Sometimes—but there is no single U.S. permit or federal approval that makes every autonomous-vehicle road test legal. Federal vehicle-safety law applies, and the state where each road segment lies may impose its own permits, operator requirements, and operating conditions. The answer depends on the location, vehicle, driver setup, and purpose of the test.
What determines whether a public-road test is legal?
For a U.S. test, check both federal vehicle-safety obligations and the rules of the state and local jurisdiction where the vehicle will operate. A permit or authorization in one state does not carry over to another. Rules may also distinguish a test with a human safety driver from driverless operation, and testing from passenger service or other public deployment.
NHTSA’s Automated Vehicle Safety page describes limited testing, research, and pilot activity on public streets. That overview is not permission for a particular vehicle or route: the agency also has federal safety oversight, including authority involving vehicle defects, recalls, and enforcement.
Federal requirements still apply
NHTSA’s 2016 Federal Automated Vehicles Policy states: “Manufacturers or other entities must comply with Federal law and applicable NHTSA regulations before operating vehicles on public roadways, whether or not they are in testing or in ‘normal’ operation.” That policy is historical; consult current requirements for an actual test.

NHTSA’s current Automated Driving Systems material describes its ADS safety guidance as voluntary, without a compliance requirement or enforcement mechanism as guidance. It addresses practices such as system safety, the operational design domain, object and event detection and response, and fallback behavior. Its voluntary status does not waive separate federal legal obligations, and it is not a general permit to test.
State rules can change the answer
States can regulate matters including driver licensing, registration, testing permits, operator conditions, permitted operating areas, disclosures, and crash reporting. These examples illustrate different approaches; they are not a complete state-by-state survey or a substitute for checking the current rules for a specific test.
California
The California DMV says a manufacturer with a permit to test with a safety driver is authorized to test on any public road in California. The DMV distinguishes that category from driverless testing permits. Its permit-holder information was dated September 17, 2026; check the live Autonomous Vehicle Permit Holders page and the requirements for the applicable permit category. This California authorization does not apply outside California.
Arizona
Arizona DOT publishes requirements for autonomous vehicles testing or operating without a driver, including federal-compliance considerations and required submissions. The department says it may issue a cease-and-desist letter when specified submissions are missing. Consult its testing and driverless-operation requirements; do not assume that the page’s driverless conditions automatically describe every test configuration.

Nevada
Nevada’s NRS Chapter 482A and NAC Chapter 482A address autonomous-vehicle testing and highway operation. The administrative regulations include testing credentials, while the statute includes crash-reporting provisions. Verify the current effective text and whether it applies to the vehicle and proposed test.

- Check whether rules differ for a human safety driver and driverless operation.
- Verify vehicle registration, title, permit, inspection, and any applicable federal compliance or exemption status.
- Confirm operator licensing, credentials, training, or designation requirements.
- Check restrictions on routes, operating areas, times, vehicle classes, and operating conditions.
- Identify crash-reporting, recordkeeping, and agency-disclosure obligations.
- Review any additional local traffic, road-use, insurance, or commercial-vehicle requirements.
For a specific operation, consult the current official rules for every jurisdiction involved and qualified counsel. The answer requires the actual test location and setup; the state examples above do not determine whether an individual test is authorized.
