There is no single process used by every state to investigate an execution problem. Depending on the jurisdiction and incident, an operating agency may conduct an internal review, a governor may commission an outside investigation, and courts may examine related claims. What the public can learn also depends on witness access, secrecy rules, court records, and whether officials release an investigation’s findings.
Who investigates an execution problem?
The investigator and the operating agency are not always the same. An incident may be addressed through one or more of these channels; the available evidence does not establish a uniform state-by-state procedure.

These channels are not interchangeable. A court case may address specific legal claims rather than provide a comprehensive operational investigation, while an administrative report may assess protocol compliance without resolving every disputed fact.
How can the public follow an investigation?
A reliable account is built from a timeline and clearly attributed evidence, rather than a single summary of what happened. For a particular case, follow the sequence below and distinguish what is observed, alleged, officially asserted, and found by an investigator.

- Establish the timeline. Record the scheduled execution, any pause or interruption, statements from officials and witnesses, related court filings, actions by the governor, and the dates an inquiry was ordered and reported.
- Identify the inquiry. Name who directed it and who carried it out. Note whether the reviewer was independent of the operating agency, what period and issues the assignment covered, and whether the reviewer had access to staff and records.
- Compare conduct with the right protocol. Use the protocol version in force at the time of the incident, not a later revision. State whether the report identified departures from that version and whether it assigned corrective actions.
- Check what became public. Look for the report itself, any redactions, official releases, court filings, witness accounts, and reporting that identifies its sources. An announcement that a review was ordered is not a report of its findings.
- Keep unresolved issues visible. Attribute disputed accounts to their sources and label findings as pending when no report has been released.
What can prevent a complete public account?
Witness access and secrecy rules can limit outside scrutiny. The Death Penalty Information Center’s November 2018 report, Behind the Curtain: Secrecy and the Death Penalty in the United States, described restrictions on what witnesses could see or hear and limits on access to information such as when drugs were administered in the states it examined. It also discussed secrecy around drug sourcing and execution-team information.
The report examined states that carried out lethal-injection executions from January 1, 2011, through August 31, 2018. It reported that 17 states withheld at least some information about executions. That is a historical finding for the period studied, not a current count of states or a survey of every jurisdiction today.

The same report said that in 2017, more than 60% of executions using midazolam produced eyewitness accounts of problems. This is the report’s historical finding, tied to its stated year, drug, and approach to eyewitness accounts; it should not be read as a current rate or a finding about all executions.
What does Tennessee’s 2022 review show?
Tennessee illustrates one route from an execution-preparation problem to a publicly released third-party review. After the April 2022 reprieve of Oscar Smith, Governor Bill Lee commissioned former U.S. Attorney Ed Stanton to conduct an independent review. The governor’s office announced and released the review in December 2022.

The underlying report by Butler Snow LLP examined Tennessee execution operations and preparations from 2018 through 2022. It documented repeated failures to follow protocol, including failures involving drug testing. Those are findings of the review; they should be distinguished from later agency statements or advocacy groups’ characterizations.
In announcing the report, the governor’s office said it directed changes involving leadership, protocol, and training. The case shows why a reader should check both the investigation’s findings and the official response: the report identifies what the reviewer found, while the response describes actions officials said they would take.

What is known about Tennessee’s October 2026 review?
On October 3, 2026, the Associated Press reported that Governor Lee ordered a comprehensive third-party review after the Christa Pike execution attempt. The report also conveyed the Department of Correction’s assertion that it had followed protocol. The AP account did not provide findings from the new inquiry, so its conclusions remain pending in the cited reporting.
Tennessee’s Department of Correction says a revised lethal-injection protocol completed in December 2024 uses a single drug, pentobarbital. That is a Tennessee-specific description of the revised protocol; it does not establish which protocol applied in other states or determine what the new review will find.

How should readers compare investigations?
When comparing two incidents or jurisdictions, use the same questions for each rather than treating “reviewed” or “investigated” as proof of equivalent scrutiny.
