A ballot measure can win more yes votes than no votes among people who answered the question and still fail a separate legal requirement, such as a supermajority threshold or a minimum participation test.
What “majority” counts—and why that can be misleading
A simple majority usually means more than half of the votes cast on the measure are “yes.” That is different from more than half of all ballots cast in the election. Some laws test only the yes and no votes on the question; others also require a specified share of the election’s total votes to be cast on that question, or require a higher percentage of yes votes.
So an unmarked response is not automatically counted as a “no.” But blank responses can matter where the law sets a participation condition based on all votes cast in the election.
How a measure can get more yes votes and still fail
A supermajority requirement
A law may require 55%, 60%, two-thirds, or another share of affirmative votes rather than a simple majority. For example, a hypothetical measure with 54% yes and 46% no has a majority, but it would not meet a 55% passage threshold.

California’s Secretary of State says statewide measures can pass by a majority, while certain local measures require 55% or two-thirds approval. The threshold therefore depends on the measure and its jurisdiction, not simply on whether yes outnumbers no. See the state’s Ballot Measures guidance.
A minimum-participation requirement
A separate rule can require a minimum number of votes on the question relative to all votes cast in the election. Under Article II, Section 1(d) of the Washington State Constitution, a measure initiated or referred under the described process takes effect if it receives a majority of votes cast on the measure, provided that votes on the question equal at least one-third of the total votes cast at the election.

That means a measure could have more yes than no votes among the people who answered it and still fail the one-third condition if too many voters leave the question blank. The rule concerns participation on that measure; it does not turn every non-voter or blank response into a no vote.
Rules tied to the measure type
Local bonds, levies, school measures, and statewide initiatives may be subject to different tests—even within the same state. For example, Snohomish County, Washington, says most non-school levies need at least 60% yes and a minimum yes-vote total tied to prior general-election turnout. Its guidance describes different rules for school levies and bonds. These are county-specific explanations, not nationwide rules or universal rules for every Washington measure. For its non-school levy example, the county uses 10,000 participants in the prior general election: 40% is 4,000, and 60% of that figure is a minimum of 2,400 yes votes. Those figures illustrate the county’s stated calculation; they are not general election statistics or a rule to apply elsewhere.
Competing measures and other special provisions
Some jurisdictions also specify what happens if voters approve competing or conflicting proposals. Washington’s constitution provides a two-question process for conflicting measures and requires a majority on the comparison question for one measure to become law. That is a Washington-specific rule, not a general rule for U.S. ballot measures.

How to check the rule for a specific ballot measure
- Read the official ballot language. Look for the stated percentage required for passage and any wording about turnout, participation, validation, or minimum yes votes. Ohio law, effective January 1, 2026, requires ballot issue text to state the percentage of affirmative votes necessary for passage; see Ohio Revised Code Section 3505.06.
- Identify the measure’s category and jurisdiction. Determine whether it is statewide or local and whether it is a bond, levy, school measure, initiative, referendum, or another type. Different categories can have different legal tests.
- Check the state constitution and statutes. Find the provision that applies to that category, including both the approval threshold and any separate participation or minimum-vote condition.
- Use the local election authority’s guidance for local measures. County or municipal explanations can clarify how a state rule applies locally, but do not assume a nearby jurisdiction uses the same formula.
The National Conference of State Legislatures reports that initiatives in Illinois, Mississippi, Nebraska, and Wyoming have participation requirements in addition to a simple majority.
