Reverse charge does not apply to every service an NBFC buys. Under the notified categories in India’s GST law, recovery-agent services supplied to an NBFC are expressly covered; services from a Direct Selling Agent (DSA) require checking the applicable amendment and its conditions. For other purchases, the supplier, actual service, recipient and tax period determine whether a notified reverse-charge rule applies.

What the reverse-charge rule means for an NBFC

Section 9(3) of the Central Goods and Services Tax Act, 2017 lets the Government notify categories of supplies for which the recipient, rather than the supplier, pays tax on a reverse-charge basis. The Act states that the Government may “specify categories of supply of goods or services or both, the tax on which shall be paid on reverse charge basis by the recipient.” Read section 9(3) in the CBIC-hosted CGST Act.

The practical implication is that an NBFC’s industry classification does not itself put all its vendor invoices under reverse charge. A transaction must fit a category notified for the relevant period, including the described service, supplier and recipient conditions.

Recovery-agent services: the express NBFC category

Entry 8 of Notification No. 13/2017-Central Tax (Rate), issued by the Government of India on 28 June 2017 and effective from 1 July 2017, names “Services supplied by a recovery agent to a banking company or a financial institution or a non-banking financial company.” It makes the recipient located in the taxable territory liable for the central tax under reverse charge. For an NBFC, this is the clearest directly relevant example. Check whether the work actually supplied is recovery-agent service and whether the recipient and location meet the entry’s terms. A supplier’s invoice description alone does not establish that the transaction falls within the category.

DSA services: verify the operative amendment

CBIC’s central tax-rate index lists Notification No. 15/2018-Central Tax (Rate), dated 26 July 2018, as an amendment concerning services supplied by individual Direct Selling Agents (DSAs) to banks and NBFCs. Check CBIC’s central tax-rate index.

The index identifies the amendment’s subject but does not, by itself, establish its complete conditions or the current treatment of a particular DSA contract. Before classifying a DSA payment, review the operative notification wording for the transaction’s tax period and compare it with the actual contractual and service facts. Do not assume that every arrangement described as a DSA engagement qualifies.

Do not confuse sections 9(3) and 9(4)

Section 9(4) is a separate mechanism concerning notified taxable supplies from an unregistered supplier to a registered recipient. It does not mean that every purchase from an unregistered vendor automatically attracts reverse charge. Identify the applicable notification and tax period rather than treating supplier registration status alone as decisive. The distinction appears in the CGST Act text.

A practical transaction check for NBFC teams

  1. Describe the service actually received. Record the work performed and its scope, rather than relying only on an invoice label or vendor category.
  2. Match the supplier and recipient to the notification. For recovery-agent services, compare the facts with entry 8, including whether the recipient is an NBFC located in the taxable territory. For a DSA, check the amendment’s full operative wording.
  3. Use the correct tax period. Confirm the notification version and applicable central, state or integrated GST treatment for the period concerned; the base notification’s 2017 effective date does not prove that every provision remains unchanged.
  4. Keep the transaction evidence together. Retain the contract or scope of work, supplier details, recipient registration and location, invoice or other document required under the rules for that period, and the notification provision used in the classification.
  5. Verify process requirements separately. Liability under reverse charge and the documentation or reporting steps are distinct questions. Check current rules and forms before deciding how to document or report a transaction.

It is useful operational background, but FAQ material addressing GST implementation-era processes should not be treated as the sole authority for current filing mechanics; verify the rules and forms applicable to the relevant period.
