These steps reduce exposure and help a team understand what it can responsibly claim; none guarantees confidentiality, copyright ownership, or freedom from infringement risk. The legal guidance discussed here is U.S.-focused.
What does “protecting” game art and code mean?
There are several different rights and risks to manage. They should not be collapsed into the question of who owns an AI-generated result:
- Existing work: Your studio’s human-created art and code may already have copyright protection, while licensed or publisher-supplied material may be governed by someone else’s rights or by contract.
- New work: Whether a particular AI-assisted image, asset, or code contribution is protectable depends on the human-authored expression in it and the circumstances of its creation.
- Confidentiality and handling: Uploading an asset can raise separate questions about service terms, studio policy, trade secrets, contractual duties, and personal data. Copyright guidance alone does not answer those questions.
- Release risk: An output can be problematic even if the team’s own contribution is protectable—for example, if it resembles existing material or a code suggestion carries an unsuitable license obligation.
A practical protection-in-depth approach handles each question separately: control inputs, approve the service, preserve creation records, inspect outputs, and escalate uncertain rights issues.
Can a game use AI-generated art or code and still be copyrighted?
In its January 29, 2025 announcement of Part 2 of its AI report, the U.S. Copyright Office said that using AI in a creative process—or including AI-generated material in a larger human-created work—does not by itself prevent the larger work from being copyrightable. The Office said copyright in AI output depends on a human author determining sufficient expressive elements. Its examples include human-authored work perceptible in the output and creative human arrangements or modifications. Merely supplying prompts, the Office said, is not enough to establish copyright in the generated expression.

That distinction matters to a game team. A prompt, an AI subscription, or possession of a generated file does not by itself establish copyright ownership of the output. Keep separate records for the original work, the generated material, and the human contributions—such as authored elements, edits, selection, and arrangement. The Office’s announcement describes general guidance, not a ruling on any particular game asset or a guarantee that a registration will be granted. Registering or claiming rights in a specific work may require advice tailored to the facts.
The Office’s AI initiative page records that Part 3, “Generative AI Training,” was released in pre-publication form on May 9, 2025, with a final version then listed as forthcoming. That training question is distinct from whether a studio owns or can protect a particular output. The cited status does not settle the legality of every use of copyrighted works to train models; check the Office’s current materials and get legal advice when that issue affects a project.
Is it safe to upload proprietary art or code to an AI tool?
There is no universal answer based on the sources discussed here. The U.S. materials do not establish how any named commercial service handles submitted prompts, files, or code. A service’s terms and controls can differ by product, account tier, contract, and date, so do not assume that an upload is private, deleted, excluded from training, or covered by an indemnity.

Before using an external service, check the terms for the exact product and account, including how it treats prompts and files, retention, model training, sharing, access controls, deletion, and any enterprise contract. Confirm that the studio has approved the service and that the person submitting the material has authority to do so. If terms are unclear, treat the material as not approved for upload until the appropriate studio decision-maker resolves the issue.
The U.S. Department of State provides an example of a strict internal approach: its 20 FAM 302.2 provision, dated February 20, 2025, tells Department personnel not to input content protected by copyright or other intellectual-property rights into AI services for official use without permission. The provision also notes that both inputs and outputs can raise IP concerns depending on the circumstances. This is Department policy, not a rule that directly governs private game studios; it illustrates why teams need explicit handling rules rather than relying on an individual employee’s judgment.
Classify material before choosing a tool
The following is a practical studio control, not a universal legal classification scheme. A team can adapt it to its contracts and risk tolerance:

How should a team protect source code when using AI?
Use AI assistance only within a workflow the studio has approved. Before sharing code, remove secrets such as passwords, API keys, signing credentials, and private endpoints; use the smallest relevant excerpt rather than a repository or build containing unrelated proprietary material. Redaction reduces unnecessary exposure but does not make a submission confidential or resolve the service’s terms. If the task requires sensitive code, use only a service and configuration whose handling has been reviewed for that purpose, or keep the work inside an approved environment.
Review code suggestions as code, not as trusted answers. Developers should inspect for security defects, copied or suspiciously familiar passages, dependencies, license notices, and obligations introduced by suggested libraries or snippets. Run the project’s normal tests and security review before integration. The sources discussed here establish no technical similarity threshold or specific product that can certify an output as safe, so a clean automated scan should not be treated as proof of provenance or rights clearance.

Do not mistake narrow software exemptions for permission to upload code
The U.S. Copyright Office’s 37 CFR § 201.40 regulation describes a limited exemption for specified good-faith security research involving computer programs. Among its conditions are lawful acquisition or authorized access, testing or correcting vulnerabilities in an environment designed to avoid harm, and using the information primarily to promote security. The regulation warns that the exemption is not a defense to liability under other applicable laws.

The same regulation includes narrow provisions for certain lawfully acquired complete video games when server support has ended, including limited personal local play or eligible cultural-institution preservation under detailed conditions. These are circumvention exemptions, not general permission to copy or disclose a third party’s code to an AI service. Check the regulation’s conditions and seek legal advice before relying on an exemption.

Keep enough project records to distinguish human-authored expression from AI-generated material and to explain how the final work was assembled. The U.S. Copyright Office’s January 2025 guidance identifies human-authored material and creative human arrangement or modification as relevant to copyrightability.
- Preserve original source files and version history for art, writing, and code.
- Record substantial human edits, selections, arrangements, or other creative decisions, with the responsible contributor and date where practical.
- Retain prompts or generation records when appropriate under studio policy, while avoiding unnecessary sensitive content in the records themselves.
- Track the service, product tier, relevant settings, and terms reviewed for the workflow, since these can change.
- Keep approvals and rights-holder permissions for material submitted to a service.
- Document output review, including any concerns found and how they were resolved.
Records help the team explain its process and assess what it can claim; they do not guarantee copyright registration, prove that an output is non-infringing, or override a contract.

How should a team review AI output before release?
- Trace the input. Confirm the source and permission status of each prompt, reference image, code excerpt, or other submitted file.
- Inspect the result against known material. Compare art and other expressive assets with existing game content and licensed references; investigate close similarities or uncertain provenance rather than assuming the output is original.
- Review code and dependencies. Have a developer examine suggestions for security, correctness, copied material, third-party components, and license obligations before merging.
- Record human changes. Preserve meaningful edits and creative choices made during selection, adaptation, or integration.
- Escalate unresolved concerns. Pause use or release where rights, contract terms, provenance, a person’s likeness, or confidentiality remain uncertain.
The official materials discussed here do not specify a similarity-checking product or a numeric threshold for acceptable resemblance. A tool result should not substitute for human review where the stakes are material.
When should the studio seek permission or legal advice?
Escalate before submission or release when an asset or code is under an NDA, licensed from a third party, supplied under a publisher or platform agreement, or otherwise subject to restrictions. Do the same if material may include a person’s likeness, if the service’s handling terms are unclear, or if a similar output raises a provenance concern. The Copyright Office’s AI initiative addresses distinct topics, including copyrightability, training, and digital replicas; one answer does not resolve all of them.
This article addresses U.S. federal copyright guidance and one federal agency’s internal policy example. It does not determine trade-secret safeguards, international copyright rules, the terms of a particular vendor or publishing contract, privacy requirements, or the result of a specific dispute. The governing jurisdiction and current agreements can change the answer. Consult qualified counsel for project-specific decisions involving significant rights or exposure.
