Yes—you can plan for an AI agent modeled on your digital traces to generate conversations after you die. But it would be a simulation, not your mind, consciousness, or a dependable record of what you would have thought. If you want your family to have this option, plan for consent, data control, clear disclosure, and a way to end the service—not just a collection of messages and photos.

What a posthumous AI agent can—and cannot—do

A posthumous conversational agent uses material such as messages, emails, recordings, or photographs to produce responses that resemble a person. The literature uses several overlapping labels, including “deadbot,” “griefbot,” “postmortem avatar,” and “AI afterlife.” Here, posthumous agent means a system that generates new outputs modeled on someone who has died.

Google Research authors Meredith Ringel Morris and Jed R. Brubaker call these systems “generative ghosts”: unlike a replay of a real recording, a generative system can create novel content. That novelty is also a limit. Its answers are model-generated and may be inaccurate; they are not evidence of the deceased person’s current thoughts, continuing identity, or wishes.

Aarhus University’s Conversations with the Dead project defines a griefbot as “an AI-powered chatbot designed to mimic a deceased person’s way of communicating.” The label is used variably, but the important distinction is whether a system is generating responses or simply presenting material the person actually created.

Decide whose consent and data are involved

Planning one of these systems involves more than the person being represented. Hollanek and Nowaczyk-Basińska distinguish three stakeholder positions: the data donor whose identity and material are modeled, the data recipient who holds or supplies relevant material, and the service interactant who uses the resulting agent. One person may occupy more than one role, but their interests are not automatically identical.

For example, a family member may possess years of private messages, but possession does not establish that the deceased person agreed to have those messages used to create an AI representation. Nor does one person’s consent necessarily resolve the privacy interests of everyone who exchanged messages with them. Make permission and boundaries explicit while the person represented can decide for themselves.

  • For the person represented: record whether they want an agent created, what materials may be used, who may access it, and whether there are topics or relationships it should not imitate.
  • For people whose data is included: consider the privacy of correspondents and other people depicted or recorded, not only the account holder’s files.
  • For people who may interact with it: make use voluntary and explain what the system is and what it can produce before anyone begins a conversation.

Set safeguards before anyone builds or uses it

In their 2024 article in Philosophy & Technology, Hollanek and Nowaczyk-Basińska recommend meaningful consent from both the person represented and service interactants, clear disclosure of capabilities and risks, limiting access to adults, and sensitive procedures for ending or retiring a deadbot. These are scholarly recommendations, not a universal legal requirement or an established global technical standard.

Use those recommendations as questions to ask of any service—or as design requirements if building one:

  • Consent and scope: Can the person represented choose whether an agent exists and specify what data it can use? Can that choice be changed before death?
  • Transparency: Is every interaction clearly presented as an AI simulation, rather than a message from the deceased? Are users told that answers may be novel or wrong?
  • Data control: What is collected, who can access it, how is it protected, and can it be deleted? Consider source files as well as the generated model or conversational history.
  • Access: Who is allowed to interact with the agent? The cited authors recommend limiting access to adults; actual service rules and laws may differ.
  • Boundaries and failure handling: Can the agent be prevented from making claims about the deceased’s wishes, giving consequential advice, or impersonating them outside the service? What happens when it produces an upsetting or inaccurate response?
  • Retirement: Is there a clear, respectful way for the person who planned it or its users to stop access and retire the agent?

Aarhus University’s Conversations with the Dead project likewise identifies consent, the deceased person’s privacy and digital legacy, and the risk of influencing people in vulnerable situations as central concerns. Treat an agent’s words as generated content, not as a source of authority for family decisions, unresolved conflicts, or statements the person never made.

Consider grief effects without assuming a single outcome

A griefbot may offer comfort or a perceived sense of presence for some people. It may also affect acceptance of the death and adjustment to life without the deceased. Aarhus University says empirical knowledge about these effects remains limited, so there is not a sound basis for presenting a griefbot as a validated grief treatment—or for claiming that it inevitably harms every user.

That uncertainty matters when deciding whether and when to offer access. The service should not pressure a bereaved person to interact, imply that continued use is necessary, or blur the difference between a generated response and a real memory. People should be able to pause or stop without losing control of the underlying family archive.

Evaluate a service on current evidence, not its label

Published work establishes that services in this category have existed, but a mention in an academic article is not a current endorsement. A 2024 Springer Nature article discusses Project December, which offered simulated text conversations, including conversations with someone deceased. A 2026 review indexed by ScienceDirect names Seance AI and HereAfter AI as commercial examples. Those references do not establish any service’s current availability, features, price, privacy practices, or geographic access.

Before entrusting a service with personal material, check its current primary-source terms and product information for:

  • Whether the represented person can provide advance consent and define the permitted use of their data.
  • Which kinds of material the service accepts, who controls it, and how deletion works.
  • How clearly generated speech, text, or images are labeled as simulated.
  • Who may interact with the agent, including whether minors are excluded.
  • How the service handles inaccurate, disturbing, or harmful outputs.
  • Whether users can end access and retire the agent, and what happens to stored data afterward.
  • Current availability, cost, and geographic coverage.

Do not infer privacy or safety from a service’s use of terms such as “legacy” or “memorial.” Read the current policies and ask what happens to the source material and generated outputs if the company changes its product or closes.

A practical way to plan a digital legacy

  1. Write down the intention. Decide whether you want a conversational simulation at all, and describe its purpose and boundaries in plain language. Choosing not to create one is also a valid digital-legacy decision.
  2. Specify permission and access. Identify which materials may be used, who may manage them, who may interact with the agent, and what should remain private.
  3. Separate authentic records from generated responses. Preserve original letters, recordings, and photographs as such. Keep any AI-generated material visibly identified as generated rather than blending it into the archive.
  4. Document deletion and retirement preferences. Say who may end the service, how access should be withdrawn, and what should happen to the data when it is retired.
  5. Revisit the plan. Tools and policies change. Review permissions and service terms while you are able to make decisions, rather than assuming a product will remain available or behave the same way indefinitely.

What the evidence does not establish

There is no directly relevant, attributable adoption, market-size, or clinical-outcome statistic in the cited material. Aarhus University’s project description says empirical knowledge about griefbot effects is limited. That means claims about how many people use these systems or whether they reliably help or harm bereaved people should not be treated as established from these sources.

The research literature frames AI afterlives as a developing area that needs further study. For now, the most defensible approach is to treat a posthumous agent as an optional, fallible simulation and make consent, privacy, disclosure, and retirement part of the plan from the outset.
