The FTC’s June 2023 lawsuit alleged that Amazon used confusing Prime sign-up screens and a difficult cancellation process to enroll or keep customers in recurring subscriptions. The case is no longer an unresolved lawsuit: Amazon, the FTC and two named executives reached a stipulated settlement order announced on September 25, 2025. It provides for a $2.5 billion total—$1 billion in civil penalties and $1.5 billion in consumer redress—and requires changes to Prime enrollment and cancellation. Some eligible U.S. customers may receive an automatic refund; eligibility depends on how they enrolled or tried to cancel and how much they used Prime.
What the FTC alleged Amazon did
In its June 2023 complaint, the Federal Trade Commission alleged that Amazon used interface designs it called “dark patterns” to steer people into Prime subscriptions without informed consent and make cancellation difficult. The agency brought claims under Section 5 of the FTC Act and the Restore Online Shoppers’ Confidence Act (ROSCA). The allegations were claims for the court to decide, not findings that should be treated as independently proven facts.
The FTC described checkout screens where a non-Prime purchase option could be harder to find, and a button could fail to make clear that choosing it also enrolled the customer in a recurring subscription. It also alleged that customers seeking to cancel faced multiple pages and offers before reaching the final cancellation step. The agency’s original account is in its 2023 announcement.
Then-FTC Chair Lina M. Khan characterized the allegations by saying Amazon “tricked and trapped people into recurring subscriptions without their consent.” That was the chair’s description of the complaint, not a court finding.

How the case ended
The FTC announced a settlement order with Amazon and two senior executives named in the case, Neil Lindsay and Jamil Ghani, on September 25, 2025. The case was filed in the U.S. District Court for the Western District of Washington as docket 2:23-cv-0932. The FTC’s case page records the entered order dated September 25, 2025.
The order calls for a $1 billion civil penalty and $1.5 billion in consumer redress, a combined $2.5 billion settlement. The FTC said the redress was intended to provide full relief for an estimated 35 million consumers affected by unwanted enrollment or deferred cancellation; that estimate is not a count of people who will necessarily receive a payment. The agency described the civil penalty as the largest ever in a case involving an FTC rule violation. These figures and the required changes are set out in the FTC’s settlement announcement.

A stipulated order resolves the case without a full trial verdict on every allegation. The FTC says stipulated final orders have the force of law when approved and signed by the district court judge; its case page lists the order as entered. FTC Chairman Andrew N. Ferguson called the settlement a “record-breaking, monumental win” in the agency’s announcement.
What the settlement requires Amazon to change
The order requires Amazon to cease unlawful Prime enrollment and cancellation practices. The FTC describes the required changes as including:

- Disclosure of material subscription terms, including price and renewal.
- A cancellation method that is easy to use and available through the same method used to sign up.
The FTC’s materials establish the order’s requirements, but do not provide a neutral assessment of how effective the changes have been in practice.

- Be a U.S. Prime customer.
- Have signed up through one of the challenged enrollment flows, or tried and failed to cancel Prime online, between June 23, 2019 and June 23, 2025.
- Have used no more than 20 Prime benefits in any 12-month period after enrolling.
The named enrollment flows are the universal Prime decision page, shipping selection page, single-page checkout and Prime Video enrollment flow. The FTC’s refund guidance explains eligibility and lists the settlement administrator’s information. Meeting the general criteria does not guarantee a particular person’s eligibility or payment amount.

No. The FTC says eligible customers do not need to submit a claim or form. Payments are issued automatically by mailed check, PayPal or Venmo, and the agency says eligible customers will receive refunds by April 2027. A payment expires 60 days after it is issued, so follow the instructions and deadline included with a legitimate payment.

Refunds cover Prime subscription fees and are capped at $200 total per eligible customer. Earlier payments were capped at $51; under the revised order, additional payments may bring an eligible customer’s total to $200. The FTC reported that more than $845 million had been distributed to eligible Prime customers as of September 2026. That reported distribution does not establish that every eligible customer has been paid or determine an individual’s amount.
How to avoid refund scams
The FTC says it is not contacting people about these refunds and will never ask for payment to obtain one. Treat an unsolicited message or offer demanding a fee as a scam, rather than paying or sharing sensitive information. Check current eligibility details and administrator contact information directly on the FTC’s official refund page.
