There is no single U.S. rule requiring every website to check every visitor’s age. Requirements depend on the state, the service, the content it offers, and the status of current litigation. The Supreme Court’s June 2025 decision upheld a particular Texas law for certain sexually explicit material; it did not approve every kind of age-check law. And the FTC’s February 2026 COPPA policy statement gives limited enforcement discretion to some services that collect age-check information under specified safeguards—not a blanket exemption.

What are age verification laws in the U.S.?

Age verification laws require or regulate checks intended to determine whether a person meets an age threshold, often before they can access specified online content or a service. The U.S. landscape is developing and uneven: state requirements target different services and content, while federal law and constitutional protections shape what governments and operators may do.

“Age verification” does not necessarily mean showing a government ID. The federal statutory text cited here lists examples such as credit or debit accounts, adult access codes or PINs, digital certificates verifying age, and other reasonable measures feasible with available technology in the statute’s covered context. Those examples do not establish that every site must use any particular method—or that every method is accepted under every state law.

The current legal developments below illustrate the patchwork, but they are not a complete state-by-state inventory. A state-specific answer can change with a statute’s effective date, an injunction or stay, or a later court order.

What did the Supreme Court decide about Texas’s age-check law?

On June 27, 2025, the Supreme Court decided Free Speech Coalition, Inc. v. Paxton. In a 6–3 decision, it affirmed the Fifth Circuit judgment upholding Texas H.B. 1181 against the challenge before it. The law targets online services meeting a statutory threshold for sexually explicit or harmful-to-minors content and requires proof of age to access covered material.

The Court applied intermediate scrutiny, not strict scrutiny, and concluded that the requirement survived that review. Justice Clarence Thomas, writing for the majority, said: “Because H. B. 1181 simply requires proof of age to access content that is obscene to minors, it does not directly regulate adults’ protected speech.” Justice Kagan dissented, joined by Justices Sotomayor and Jackson.

The decision is about that Texas law and the challenge before the Court. It is not a general ruling that all age checks are constitutional, or that the same reasoning necessarily applies to social-media accounts, app stores, operating systems, or broader categories of online speech.

Which states require age verification online?

The sources available for this overview do not establish a reliable, complete list of state laws and their current litigation status. Texas provides two examples of how state requirements can differ, but those examples cannot answer whether a specific service must check a user’s age in every other state.

Texas H.B. 1181: access to covered material

H.B. 1181 is the Texas law considered in Free Speech Coalition v. Paxton. Its age-verification requirement concerns access to material meeting the law’s sexually explicit or harmful-to-minors threshold. The Supreme Court’s decision upheld the requirement against the challenge in that case.

Texas H.B. 18: a separate law and appeal

In a July 24, 2026 opinion, the Fifth Circuit described H.B. 18 as requiring a digital service provider to verify users are at least 18 when the provider determines that more than one-third of its material is harmful material or obscene under Texas law, and to deny access to users under 18. The court said the challenge to that age-verification requirement was foreclosed by precedent. It considered other H.B. 18 provisions—including monitoring and filtering, targeted advertising, and unlawful-ad requirements—separately. This ruling concerns the provisions and challenge before that court; it does not settle the status of other states’ laws.

For an answer about a particular state or website, check the current statute, effective date, and any injunction, stay, or appellate order that applies. A law’s passage alone does not establish that every provision is currently enforceable.

Will I have to upload my ID to use websites?

Not as a universal U.S. requirement established by these legal developments. Neither the Supreme Court decision nor the federal statutory examples establish that every user must upload a government ID to every website. A particular service may ask for proof of age if a law that applies to it requires a check, but the legal materials discussed here do not establish one nationwide interface or verification method.

Possible approaches vary in what they ask a user to provide. The federal statutory text names credit or debit accounts, adult access codes or PINs, digital certificates, and other reasonable measures as examples in its covered context. A service’s actual method, what information it collects, and whether it satisfies the applicable law depend on the service and jurisdiction. Do not assume that an ID upload will always be required—or that another method will always be available.

How do age checks affect children’s privacy?

An age check can involve personal information, so the relevant questions are not only whether it works but what data is collected, why it is used, how long it is kept, and who receives it. The FTC addressed some of these issues in a February 25, 2026 policy statement on the Children’s Online Privacy Protection Act (COPPA) Rule.

The FTC said it would not bring COPPA Rule enforcement against certain general-audience and mixed-audience operators that collect, use, or disclose personal information solely to determine a user’s age without first obtaining verifiable parental consent, if they meet the statement’s conditions. The statement is limited: it does not exempt all age verification or all services from COPPA requirements.

Conditions in the FTC policy statement

  • Use the information only to determine age, and do not use or disclose it for another purpose.
  • Delete it promptly after it is no longer needed for age determination.
  • Limit third-party disclosures to parties reasonably assessed as able to protect the information’s confidentiality, security, and integrity.
  • Give clear notice to parents and children about the collection and use.
  • Use reasonable safeguards and take reasonable steps to ensure the verification method or provider is reasonably accurate.

The FTC described this as an enforcement policy that remains effective until final amendments to the Rule are published or the statement is withdrawn. Its Bureau of Consumer Protection Director, Christopher Mufarrige, called age-verification technologies “some of the most child-protective technologies to emerge in decades.” That is his characterization of the policy, not a finding that every technology or implementation protects children equally.

What does federal law say?

The 2024 text of 47 U.S.C. § 231 includes a good-faith affirmative defense for a defendant that uses reasonable measures to restrict minors’ access to material harmful to minors. It gives examples including credit cards, debit accounts, adult access codes or PINs, digital certificates verifying age, and other reasonable measures feasible under available technology. The cited statutory text also contains privacy protections for information collected to restrict access.

This is statutory background for the law’s covered context, not a nationwide requirement for all websites to verify every visitor. It should not be confused with either Texas H.B. 1181 or the FTC’s separate COPPA enforcement policy.

What should an online service consider when choosing an age check?

The law that applies to a service determines what it must do; there is no basis here for recommending one vendor or method as universally safest or most effective. Operators assessing an approach should examine:

  • Age signal: Does the method establish a date of birth, or only whether a person meets a threshold?
  • Data minimization and retention: What information is collected, and when is it deleted?
  • Disclosure and security: Does a third party receive information, and what safeguards and limits govern that disclosure?
  • Accuracy and errors: How is reasonable accuracy assessed, and what happens when a check fails or produces an incorrect result?
  • Friction and accessibility: What must users do, and can they complete the check?
  • Legal fit: Does the method meet the requirements that apply to this service, content, and jurisdiction?

For covered operators relying on the FTC’s February 2026 COPPA policy statement, purpose limitation, deletion, notice, safeguards, controlled disclosures, and reasonable accuracy are conditions of the stated enforcement discretion—not optional design suggestions.
