In the United States, a data center may need a state or local air permit before building or modifying backup generators, and may also need a Title V operating permit once the facility is operating. Which approvals apply depends on the site, its total emissions, the generators’ design and status, and how they will be used. Federal engine-emission rules can apply separately, even when a particular air permit is not required.

There is no single nationwide permit checklist. The first step is to identify the air-permitting authority for the project location and give it a complete inventory of the planned engines or turbines and their uses.

Which air permits might a data center need?

Most U.S. data-center air permits are issued by state or local air agencies under Clean Air Act programs approved to meet federal minimum requirements. Depending on the location, an EPA regional office or a tribal authority may also have a role. The U.S. Environmental Protection Agency’s Clean Air Act Resources for Data Centers, last updated September 28, 2026, describes this division of responsibility; the agency covering the project site can confirm the correct application process and thresholds.

New Source Review: approval before construction or a qualifying change

New Source Review (NSR) is a preconstruction permitting program. A new stationary source or a modification may need NSR approval if it meets the applicable criteria. Whether it does depends on the project’s emissions, source status, and jurisdiction-specific requirements. Determine applicability before beginning construction or a covered modification; do not assume that a generator’s “backup” label exempts it.

Title V: an operating permit for qualifying sources

Title V is an operating-permit program for major stationary sources and certain minor sources. It gathers applicable Clean Air Act requirements into an operating permit and supports compliance oversight. A data center does not need Title V simply because it is a data center or has generators: applicability depends on the source and the relevant thresholds.

Engine rules are a separate layer

NSR and Title V are permitting programs. Federal standards for stationary engines are a different layer of requirements, and can apply whether or not the project triggers either permit program. EPA’s Understanding the Stationary Engines Rules (updated June 22, 2026) identifies the major rule families for reciprocating internal combustion engines (RICE):

  • RICE NESHAP, 40 CFR part 63, subpart ZZZZ: controls hazardous air pollutants from stationary reciprocating engines.
  • Compression-ignition NSPS, 40 CFR part 60, subpart IIII: can apply to stationary compression-ignition engines, including diesel engines.
  • Spark-ignition NSPS, 40 CFR part 60, subpart JJJJ: can apply to stationary spark-ignition engines, including many natural-gas-fired engines.

Which requirements apply varies with factors such as whether an engine is new or existing, its fuel and subtype, rating, source classification, and emergency status. EPA’s Compliance Requirements for Stationary Engines gives category-specific summaries. A project should classify each unit against the applicable rules rather than assume one rule covers every generator.

Stationary combustion turbines have distinct NSPS and NESHAP requirements. A facility using turbines should assess those standards rather than treating the equipment as RICE.

How to classify the generators

Before estimating permit applicability, document each unit individually. The same facility can have equipment that falls into different regulatory categories. At a minimum, resolve these questions:

  • Is the unit stationary or nonroad, and is it an engine or a combustion turbine?
  • Is it new, existing, modified, or relocated?
  • What are its fuel, ignition type, engine subtype, power rating, model year, and source classification?
  • Is it designated emergency, limited-use, or non-emergency, and what activities will it actually perform?

These classifications inform both the applicable federal engine standards and the permitting authority’s review. A portable unit’s status should not be inferred from its location or how the owner describes it; provide the agency with the equipment details and ask how the rules apply.

How generator operating hours affect the analysis

Operating hours matter, but different figures serve different purposes. An emissions estimate, a rule’s maintenance-and-testing provision, and permission to generate electricity are not interchangeable.

Potential to emit: the 500-hour assumption is not permission to run

EPA’s September 28, 2026 data-center resource says 500 hours is an appropriate default assumption for estimating worst-case annual operation when calculating potential to emit (PTE) for emergency generators. An owner or permitting authority may justify a different estimate case by case, for example using local outage history. PTE is an emissions-estimation concept: using 500 hours in that calculation does not grant a generator 500 hours of operating time.

Maintenance and testing

Federal emergency-engine standards provide defined maintenance-and-testing allowances, but the applicable requirements vary by rule and engine category. Check the specific standard and any permit conditions for each unit; do not apply one generalized limit to the entire generator fleet. EPA’s compliance summaries identify category-specific requirements and call for an hour meter and records of operating hours for emergency engines.

Non-emergency grid reliability

In a May 1, 2025 clarification, EPA said certain emergency engines may operate for up to 50 hours per year in specified non-emergency circumstances to prevent local power interruption, when the applicable regulatory criteria are met. The clarification addresses qualifying financial arrangements. It is not general authorization for routine energy-market dispatch or unrestricted data-center generation. Confirm the rule and arrangement for the particular engine before planning this operation; EPA’s April 17, 2025 fact sheet and FAQ explain the underlying provisions.

Federal emergency orders described for 2026

EPA’s data-center page also addresses Department of Energy emergency orders issued in spring and summer 2026 under section 202(c) of the Federal Power Act. EPA considers operation under the identified orders an emergency situation for stationary emergency engines covered by the specified RICE NESHAP and compression-ignition and spark-ignition NSPS provisions. The page says those hours do not count toward the specified 50-hour non-emergency allowance. This interpretation is tied to those orders and covered provisions, so check the current order and EPA guidance before relying on it for operations.

What information to give the permitting authority

Prepare a facility-wide inventory and operating description, not just a list of generator counts. The agency’s application instructions control, but having the following information ready makes the applicability discussion more useful:

  • Site and schedule: street address, county, state, any relevant tribal jurisdiction, and planned construction and operating dates.
  • Equipment inventory: each engine or turbine’s manufacturer, model, fuel, rated horsepower or capacity, serial number, model year, stationary or portable status, and certified emissions family where available.
  • Regulatory status and uses: whether each unit is new, existing, modified, or relocated; its proposed emergency, limited-use, or non-emergency designation; and each intended use.
  • Hours by purpose: maximum annual hours planned for outage response, maintenance and testing, demand response, grid reliability, commissioning, and other operation.
  • Emissions and limits: estimated emissions by pollutant for each unit and the full source, assumptions used in the estimates, and any proposed enforceable operating limits.
  • Compliance approach: proposed controls, exhaust and stack configuration, monitoring, hour tracking, recordkeeping, and reporting.
  • Other site sources and approvals: existing permits and other emissions sources that may matter to source-wide applicability or aggregation.

Ask the agency to confirm which preconstruction and operating permit processes apply, how it wants emissions and operating scenarios presented, and which federal engine requirements must be addressed. The answer is site-specific: no project address, equipment specifications, emissions inventory, or operating plan is available here to determine an individual facility’s thresholds, permit conditions, or forms.

Compare backup-power plans before fixing the permit strategy

Design and operating choices can change which requirements deserve attention. Use these distinctions to frame the discussion with the permitting authority; they do not replace a site-specific applicability determination.
