted text and any applicable notification before relying on that period.

What was the GSTAT backlog deadline?
The Ministry of Finance and the official GSTAT portal reported an extension of the due date for the specified backlog cohort of section 112(1) appeals read with section 112(3) applications to 31 July 2026. That date has passed as of 4 October 2026; it is not an open future deadline. The date does not by itself establish whether a particular order was within the notified cohort or whether later relief applies.
For a live matter, check the order’s communication date, whether it falls within the notified cohort, the operative Gazette notification, and any subsequent order or relief. The Council’s agenda materials discuss legislative recommendations and timing; recommendations should not be treated as operative law unless enacted.

Where and how do you file?
The official GSTAT portal provides electronic filing and lists the GSTAT Procedure Rules, 2025. An older rules copy located in official materials identifies Form GST APL-05 for a Tribunal appeal and APL-06 for cross-objections; another rules extract identifies APL-01 for a first appeal to the Appellate Authority. Because the older rules copy may not reflect current requirements, use the current portal instructions and applicable rules to confirm the right form, fee, documents, certified-copy requirements, and any bench-specific directions.
- Identify the order and appeal tier. Check whether the order came from an adjudicating authority or a qualifying Appellate or Revisional Authority, and identify whether you are filing as an aggrieved person or under a Commissioner’s direction.
- Check the operative deadline. Record when the order was passed and communicated, then check for amendments, notifications, and any transitional-cohort provisions that apply to that order.
- Use the current official filing instructions. For GSTAT matters, consult the Tribunal portal’s current electronic-filing instructions and Procedure Rules, 2025. For a section 107 appeal, confirm the prescribed Appellate Authority and its current filing requirements.
- Verify the complete filing package before submission. Confirm the applicable form, supporting order and records, certified-copy rules, fee, and any procedural directions under the current rules. The available older rules text is not enough on its own to establish a current checklist.
What should you verify before acting?
- The exact provision and appeal tier applicable to the order.
- The competent Appellate Authority or GSTAT route, and who is legally initiating the filing.
- The communication date, order date, and any notification that changes the ordinary limitation calculation.
- The current form, portal procedure, fee, document requirements, and any subsequent extension or relief.
