The House Judiciary Committee advanced the Fourth Amendment Is Not For Sale Act on July 19, 2023. That was a committee vote—not enactment—and the available reporting does not establish the bill’s later disposition. The proposal addressed government agencies’ purchases of personal information from data brokers, a practice supporters argued could bypass legal safeguards associated with direct requests for data.
What bill did the committee advance?
The measure was the Fourth Amendment Is Not For Sale Act. CyberScoop reported on July 19, 2023, that the House Judiciary Committee had advanced it. The report described the bill’s path beyond committee as uncertain; it does not establish whether the proposal later became law or what its complete legislative disposition was. The report said the House bill then had four Republican and four Democratic co-sponsors, including ranking committee member Rep. Jerry Nadler, and identified Sen. Ron Wyden as the original Senate sponsor. Those are details reported in 2023, not a current sponsorship list.
What would the bill stop data brokers from selling to government agencies?
The report described the proposal as addressing data brokers’ sale of consumer information to law enforcement and federal agencies. It cited location information and internet records as examples. Supporters’ concern was that an agency might buy commercially available personal information rather than seek it directly from a service provider through legal process that may require a warrant.

That describes the policy concern reported during the bill’s committee consideration, not a complete account of the bill’s operative language. The available reporting does not establish that every government purchase of data, every agency, or every category of information would have been covered; the bill text and any exceptions would be needed to answer those questions precisely.
Why did supporters object to buying data?
The debate centered on whether purchasing information from a commercial broker could let government obtain sensitive records without protections that might apply to a direct demand to the provider holding them. Rep. Jerry Nadler put the supporters’ position this way during the markup: “We have the Fourth Amendment for a reason. If law enforcement wants to gather information about you, they should need a warrant for that.”

Sen. Ron Wyden similarly said the act would “stop the government from using its credit card when it should be getting a warrant.” These statements express supporters’ rationale; they are not a legal ruling about when a warrant is required or a full description of the proposal’s scope.
Does this mean law enforcement could no longer access this kind of data at all?
No such conclusion follows from the report. It framed the proposal as limiting purchases from data brokers; it did not establish that law enforcement would lose all access to location information, internet records, or other relevant data. Access through a provider or another route depends on the applicable law and legal process. The report is not a detailed analysis of those rules or of the bill’s exceptions.

What did “moves forward” mean—and what is known now?
In the July 19, 2023 headline, “moves forward” referred to advancement by the House Judiciary Committee. A committee action is one step in the legislative process and does not itself make a proposal law. The CyberScoop report said the measure might be part of broader surveillance-reform discussions, while noting that what would happen next was unclear.
Later Congressional Record material should not be treated as proof of this Act’s status. A September 3, 2025 Senate record includes language concerning restrictions on data brokers and government agencies involving covered information of at-risk individuals. A June 29, 2026 House record includes data-broker registration and disclosure provisions. Those records concern related policy areas, but the cited material does not establish that either is the same measure as the 2023 Act or a continuation of its legislative path: Senate Congressional Record, September 3, 2025; House Congressional Record, June 29, 2026.
