Describe the plate, state, dates, and records you seek in writing. If a record appears inaccurate or was used improperly, ask that custodian what review or complaint process applies. In California, a public-records request can seek agency records, but it does not guarantee disclosure of your individual scan history; rules depend on the jurisdiction, operator, record, and any applicable exemptions.
Start by identifying who may hold the record
An ALPR observation is created when a camera captures a plate and software reads its characters. The operator may also store a vehicle image and the date, time, and location of the observation. The fields vary by system, so do not assume every camera or agency keeps the same information.
List the public bodies that could have scanned the vehicle: for example, a city or county police agency, a state agency, or a parking or transportation agency. If a private vendor operates the system, find out which public agency controls it or can access its records. The reviewed California sources do not establish that a vendor must respond directly to an individual in every jurisdiction.
Search the likely holder’s website for “automated license plate reader,” “automated license plate recognition,” “ALPR,” or “LPR.” California law-enforcement agencies are required under SB 34 to have a written ALPR usage and privacy policy, according to the California Attorney General. The policy can help identify the custodian, collection purposes, retention schedule, sharing rules, audits, and privacy contact. It is a starting point—not proof that the agency offers a personal data-access portal.

Choose the request route that matches the record

The federal Driver’s Privacy Protection Act concerns personal information in motor vehicle records. It does not turn a DMV registration request into a search for ALPR observations.
Make a focused written request
Use the agency’s stated form or channel and address the request to the records custodian named in its policy. Include enough detail to help locate records without implying that they must exist or be disclosed.

- Identify the plate number and issuing state; include the vehicle description if it helps distinguish the vehicle.
- Give a specific date or date range and, if relevant, a location or incident reference.
- Name the records you seek: detections, plate or vehicle images, observation time and location fields, access or disclosure logs, or records showing a particular use or sharing.
- Ask which retention schedule applies and whether responsive records have already been deleted.
- Request that the agency identify the process for personal-data access or amendment if that is separate from its public-records channel.
For example: “I request records held by [agency] concerning ALPR observations of plate [plate number], issued by [state], from [start date] through [end date]. Please include any responsive detection records and associated images, date/time and location fields, and records of access or disclosure for that period. Please also identify the applicable retention schedule and whether any responsive records have been deleted. If a different process applies to a request for personal information or correction, please direct me to the appropriate contact.” Tailor the categories and dates to what you actually need.
If the agency denies the request or provides an incomplete response
Ask the agency to explain the specific exemption, privilege, or other basis for withholding records; whether any reasonably separable material can be released; and what appeal or administrative review procedure is available. Keep the request and response together.

California DOJ guidance tells law-enforcement agencies to consider applicable privileges and exemptions when ALPR information is sought through public-records requests or compulsory process. A California Supreme Court opinion involving a CPRA request for ALPR policies and records concerning use and retention likewise does not establish that every individual scan must be disclosed. Outcomes depend on the particular record and applicable law.
Challenge a suspected error or misuse
Write to the custodian identified in the policy. Describe what you believe is wrong or improper, identify the relevant dates and records, and explain what review you are seeking. Ask which correction, complaint, or oversight procedure applies and whether the disputed information can be reviewed while the issue is considered. Preserve the response and any supporting documents.

There is no single correction process established for every ALPR record or agency in the reviewed California sources, and the available rights vary by jurisdiction and operator. Do not assume a request will cause the record to be corrected or deleted; ask the specific custodian what authority and procedure apply.

Retention and sharing are policy-specific. California’s Bureau of Automotive Repair (BAR) says its ALPR information follows its file-retention policy and permits sharing under stated exceptions, including authorized law-enforcement purposes and certain public agencies under confidentiality agreements. BAR’s policy is not a statewide retention rule. Santa Monica describes its own controls and says it does not share ALPR information with other California agencies without a formal request. Those examples illustrate why the policy for the actual system matters.

BAR’s policy, effective April 28, 2026, says its ALPR information will be collected only to evaluate Smog Check Program effectiveness, conduct research, develop and implement regulations, and support emissions inventories. That purpose statement applies to BAR’s program, not to police or other ALPR systems.
The California State Auditor’s 2019-118 audit report, published in 2020, said the majority of California law-enforcement agencies collected and used ALPR images. The audit summary also identified shortcomings among audited agencies in policy clarity, access oversight, and data destruction. Those are historical audit findings, not a description of every agency’s current practices.
