A semiconductor export control is a rule that can require authorization before certain chips, manufacturing equipment, software, or technical information are exported, transferred, or shared. Under the U.S. Export Administration Regulations (EAR), whether a rule applies depends on the specific item and its classification, the destination, the parties, the end use, and sometimes how foreign-produced items were made. A chip project may therefore face a compliance review even when no physical shipment is planned—but not every chip or chip-related activity is controlled.

What does “semiconductor export control” mean?

In this context, the term generally refers to U.S. controls administered by the Bureau of Industry and Security (BIS) under the EAR. The controls can apply to specified advanced-computing chips, some computers containing them, semiconductor manufacturing equipment, and related software or technology. They are not a blanket restriction on everything described as a semiconductor. A control can take different forms. It may restrict an item based on its technical characteristics and classification, require a license for a particular destination, or apply because of a customer or intended use. The applicable control and any authorization or exception must be assessed against the current EAR and the transaction’s facts; a destination alone does not determine the answer. BIS describes Commerce Control List-based controls in EAR Part 742 and end-user and end-use controls in EAR Part 744.

Which parts of a chip project could be affected?

Chips, computers, and manufacturing equipment

A project may need review before shipping chips or equipment, including certain advanced-computing items and semiconductor manufacturing equipment. A computer containing a controlled chip can also be relevant. The product’s marketing name or general description is not enough to establish whether a control applies; the specific technical characteristics and applicable classification matter.

Design files, software, and technical information

Export controls can matter even when no hardware crosses a border. Releasing controlled software or technology to a foreign person can raise a deemed-export or deemed-reexport question. The answer depends on the applicable control basis, the item’s classification, and the circumstances of the release; there are also limited exclusions. BIS addresses these issues in its Advanced Computing Rule FAQs. A team should not assume that a file is unrestricted simply because it is shared electronically or remains on a company’s systems.

Foreign-produced chips and equipment

Foreign manufacture by itself does not settle whether an item is subject to the EAR. A Foreign Direct Product Rule (FDP Rule) can bring certain foreign-produced items within EAR controls when defined product-scope and other conditions are met. That is a fact-specific scope analysis, not a rule that automatically covers all foreign-made chips. The EAR’s scope provisions are in Part 734.

How can a control affect a project schedule or design?

If a license requirement applies, a team may need to resolve authorization before it ships, transfers, or releases the controlled item or information. That can affect delivery dates, supplier or customer choices, and decisions about where work is performed or who can access technical materials. The available sources do not establish a standard license-processing time or guarantee an approval outcome, so a schedule should not rely on an assumed turnaround.

Controls can also shape project decisions earlier than shipment: for example, what a supplier provides, which facility will use a tool, who receives design access, or whether a proposed customer and end use require additional review. Those are planning implications, not proof that any particular project is prohibited. The result depends on the transaction-specific analysis.

How should a team check whether a control may apply?

Before shipping, transferring, or sharing chip-related items or technical information, assemble the facts below for an export-control review. This is a screening framework, not a legal determination.

  1. Identify and classify the item. Describe the chip, equipment, software, or technology accurately, then determine whether it has a Commerce Control List Export Control Classification Number (ECCN) or is otherwise subject to the EAR. Do not infer its status from a product label alone; check the relevant classification and current rules.
  2. Map the destination and route. Record where the item or information is going, including relevant transfer or reexport locations. Compare those facts with the controls that apply to the item and destination under the current EAR.
  3. Identify the parties and ownership. Document the consignee, end user, and other parties involved, and check whether applicable end-user restrictions or other provisions affect the transaction.
  4. Describe the intended end use and facility. Establish what the item will do, where it will be used, and whether a specified use or facility triggers additional restrictions. EAR § 744.23 addresses certain supercomputer, advanced-node integrated-circuit, and semiconductor-manufacturing-equipment uses when its regulated-knowledge condition is met; consult the live Part 744 text for the provision’s scope.
  5. Test foreign-produced item scope. If an item was made outside the United States, assess whether an FDP Rule’s product-scope and other conditions apply rather than treating foreign manufacture as conclusive. See the live EAR Part 734.
  6. Review technology access. Identify whether controlled software or technology will be released to foreign persons, including through project collaboration or remote access. Check the relevant ECCN and control basis; BIS’s FAQs explain why deemed-export treatment varies.
  7. Determine whether authorization is needed. Check applicable license requirements, exceptions, and other authorizations against the current regulations and facts. If the answer is uncertain or a control may apply, involve an export-control specialist before the relevant shipment, transfer, or release.

Does a China policy example mean certain chips are automatically cleared?

No. In an announcement dated January 13, 2026, BIS said it would review applications to export Nvidia H200, AMD MI325X, and similar chips to China on a case-by-case basis where applicants demonstrate that exports will not reduce capacity available to U.S. customers, the purchaser has export-compliance procedures that include customer screening, and the product has undergone independent third-party testing in the United States. This is a dated, conditional review policy for specified applications—not a blanket authorization, a guarantee of approval, or a rule covering every chip or transaction. See the BIS announcement.

What should project teams take away?

Treat export-control review as a transaction-specific project gate, not a conclusion that follows from the word “chip” or a single country. The central facts are the item and ECCN, destination and route, parties, end use and facility, foreign-produced item scope, and who will access controlled technology. Because ECCNs, country controls, lists, and licensing policies can change, use the current EAR and BIS notices when making a decision; the sources linked here include live regulation pages and dated explanatory material.
