Section 702 of the Foreign Intelligence Surveillance Act automatically lapsed on June 12, 2026, according to the Congressional Research Service (CRS). A Senate Judiciary Committee statement on June 16 said collection could continue under an existing FISA Court certification until March 2027. The available official records do not establish whether Congress took further action after June, so Section 702’s status on October 8, 2026, cannot be stated definitively here.
What Section 702 does—and why its use is disputed
Section 702, part of Title VII of FISA, authorizes the government to target non-U.S. persons reasonably believed to be outside the United States to obtain foreign intelligence information. It does not authorize directly targeting U.S. persons under Section 702.
The privacy debate focuses in part on two consequences of that foreign-intelligence collection: communications involving U.S. persons may be acquired incidentally, and agencies—particularly the FBI—may later query collected information using U.S.-person identifiers. Critics argue that these searches need stronger safeguards; supporters emphasize the intelligence value of the authority.
What the House considered in 2026
The House debate involved different proposed extension periods and safeguards. The proposals should not be treated as one enacted package: the House Clerk’s record of an April procedural vote, bill text debated later that month, and a bill introduced in June represent different actions.

The dates and provisions in the table are drawn from the House Clerk’s record, the Congressional Record, and the text of H.R. 9115 as described by CRS. The different extension dates reflect separate proposals, not successive changes proven to have taken effect.
How the debate framed the trade-off
Supporters of reauthorization argued that losing the authority could harm national security and intelligence collection. Reform advocates focused on the privacy risks of incidental acquisition and later searches using U.S.-person identifiers, and called for tighter query controls, independent auditing, and stronger congressional oversight. The proposals differed: a safeguard discussed in one package should not be assumed to have appeared in every bill.

During April 29 floor debate, one House speaker cited nearly 3 million FBI U.S.-person queries in 2021 and said an audit found 278,000 noncompliant queries. The same speaker said the FBI reported 9,089 queries and 127 noncompliant queries in the year after the 2024 reforms. Those figures are claims in that speaker’s Congressional Record remarks, not independently validated by the records cited here; they should not be read as a like-for-like assessment of the reforms’ effects.
What happened when the authority reached its expiration date
CRS reported that the provision automatically repealed on June 12, 2026. A June 16 statement from the Senate Judiciary Committee, issued by Senator Dick Durbin, said collection could continue under an existing FISA Court certification until March 2027.

Those statements concern different legal mechanisms. The statutory provision’s lapse is not the same thing as the end of collection under a certification already in place. The certification itself is not available in the records cited here, so the Senate statement establishes what the committee said about continued collection—not the full terms or legal scope of that certification.

The official material described above establishes the June lapse and reports a basis for collection to continue into March 2027. It does not settle whether Congress took further action after June and before October 8, 2026. Without a later official record, it would be inaccurate to describe Section 702 as definitively reauthorized, still lapsed without qualification, or otherwise resolved as of October 8.
