For an appealable GST adjudication order, the statutory appeal under section 107 is usually the ordinary route. A writ petition under Article 226 may still be available, but a procedural complaint does not automatically justify bypassing the appeal: the alleged defect must fit a recognized exception—such as a substantiated denial of natural justice—and be supported by the record.
When should you appeal a GST order?
If the order is appealable and was passed by a GST adjudicating authority, section 107 is generally the first remedy to consider. Section 107(1), as reproduced by the Gauhati High Court, allows an aggrieved person to appeal to the Appellate Authority within three months from the date the decision or order is communicated. The appeal route is especially suited to disputes that require examination of the tax assessment, evidence, or factual findings. In Assistant Commissioner of State Tax v. Commercial Steel Limited, the Supreme Court’s holding, reproduced by the Delhi High Court, treated factual assessment as a matter for the statutory appellate authority where the stated exceptions to the alternative-remedy rule were not established. Do not calculate a live deadline from the general three-month rule alone. Confirm which GST enactment governs the order, the order and communication dates, the manner of communication, any applicable amendments, and the rules for computing time.

When can a writ petition be considered?
Article 226 jurisdiction is not extinguished merely because a statutory appeal exists. However, the High Court ordinarily uses its discretion against entertaining a writ petition when an effective alternative remedy is available. The Supreme Court’s formulation in Commercial Steel, reproduced in a 2025 Delhi High Court judgment, states: “The existence of an alternate remedy is not an absolute bar to the maintainability of a writ petition under Article 226 of the Constitution.” Delhi High Court judgment, paras 62 and reproduced passage.
The same holding says a writ may be entertained in exceptional circumstances. It identifies these categories:

- A breach of fundamental rights.
- A violation of natural justice.
- An order made in excess of jurisdiction.
- A challenge to the vires of a statute or delegated legislation.
These are grounds for asking the court to exercise its writ jurisdiction; they do not by themselves establish that the tax order is wrong or guarantee that the court will intervene. Alternative-remedy discussion; Commercial Steel exceptions as reproduced by the Delhi High Court.
Why a procedural allegation may not be enough
The important question is not simply whether a taxpayer can describe a step as defective. It is whether the procedural record shows a defect that denied a fair opportunity or otherwise falls within a recognized exception. Notice, hearing, access-to-material, and portal complaints can depend on what was communicated, what the taxpayer requested or submitted, and what the authority did.

In GNRC Limited, the Gauhati High Court noted that the taxpayers had received show-cause notices and sought time. Their claims about portal deficiencies and filing documents involved disputed facts that required examination. On that record, the court declined writ intervention and pointed to the section 107 appeal. The decision illustrates that a portal or document-filing allegation is not automatically enough to secure writ relief. GNRC Limited (Gauhati High Court, 2024).
For a natural-justice argument, the relevant material may include the notices and their service details, hearing opportunities and requests for adjournment, submissions or upload records, the order’s account of the proceedings, and any evidence showing how the claimed defect affected the opportunity to answer. A disputed factual account may be better examined through the statutory appeal.

A practical way to choose
- Identify the order and governing law. Check whether the order is appealable, which authority issued it, and whether the CGST Act, a state GST enactment, or another applicable provision governs.
- Establish the communication date and deadline. Record when and how the order was communicated, then verify the current limitation rules and any amendments that apply to that order.
- Describe the defect precisely. Separate a claim that the authority reached the wrong conclusion from a claim that the process denied a meaningful opportunity, exceeded jurisdiction, or raises another recognized writ exception.
- Match the claim to the record. Gather the notice, proof of service, hearing history, requests, submissions, portal or filing evidence, and the order’s reasoning. Identify what evidence supports the allegation and whether material facts are disputed.
- Choose the route with the right function. Use the statutory appeal as the ordinary route for an appealable order and factual or merits review. Consider a writ only where the available record supports an exceptional basis for the High Court to intervene.
The appropriate remedy can turn on the order type, governing statute, dates, appeal status, and procedural record. The cited decisions establish a general framework, not a universal answer for every GST procedural dispute.
