U.S. stalking laws and procedures vary by jurisdiction, so general federal guidance cannot determine whether a particular person’s conduct meets the law where you live.
What counts as cyberstalking or harassment?
The U.S. Department of Justice’s Office on Violence Against Women describes stalking as “engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for his or her safety or the safety of others or suffer substantial emotional distress.” The Office on Women’s Health describes cyberstalking as using the Internet, email, or other electronic communications to stalk someone.
This is a general federal description, not a legal finding about a specific situation. State, territorial, tribal, and local laws can define offenses differently and set different requirements for evidence, reports, and court remedies. A rude message or other unpleasant interaction is not automatically a crime; repeated conduct, threats, fear, and the circumstances matter.
What can I do if someone is cyberstalking me?
If you may be in immediate danger
Call 911. If you can do so safely, move to a place where you are less exposed and contact someone you trust. Do not confront the person or make a device change if doing so could increase the danger.

If the danger is not immediate
Consider speaking with a victim advocate about safety planning and reporting. If you think a device or account is monitored, use a device the person cannot access to look for help. The FTC warns that removing monitoring software or taking other actions can alert an abuser and potentially escalate abuse.
How do I document online harassment?
When it is safe, keep a dated record of incidents and preserve relevant messages, emails, screenshots, and descriptions of what happened. Include dates and context so the record shows a pattern rather than isolated fragments. Keep copies of reports you make and any responses you receive.

Before deleting accounts, resetting a device, or replacing a phone, consider whether it contains useful evidence. The FTC specifically advises people who suspect stalkerware to consider evidence preservation before resetting or replacing a device. If preserving material could put you at risk, prioritize safety and ask an advocate for help deciding what to do.
Where should I report the conduct?
- Online service: You can report behavior to the site, app, or service where it occurred. Procedures and evidence-retention practices can change, so check that service’s current reporting process.
- Local law enforcement: Contact local police about stalking-related incidents or threats when appropriate. Report stalking, threats of violence, and hate crimes to law enforcement; for school-related cyberbullying, StopBullying.gov also recommends documenting the behavior and reporting it to platforms or service providers.
- School: If the conduct involves students or happens in a school context, consider reporting it to the school as well as to the relevant platform. The applicable response and legal rules can vary by location.
An advocate may help you plan for safety and navigate reporting. You do not have to decide alone which channel is safest or most appropriate.

What if I suspect stalkerware or phone monitoring?
The FTC uses “stalkerware” for software or an app installed on a device without the owner’s knowledge that can enable location tracking, access to messages or media, or other surveillance. If you suspect it, the FTC’s guidance is: “Think about your safety first.” Searching for help on a monitored phone may not be private.
Do not assume that deleting an app, resetting a phone, or changing accounts is a safe first step: those actions may alert the person monitoring you, remove evidence, or affect your access to accounts and services. The FTC identifies a new phone with an account the abuser cannot access and a factory reset as possible options for some people, not universal recommendations. Discuss device changes and evidence with an advocate using a safer device where possible.

Where can I get help if someone is stalking me?
The DOJ advises contacting local police to report stalking and lists these victim-support contacts:
- National Center for Victims of Crime: 855-4-VICTIM (855-484-2846).
- StrongHearts Native Helpline: 844-762-8483.
USA.gov links to state and local survivor services, including hotlines, counseling, shelter, and victim-compensation information. Availability and eligibility can depend on your location. The DOJ’s Office on Violence Against Women does not directly provide services to the public.

What do federal cyberstalking case numbers tell us?
An Office of Justice Programs summary published in 2023 reported 412 federal cyberstalking cases filed from 2010 through 2020, including 80 filed in 2019. These are federal filings in the studied period, not an estimate of how many people experience cyberstalking. The summary also notes that digital evidence can be difficult to link to an individual offender and that most victims in the analyzed federal cases knew the offender.
What rights or legal remedies might apply?
Federal descriptions can help explain the concept of stalking, but they do not establish the legal elements for a case in your jurisdiction. State, territorial, tribal, and local rules may differ, including rules for reporting, court procedures, and protective orders. For advice about your circumstances, contact a local victim-support organization, legal-aid service, or attorney familiar with your location.
