Oracle is listed as the owner of the U.S. JAVASCRIPT trademark registration at issue, but that does not mean Oracle owns or controls the JavaScript programming language. Deno Land Inc. has asked the U.S. Trademark Trial and Appeal Board (TTAB) to cancel the registration. As of October 4, 2026, the case is suspended—not decided—with a conditional resumption date of October 28, 2026.

What trademark is being challenged?

The case concerns Oracle America, Inc.’s U.S. Registration No. 2416017 for JAVASCRIPT in standard characters. The TTAB record says the registration dates to December 26, 2000, and was renewed in 2010 and 2019. It covers specified computer programs and related services, including utility programs, language processors, and interpreters in International Classes 9 and 42; it is not a registration for ownership of the programming language itself. The TTAB record identifies the registration and its history.

Trademark registration concerns a mark used in connection with listed goods or services. The legal dispute is whether Oracle’s registration should remain in force, not whether developers may use JavaScript as a programming language.

Why is Deno challenging Oracle’s JavaScript trademark?

Deno Land filed a cancellation petition on November 22, 2024. Its petition asserts three grounds. These are Deno’s allegations, not findings by the Board. Deno’s petition sets out the claims.

Issue Deno’s position Procedural status
Genericness Deno argues that “JavaScript” is the generic name of a programming language rather than a term that identifies a particular commercial source. The claim remains unresolved in the available TTAB orders.
Abandonment Deno argues that Oracle has not made qualifying use sufficient to maintain the registration. The claim remains unresolved in the available TTAB orders.
Fraud Deno alleged that Oracle’s 2019 maintenance filing was fraudulent, pointing to its use of a Node.js screenshot. The TTAB dismissed this claim on June 18, 2025; it is not a pending claim. The Board’s order addressed the dismissal.

Oracle’s August 6, 2025 answer admits that millions of developers use the JavaScript language and that TC39, part of Ecma International, maintains the ECMA-262 specification. Oracle denied Deno’s broader characterization of public or industry consensus and denied other allegations. Those admissions and denials are the parties’ positions in the case, not a Board decision on genericness or abandonment. Oracle’s answer records its response.

What has the TTAB decided?

The Board dismissed Deno’s fraud claim on June 18, 2025. That ruling did not determine whether the mark is generic or whether Oracle abandoned it. Deno founder Ryan Dahl later wrote, “But fraud was never the heart of this case.” That was Dahl’s description of Deno’s strategy, not the Board’s conclusion. The latest key docket action as of October 4, 2026 is an August 28 order granting Oracle’s motion for a 60-day suspension. The order states: “MOTION TO SUSPEND GRANTED.” It says the proceeding will resume October 28, 2026 if neither party reports further action. A suspension does not establish that the parties settled, and the registration has not been shown as canceled in the cited docket. The suspension order states the condition and date; the official live docket lists the case status.

What role did the community campaign play?

Deno and Ryan Dahl used the #FreeJavaScript campaign to urge Oracle to release the mark and later pursued cancellation. Deno said in a November 2024 post that more than 14,000 developers had signed its open letter by then. In a September 18, 2025 fundraising post, Deno reported more than 27,000 signatures and a $200,000 fundraising goal for public surveys, expert testimony, records and depositions, and legal filings. These are dated figures reported by Deno, not independently audited measures of industry opinion or proof of genericness. What happens next?

Under the August 28, 2026 order, the case is set to resume on October 28 if the parties do not report further action. The docket could change if they file something before then; the suspension itself does not say that a settlement has occurred. The live TTAB docket is the place to check for subsequent filings and the case’s current status.
